S.S. m/v "INCHMULL"

In conformity with Charter Party, Dated, ... I, the master of the above named Vessel, herewith beg to inform you that the said Vessel arrived at the port of Leningrad at 0920 a.m. on the 26th September 1955, and is ready to commence loading cargo.

You are, therefore, kindly requested to commence loading immediately,

Notice of readiness to load

Messrs. Exportless, Leningrad,

c/o Messrs. Inflot Dear Sirs,

I hereby confirm verbal conversation of this afternoon, according to which the Bjorn Clausen will be placed at your dis­posal as from 0800 a. m. on Tuesday the 31st inst. ready to load in accordance with terms and conditions laid down in Charter Party dated 20th May 1970, Copenhagen.

I agree time is not to count till June 30th, as stated in said Charter Party.

IV. Ship's protest

On May 5th, 1970 the s/s "G" trading under the USSR flag, Owners — the Baltic State Steamship Line sailed from "D" to having on board cargo of 5,600 tons of wheat.

The vessel left the port of "A" in a seaworthy condition pos­sessing the Certificate of Register of Shipping of the USSR and she was loaded in accordance with her loading line.

On May 12th, 13th and 14th while crossing the North Sea the vessel met with rough weather. The N. W. wind was blowing all these days attaining force 10, the state of the sea was 8. The ves­sel was subject to violent rolling. Heavy seas on several occasions swept the vessel's deck and cargo hatches.

Although the cargo hatches were properly covered with three tarpaulines which were in good condition and the hold ventilators with covers were turned leeward, it is quite possible that owing to the storm, or to some latent defects of the vessel, which could not have been established before the voyage even by due diligence of the carrier, the sea water could have penetrated into the cargo holds and damaged the goods.

In view of the above I, Master of the s/s M" note a protest in order to protect the shipowner's interests against any possible claim which may arise on the part of anybody.
