STATEMENT OF SEA PROTEST

I, Kosmas Marentis, Master of the M/V «Meridian Ice», registered, in the port of Piraeus, gross tonnage 5,300, net tonnage 4,800, sailed from the port of Piraeus on December 20, 2000 and arrived in London on January 21, 2000

On my way to London I received 1,500 tons of frozen fish from the Soviet M/V «Sevryba» on January 20, 2000 in psn 51°30'N, 15°25'W.

During transshipment operations the weather has become worse and my ship started pitching and rolling heavily coming close and drifting, away from the M/V «Sevryba». I asked her captain through VHP channel 13 to stop loading in order to avoid damages but he decided to continue transshipment.

At 08.00. UTC on January 11, 2000 the transshipment was interrupted. I secured the derricks for sea and was getting ready to sail when one of the wire ropes holding the M/V «Sevryba; pneumatic fender which was han­ging between our ships broke and the two vessels struck against each ot­her.

Owing to the above-mentioned collision the following damages were caused to my vessel «Meridian Ice».

1. A big hole in the way of tank No. 3.

2. Deflection of the gunwale, 400 cmX35 cm, and a dent of 22 cm in» plating below the gunwale between frames 108 and 114.

3. Deflection of the bulwark stanchions over the main deck, therefore, I give notice of my intenion of protesting against all losses and damages, reserving the right to extend my Protest at time and place convenient.

STATEMENT OF SEA PROTEST

I, Petrov Ivan Ivanovich, Master of the M/T “Neftekamsk” registered in the port of Murmansk and sailing under the Russian Flag, gross tonnage 5,800 on March 2, 2000 sailed from the port of Rosario, Argentina, with the cargo of sunflower-seed oil, 5,000 tons, bound for Rotterdam, Holland, arrived in Rotterdam on March, 2000 at 10.00. UTC, berthed and received free pratique at 13.00. UTC.

On March 3, 2000 my ship was proceeding up the Parana River, with a Government pilot aboard and at 02.10. UTC owing to incompetent pilotage got stranded on the edge of a bank.

The crew took every measure to tow the ship off, and at 04.30. LT the ship refloated and proceeded on her voyage.

In consequence of the above mentioned occurrence I fear possible hull d 'formation and rapture of joints of water-heating system resulting in contamination and damage to the cargo.

STATEMENT OF SEA PROTEST

I, Sergey Ivanovich Volkov, Master of the seiner “Zvezda Azova” sailing under Ukrainian flag, registered in Kerch, Ukraine; gross tonnage 300, sai­led from Klaipeda on March 20, 2000 and arrived in Halifax on April 13, 2000.

On the 1st of April, 2000 we were drifting in psn 52°20'N, 20°18'W

with a purse-seine shot on our starboard side, the length of the net from the ship's side reaching 200 m. Fishing lights prescribed by the International Regulations for Preventing Collisions at Sea were exhibited and the ray of our search-light was directed towards the purse-seine.

At 21.45 UTC the trawler «Santa Maria» under the Portuguese flag, side number UP 205, passed my starboard side at a distance of 5 cables from my ship.

To avoid her crossing our nets we were giving sound and light signals hut the M/V «Santa Maria» paid no attention to them and did not alter her course having cut my net by her warps.

Under the circumstances, I give notice of my intention of protesting against all losses caused in consequences of the above occurrence.

STATEMENT OF SEA PROTEST

I, Trifonov Aleksei Ivanovich, Master of the M/V «Dikson», registered in Murmansk, Russian Federation, Register No. 1986, gross tonnage 3.092, sailed from the port of Murmansk on the 22nd of January, 2000 and arrived in St. John's on the 9th of April, 2000 with the cargo of fish, 300 tons.

On March 8, 2000 at 13.00 UTC I was fishing in psn 54°10'N, 55°27'W under the licence issued by the Goverment of Canada, and hauled up 2 lobster traps in my bottom trawl. The traps were released from our net and returned to the sea together with their catch.

The said gear conflict was due to the absence of a signal buoy or any other beacon showing the location of traps.

I hereby declare this sea protest in the event of any claims against' me or my shipowners for the above gear conflict.

STATEMENT OF SEA PROTEST

I, Sedov Ivan Nikolaevich, Master of the M/V «Tortsev», registered in the port of Kerch, Ukraine, gross tonnage 4,482, sailed from Las Palmas on February 20, 2000 and arrived in the port of Luanda on March 12, 2000

On the 1st of March, 2000 I was engaged in fishing activities in psn 19°20’S, and 14°05'E, 2.5 miles distant from the fishing zone, laying the course parallel to its boundary. At 12.00. UTC when towing the midwater trawl the main engine stopped, and we had to start repairing it, having hoisted the not-under-command signals prescribed by the International Regulations for Preventing Collisions at Sea.

As it was impossible to haul in the trawl, it was left in the water. The ship was drifting to leeward to ENE, the wind speed being 14 metres per second and the rate of drift 0.5 knots, and at 16.45. UTC she entered the Fishery Conservation Zone of Namibia.

At 18.00. hrs UTC a S.A. patrol helicopter, side number MS 287, was manoeuvring over the ship for 10 minutes. At 20.30. hrs UTC the main en­gine was repaired and started, and the trawl was hauled in. The trawl was damaged and empty.

At 21.00 UTC we got underway, headed for 270° and at 21.40. UTC left the Fishery Conservation Zone of Namibia.

I hereby declare this Sea Protest in the event of any claims by the S.A. authorities against me or my shipowners for infringement of Foreign Fi­shing Regulations in Namibia fishery waters.

I reserve the right to extend this protest at time and place convenient.
