John Morton & Co., Dundee, despite the fact that the first 16 containers arrived on 12 February. We cannot understand what has happened to the missing containers and the delay is causing a great disorganization at the consignee’s factory. We must ask you to look into the matter and arrange for the missing containers to be forwarded at once.

Dear Sirs,
We regret to inform you that the machines which arrived by s.s. PSKOV in execution of Contract 17/123 have come with a two months delay. You will remember that in accordance with the Contract the shipment was to have been effected at the end of January. However in spite of our numerous letters you failed to deliver the goods in the stipulated time. Since this is an f.o.b. transaction we had to change our loading programme and this alone caused us considerable inconvenience. Also the delay has exceeded six weeks which is a gross infringement of the contract and we feel entitled to claim from you agreed and liquidated damages at the rate stipulated in the Contract which makes $ ... You will certainly understand that we intend to settle the matter amicably.
However, if you refuse to meet our claim we shall have to refer the matter to the Arbitration court at the Russian Federation Chamber of Commerce and Industry, Moscow.
We are sure you will give the matter your immediate attention.

Dear Sirs,
We have received two shipments from John Brown Engineering on the s.s. Thomas Jefferson when it discharged in St. Petersburg in September.
On unpacking the crates our clients discovered a few shortages in four crates. With this letter we enclose Experts Examination Acts Nos. 15912, 21313, 212314 and 107630 and a list detailing the missing components.
These shortages are causes of great inconvenience to us necessitating the making of constant excuses to our customers.
It is essential that we deliver part of the consignment to our Finnish customers on time, as this was a trial order from them and it would give us an opening in the Scandinavian market.
Unless we receive the missing components within the next week we will take legal action.

As a result of this situation we sustain heavy losses because we cannot fulfill our contractual obligations to our clients. In this situation we are prepared to retain the goods if you reduce the price, say, by 40 %.
