Конвенция опризнании
иприведении висполнение
трансграничных медиативных соглашений
Статья 1. Предмет Конвенции
Настоящая Конвенция применяется к признанию и (или) приве­дению в исполнение трансграничных медиативных соглашений, со­держащих гражданско-правовые, торговые, семейно-правовые и (или) трудоправовые условия.
Статья 2. Определения понятий
1. «Медиация» в настоящей Конвенции определяется так же, как она определена в пункте 3 статьи 1 Конвенции Организации Объединен­ных Наций о международных мировых соглашениях, достигнутых в результате медиации (Нью-Йорк, 2018).
2. Медиативное соглашение является трансграничным, если:
1) Стороны медиативного соглашения имеют гражданство (постоян­ное местожительство, учреждены, имеют коммерческое предприятие) в разных государствах, одно из которых является Договаривающейся Стороной, либо
2) Стороны медиативного соглашения имеют гражданство (постоян­ное местожительство, учреждены, имеют коммерческое предприятие) в одном государстве, и
а) объект медиативного соглашения находится на территории
другого государства, являющегося Договаривающейся Стороной, или
б) медиативное соглашение заключено на территории другого го-
сударства, являющегося Договаривающейся Стороной, или
в) медиативное соглашение подлежит исполнению (полностью или частично) на территории другого государства, являющегося Догова­ривающейся Стороной, либо
3) В иных случаях связи медиативного соглашения с более чем одним государством, одно из которых является Договаривающейся Стороной и с которой медиативное соглашение имеет тесную связь.

Статья 3. Отказ в признании и(или) приведении в исполнение
1. Договаривающаяся Сторона может отказать в признании и(или) приведении в исполнение трансграничного медиативного соглашения только по основаниям, указанным в настоящей статье.
2. В признании и приведении в исполнение трансграничного ме­диативного соглашения может быть отказано по просьбе стороны медиативного соглашения, против которой испрашивается признание и приведение в исполнение, если эта сторона докажет, что трансгра­ничное медиативное соглашение:
1) не было заключено, или
2) недействительно, или
3) не может быть исполнено, в том числе ввиду соглашения сторон о запрете признания и (или) приведения в исполнение этого трансгра­ничного медиативного соглашения, или
4) утратило юридическую силу.
3. В признании и приведении в исполнение трансграничного ме­диативного соглашения может быть отказано и без просьбы стороны медиативного соглашения, если компетентный суд Договаривающейся Стороны, в котором испрашивается признание и приведение в испол­нение, установит, что:
1) Признание и (или) приведение в исполнение трансграничного медиативного соглашения противоречит публичному порядку этой Договаривающейся Стороны, и (или)
2) трансграничное медиативное соглашение заключено по правово­му спору, который не может быть урегулирован посредством медиации согласно праву этой Договаривающейся Стороны.
Статья 4. Процедура признания и (или) приведения в исполнение
1. Трансграничное медиативное соглашение подлежит признанию и (или) приведению в исполнение в Договаривающихся Сторонах согласно настоящей Конвенции по письменному заявлению стороны такого медиативного соглашения.
2. Заявление о признании и (или) приведении в исполнение транс­граничного медиативного соглашения подается в суд Договариваю­щейся Стороны, компетентный согласно ее законодательству рас­сматривать такие заявления.
К заявлению прилагается трансграничное медиативное соглашение, подлежащее признанию и (или) приведению в исполнение. Заявление и трансграничное медиативное соглашение должны быть переведены на язык запрашиваемой Договаривающейся Стороны.
