Black: Yes, you are quite right. I’ll do my best to avoid delays in future. Your deliveries will be given the close attention. We’ll compensate our fault.
Sedov: This sounds encouraging. But there is another difficulty. Unfortunately, we have more breakages than we should like to have. The cases are securely nailed, so your Packing Department seems to be responsible for inadequate packing of the goods inside.
Black: It’s out of my business. Have you taken this up with the transport people? I know that they are quite often careless while loading or unloading. Was our expert present at the moment of nailing the boxes?
Sedov: Yes, he was. Here is a copy of the Packing Certificate with his personal stamp and signature.
Black: I am sorry, that you have had these problems. I’ll go into the document by myself and clarify the matter.
Sedov: Good. Thank you for your understanding and cooperation.
Black: Don’t mention it. Your company, Mr Sedov, is a reputable partner and we appreciate our cooperation. If you have any problems, apply to me at once. I beg your pardon for the inconveniences caused.
Sedov: Can I consider the matter settled?
Black: Yes, you can. I get down to your business just now.
Please, be available within an hour. I’ll make you a call.

1. Read and translate the dialogue.
Claim
Mr Brown receives Lavrov from Rossimport to discuss the Buyer’s complaint about a delay in delivery
Brown: Good morning! Was your trip good? Weather in London is very cold. It is much warmer in Moscow, isn’t it?
Lavrov: My trip was good enough and I like cold weather.
Brown: Really? Why?
Lavrov: May be, because I was born in winter, in January.
Brown: So was I. May be, this will help us to come to the
agreement.
Lavrov: May be, and now let’s get down to business.
Brown: We have looked into your complaint and in our opi-
nion it isn’t justified.
Lavrov: I’m afraid we can’t agree with you here. I think I should refer you to the delivery Clause of our Contract. It says that the delivery is to be made not later than the end of September.
Brown: As a matter of fact, we passed the goods on to our forwarding agents at the works on 20
th
October. I’ve brought a receipt with me signed by the agents to confirm my words. Will you have a look at it?
Lavrov: I want to draw your attention to such a thing. According to the Contract it is the Date of the Bill of Lading which is considered to be the date of delivery – the date is 25
th
, September. If this is taken into account we are entitled to claim compensation for a month’s overtime.
Brown: What amount of compensation are you thinking of? Lavrov: We have calculated it on the basis of the provisions
stipulated in the Contract.
Brown: Can I look through your calculations to get a better
idea of the figures?

Lavrov: Here you are. They show the exact sum of the
agreed and liquidated damages.
Brown: That’s the matter. I think I should like some time to
go into all this. What is about our meeting on Thursday?
Lavrov: Why not? But we’d appreciate it if you could speed
up the decision of the matter.
Brown: Of course, I am sure it won’t take us long. What are
you doing in the evening?
Lavrov: I am going to prepare for the report. Brown: You mean the meeting devoted to the business rela-
tions between England and Russia?
Lavrov: Yes, just this. The report is one of the reasons for my
future business trip to London again.
Brown: Is Russia going to continue her partnership with
England?
Lavrov: Yes, of course. We should like even to expand it. Brown: It is good. I have always wanted to work with the
Russian companies. Have you been in the trade business for a long time?
Lavrov: All my life. Good-bye, Mr Brown. Brown: I could guess it. Good-bye, Mr Lavrov.
