The rule of law is a backbone of any civilized society. Awareness of the rule of law in Ukraine does not reflect the fundamental concept of law as a means, due to which the society limits the power. Regulations are commonly beyond the ideas, incorporated in the primary sources - the Constitution of Ukraine and the laws, distorting their real legal meaning and objective set by the legislator. Judicial interpretation of legal norms is usually limited to the literal communication of their contents, whereby judges avoid their duty to clarify the real “spirit of law”, and to apply the principle of the rule of law to protect rights against infringements from the side of the legislator. Institutional structure of the judicial system does not ensure either due protection of rights, or uniformity in law enforcement.
An individual feels safe where the judicial branch is independent and powerful. The Ukrainian Constitution provides for an independent judiciary; however, in practice the judiciary is subject to considerable political interference from the executive branch and suffers from corruption and inefficiency. The courts are funded through the Ministry of Justice, which controls the organizational support of the courts, including staffing matters, training forjudges, logistics and procurement, and statistical and information support. In 2006 President of Ukraine approved a strategic plan for improving the country’s court system and creating a European standard judiciary. Lawmakers gave preliminary approval to two draft laws focused on the removal of subjective factors in court practices in order to prevent fraud through a better mechanism of selecting judges, their higher transparency and responsibility. Since then, the draft laws have never been discussed in parliament due to various crises.

Правосуддя в Україні здійснюється виключно судами. Юрисдикція судів поширюється на всі правовідносини, що виникають у державі. Судову систему України складають суди загальної юрисдикції та Конституційний Суд України. Конституційний Суд України є єдиним органом конституційної юрисдикції в Україні. Він вирішує питання щодо відповідності законів та інших правових актів Конституції й надає офіційне тлумачення Конституції та законів. Рішення Конституційного Суду є обов’язковими для виконання на всій території країни. Вони є остаточними і не підлягають оскарженню. Закони та інші правові акти або їх окремі положення, що визнані неконституційними, втрачають юридичну силу. Єдина система судів загальної юрисдикції в Україні будується за принципами територіальності й спеціалізації. Разом із загальними судами, які розглядають цивільні, кримінальні та інші справи, віднесені до їх підсудності, до системи також входять спеціалізовані суди, а саме адміністративні та господарські. Найвищим
судовим органом у системі судів загальної юрисдикції є Верховний Суд України. Вищими судовими органами спеціалізованих судів є відповідні вищі спеціалізовані суди.
Справи в судах першої інстанції розглядаються суддею одноособово, колегією суддів або судом присяжних. Народ безпосередньо бере участь у здійсненні правосуддя через народних засідателів і присяжних, які мають однакові з професійними суддями права стосовно розгляду справи або винесення судового рішення. Перше призначення на посаду професійного судді строком на п’ять років здійснюється президентом України на підставі рекомендації відповідної кваліфікаційної комісії суддів. Усі інші судді, крім судців Конституційного Суду, обираються безстроково Верховною Радою України. Суддями спеціалізованих судів можуть бути особи, які мають фахову підготовку з питань юрисдикції цих судів. Незалежність і недоторканність суддів гарантуються Конституцією і законами України. Суддя не може бути без згоди Верховної Ради України затриманий чи заарештований до винесення обвинувального вироку судом. Суддя звільняється з посади органом, що його обрав або призначив, у разі: 1) закінчення строку, на який його обрано чи призначено; 2) досягнення суддею шістдесяти п’яти років; 3) неможливості виконувати свої повноваження за станом здоров’я; 4) порушення суддею вимог щодо несумісності; 5) порушення суддею присяги; 6) набрання законної сили обвинувальним вироком щодо нього; 7) припинення його громадянства; 8) визнання його безвісно відсутнім або оголошення померлим; 9) подання суддею заяви про відставку або про звільнення з посади за власним бажанням.
