Your Order No. 281511/ TW 37/ CLF
Thank you for your letter of the 21st December. We are sorry to hear that two filing cabinets of the wrong type were sent.
Our pacldng agents made a mistake in catalogue reference numbers, as you suggested. All the other cases contain four cabinets each, and since this case contained the last two of the order there was a delay while extra padding was inserted1. It was during this delay that the mistake occurred. We have arranged for the despatch of the correct cabinets on board the M/V Bludyel, which will leave from the East India Docks, port of London, on the 29th December. We assume that2 vou will not invoke the penalty clause3 in your contract, since the bulk of the order was despatched promptly. Relevant documents are being despatched, and should reach you within a few days. We should be obliged if your agents would keep Case No. 13 in their warehouse until our forwarding agents can collect it.
We shall do everything we can to ensure that similar mistakes do not happen again. Please accept our sincere regrets at any inconvenience caused to you by our mistake.
We trust that the TW 37 cabinets are to your satisfaction.

We refer to your letter of 20th January, 19... Regarding Experts Examination Acts Nos. 15912, 21313, 21314 and 107630.
Your Experts Examination Acts in each of the above numbers indicate that each case was received undamaged and with no sign of being opened. Similarly1, our contention2 is that the components were counted3 by our Stores personnel and Packing personnel and your representative in Jolm Brown Engineering. In view of the above we therefore consider that the agreement cannot be reached between our two companies on the responsibility for the shortages found on examination in Russia. However, because of business relationship our two companies have enjoyed we are prepared in this instance to supply the items which you claim as shortages. This concession4 on behalf of John Brown Engineering must not be construed5 as an admission of liability6 and we will not accept penalties7 for late deliveries or further claims of shortages. We will therefore supply the components detailed on the attached list on an f.o.b. U.K. port basis. These components will not be available for some time but we require your shipping instructions as soon as possible. Please forward these to us.
