1). A second zone free from nuclear weapons in a populated part of the world was established in 1985 by the South Pacific Nuclear Free Zone Treaty, also known as the Treaty of Rarotonga, which entered into force on 11 December 1986.

2). Ten of the 13 members of the South Pacific Forum had ratified the Treaty as of 31 July 1989, undertaking not to manufacture or otherwise acquire or have control over any nuclear explosive device inside or outside the zone, and to prevent in their territories the stationing as well as the testing of any such device.

3). In addition, the Treaty prohibits the dumping of radioactive wastes and other radioactive material at sea anywhere within the zone.

4). The authors of the Treaty recognised that its parties could be responsible only for actions regarding their own ships and aircraft; consequently, nothing in the Treaty affects the rights of any State under international law with regard to freedom of the seas.

5). Under Protocol 1, France, the United Kingdom and the United States would undertake not to manufacture, station or test nuclear explosive devices in the territories situated within the zone for which they are internationally responsible.

6). None of the three States has so far signed Protocol 1.

7). Under Protocol 2, all five nuclear-weapon States would undertake not to use or threaten to use a nuclear explosive device against the parties to the Treaty or against any territory within the zone for which a party to Protocol 1 — France, the United Kingdom or the United States — would be internationally responsible.

8). Protocol 3 prohibits tests of any nuclear explosive device anywhere within the zone and is open for signature by all five nuclear-weapon States.

9). China and the Soviet Union have ratified Protocols 2 and 3.
