За конституцією, прийнятою Верховною Радою 1996 року, Україна визначається як суверенна, незалежна, демократична, соціальна й правова держава. Державна влада в Україні здійснюється на засадах її поділу на законодавчу, виконавчу та судову. Права й свободи людини та їх гарантії визначають зміст і спрямованість діяльності держави. Носієм суверенітету і єдиним джерелом влади в Україні є народ, який здійснює її «безпосередньо, а також через органи державної влади та органи місцевого самоврядування». Принцип верховенства права підкреслює, що в Україні має панувати право як загальна оцінка ступеня свободи, рівності і справедливості. Права та свободи людини і їх гарантії визначають зміст і спрямованість діяльності держави. Конституція складається із 161 статті, включаючи преамбулу та 15 розділів. Чинна Конституція України була позитивно оцінена найавторитетнішою в галузі конституційного законодавства Європейською комісією Ради Європи.
Конституція України має найвищу юридичну силу. Закони та інші нормативно- правові акти приймаються на основі Конституції й повинні відповідати їй. Норми Конституції є нормами прямої дії. Звернення до суду для захисту конституційних прав і свобод людини та громадянина гарантується безпосередньо на підставі Конституції України. Згідно зі статтею 3, людина, її життя і здоров’я, честь і гідність, недоторканність і безпека визнаються в Україні найвищою соціальною цінністю. Усі люди є вільними та рівними у своїй гідності та правах. Права і свободи людини є невідчужуваними й непорушними. Вони не є вичерпними. Конституційні права й свободи гарантуються і не можуть бути скасовані. Громадяни мають рівні конституційні права й свободи і є рівними перед законом. Не може бути жодних привілеїв чи обмежень за ознаками раси, кольору шкіри, політичних, релігійних та інших переконань, статі, етнічного й соціального походження, майнового стану, місця проживання, за мовними чи іншими ознаками. Права й свободи людини і громадянина захищаються судом. Кожному гарантується право на оскарження в суді рішень, дій чи бездіяльності органів державної влади, органів місцевого самоврядування, посадових і службових осіб. Кожен має право звертатися за захистом своїх прав до Уповноваженого Верховної Ради України з прав людини.
С. Законопроект про внесення змін до Конституції України може бути поданий до Верховної Ради президентом або не менш як третиною народних депутатів від конституційного складу Верховної Ради. Законопроект про внесення змін до розділу І «Загальні засади», розділу III «Вибори. Референдум» і розділу XIII «Внесення змін до Конституції України» подається до Верховної Ради президентом або не менш як двома третинами від конституційного складу Верховної Ради і за умови його прийняття не менш як двома третинами від конституційного складу Верховної Ради затверджується всеукраїнським референдумом, який призначається президентом. Законопроект про внесення змін до Конституції розглядається Верховною Радою за наявності висновку Конституційного суду щодо відповідності законопроекту вимогам статей 157 і 158 цієї конституції.
