Конституція України встановлює, що народне волевиявлення здійснюється через вибори, референдум та інші форми безпосередньої демократії. Вибори президента України, а також вибори до органів державної влади та органів місцевого самоврядування відбуваються на основі загального, рівного і прямого виборчого права. Право голосу на виборах мають громадяни України, яким виповнилося вісімнадцять років. Права голосу позбавлені лише громадяни, визнані недієздатними за рішенням суду. Участь громадян України у виборах є добровільною. Застосування насильства, погроз, обману, підкупу чи будь-яких інших дій, що перешкоджають вільному формуванню та вільному виявленню волі виборця, забороняється. Виборчий процес включає такі етапи: 1) утворення територіальних виборчих округів; 2) утворення виборчих дільниць; 3) формування виборчих комісій; 4) складання списків виборців, їх перевірка й уточнення; 5) висування та реєстрація кандидатів; 6) проведення передвиборної агітації; 7) голосування у день виборів; 8) підрахунок голосів виборців та встановлення результатів виборів.
Б. На національному рівні Україна обирає президента й законодавчі органи влади. Президент обирається громадянами України шляхом таємного голосування терміном на п’ять років. Одна й та сама особа не може бути президентом України більше ніж два терміни підряд. Кандидат може висуватися партією або виборчим блоком партій. Переможцем є кандидат, що набрав 50 відсотків поданих голосів. Якщо жодний із кандидатів не зможе подолати цей бар’єр, призначається повторне голосування й два кандидати, що набрали найбільшу кількість голосів, включаються до виборчого бюлетеня. Драматичні політичні події в Україні спричинили численні зміни в системі парламентських виборів. Верховна Рада кожного нового скликання обиралася згідно з різними законами. Починаючи з 2006 року всі 450 депутатів обираються за системою пропорційного представництва. За цією системою частка місць партії у парламенті відповідає отриманій нею частці голосів виборців й таким чином забезпечується більш точне врахування громадської думки. Згідно з законодавством України, тільки ті партії та блоки, що отримали не менше трьох відсотків голосів, беруть участь у розподілі депутатських мандатів. Народні депутати України обираються на п’ятирічний термін.
Україна має багатопартійну систему, що передбачає врахування інтересів меншин. Багатопартійна система є засобом упорядкування політичного протистояння у плюралістичному суспільстві і, таким чином, є ознакою демократії. Міністерством юстиції України зареєстровано понад 160 політичних партій. Чимало з них мають незначну кількість членів і є невідомими широкому загалу. Невеликі партії часто об’єднуються у багатопартійні виборчі блоки для участі у парламентських виборах. Більшість партій мають незначні шанси пройти до парламенту самостійно. Для створення правлячої більшості партії та блоки мають формувати коаліції, які часто бувають нестійкими і спричинюють нестабільність.
