Re: «Mikhaylo Lomonosov» in Aalesund 21.08.2000

No cargo was discharged in Aalesund for following reason.

Upon opening of hatches it was noted that the cargo came from fac­tory vessels «Sovjetsk» and «Matochkin Shar». Cargo from same two vessels was discharged in Aalesund from «Bazaltovyy» on 14th and 15th of August to the same receiver. It was then stated through batcerialogical test that the cargo was not in accordance with requirements for first class commercial product.

The receiver is therefore afraid that also cargo on board «Mikhaylo Lomonosov» is of bad quality. He is therefore not willing to accept this-, cargo.

If a new bacteriological examination is to be carried out, it will take 3—4 days to have the result of the analysis.

Re: Shortages on discharging in Turkish ports

Dear Sir,

On discharging of several vessels in Turkish ports, each time a shor­tage of bags has been ascertained. Therefore we paid more attention to< the control of counting in the port of Rijeka and tried to find out what was happening on discharging in Turkish ports. We ascertained that Tur­kish official authorities (Customs) on counting bags took in. consideration only sound and partly damaged bags, and did not count completely dama­ged bags, at all, from which contents have leaked, or they did not add at all newly bagged cargo to complete quantity which has been supplied. Ac­cording to their regulations, they are not obliged to register afterwards new­ly bagged bags, but they must count, beside sound and partly damaged bags, completely damaged bags too. Only in that way total number of supplied bags may be exactly ascertained.

The realization of this information is of common interest, because you, as carrier, are responsible for number of packages (bags), and we, as shippers, are interested that there were no unnecessary claims.

I herewith inform you that having completed loading to-day at 14.00. hours we've found out that 126, 570 cartons have been taken aboard; as per ship's tally whereas according to shore figures the total amount of cartons loaded comes to 126, 800 cartons.

Besides, due to improper slinging several cartons have dropped front the sling and were totally broken.

Taking into consideration that the bill of lading must be signed clean, I therefore, on behalf of my owners, must make reserves regarding 230 cartons in dispute and the damage caused to the cargo of cartons.

We wish to inform you that today when loading lots of cargo in pallets there came on board pallets containing both 50 and 60 boxes.

Please, advise your dockers to put only 50 boxes in each pallet other­wise the vessel will be responsible only for the number of pallets and not for the number of boxes.

Moreover, if you don't either submit a guarantee letter exempting the vessel from responsibility or allow us to make note thereof in the shipping order (mate's receipt) we shall be obliged to insert such remark in the bill of lading.

Please be informed that during loading the dockers have broken the wooden pallets, made bad stowage of bags inside pallets and torn bags. Many bags inside pallets were dirty.

I had to stop loading operations due to bad stowage of cargo and because your dockers have refused to take the pallets with torn bags out of holds and also to put wood under each pallet.

Therefore, I hold you responsible for the ship's demurrage.

Dear Sirs,

This is to inform you that up to now we have free space in holds 2, 3 and 4 and further loading in those holds is possible if strong wooden platforms, accomodating 400 tons of cargo, are put on the cargo loaded.

The said platforms should be made for the shippers' account by their workers, cover all the holds area and remain under the cargo loaded. This is the only way to take a fullload on board.

Please take notice that if damaged cargo is found under wooden platforms during discharging you will be responsible for the damages caused because the ship has accepted the cargo in good condition.

Please confirm your agreement to make those platforms.
