Для кваліфікації вчинку як кримінального правопорушення необхідна наявність двох ознак: по-перше, вчинку або поведінки, які заборонені законом, або ж невиконання певного обов’язку, що вимагається законом, а по-друге, під час неправомірних дій правопорушник повинен мати певний злочинний намір. Наприклад, спричинення смерті людини є протиправною дією, яка є складовою злочину «вбивство». Однак, якщо смерть іншої людини спричиняється випадково, це не є вбивством. Правопорушник не мав злочинного наміру, необхідного для вбивства як кримінального злочину. Навмисне спричинення смерті людини є вбивством, тому що протиправна дія (завдання смерті) та злочинний намір збігаються у часі. Так само, якщо людина збирається щось вкрасти, то вона має злочинний намір. Однак не можна сказати, що така людина вчинила злочин, поки вона насправді щось не вкраде, маючи при цьому злочинний намір.
Існують чотири ступені злочинних намірів, або злочинного психічного стану: умисел, усвідомлення наслідків вчинку, необачність (груба необережність) та недбалість. Заборонений вчинок не є злочином, якщо відсутній хоча б один із цих злочинних психічних станів. Винятки допускаються у визначенні деяких злочинів, за які передбачена сувора відповідальність, наприклад, у галузі охорони здоров’я та забезпечення громадської безпеки. Продаж неякісних продуктів харчування є порушенням закону, навіть якщо продавець не знав, що продукти зіпсовані.
Тягар доведення та ступінь переконливості доказів. Виступаючи обвинувачем у справі, держава повинна довести вину обвинуваченого так, аби не залишалось жодної розумної підстави для сумнівів. Аби виграти справу, захисту достатньо поставити обвинувачення держави під обґрунтований сумнів. Розумний сумнів ґрунтується на здоровому глузді.
Іноді обвинувачений може поставити обвинувачення держави під обґрунтований сумнів, навіть не виставляючи жодного свідка. Наприклад, обвинувачення із самого початку може бути непереконливим або обвинувачений може довести під час перехресного опитування свідків обвинувачення, що обвинувачення держави є сумнівними. Ступінь переконливості доказів обвинуваченого визначається наведенням вагоміших доказів. Якщо обвинувачений подає заяву про факти, що спростовують обвинувачення, він має також взяти на себе ризик можливої невдачі у намаганні переконати присяжних. Поширеними типами такого захисту є самозахист, захист посиланням на необхідність або на примус.
