Shipments of Wheat

Dear Sirs

We are writing to inform you that you were to have shipped us 10,000 tons of Wheat by s. s. Neva leaving Archangel for London on August 10th. However, you failed to dispatch the goods1 by the said vessel and the goods arrived with a delay of 3 weeks. We, therefore, were not in a position to fulfil our obligations2 to our clients Messrs. Cortwight & Co. in time and they have made a claim on us for damages3.

We hold you responsible for4 the losses5 we shall sustain in connection with this delay in delivery and we request you to remit6 to our account with Midland Bank the amount of $ ... representing agreed and liquidated damages stipulated7 in p. 24 of our Contract.

Dear Sirs

We write to draw your attention to the fact1 that no shipments have been made so far under Contracts Nos. 125 and 129.

We have informed you several times that if shipments were not made in the time provided for by the contract any losses sustained2 would be for your account3. In fact the point of delays was brought up prior to4 signing these Contracts and during the execution of the previous contracts.

We remind5 you that under our General Conditions to the above Contract all disputes must be settled by arbitration. We have no desire to threaten6 you but under the circumstances7 we have no option8.

The time of delivery under the Contracts expired on 15th June 19.. and 10th July 19.. respectively9, therefore we would be pleased to know if you are agreeable to accept the claim10 or whether you have an alternative suggestion to put forward2 to settle the matter.

Letter No. 5. Complaint about delay

10th December, 19..

Dear Sirs

We are concerned that we have not yet received an advice of dispatch from yon

about our order (JMB/08/07/77) for 1,500 Mickey Mouses.

Our order stressed the importance of an early delivery date. That date is very

near (15th December). In your acknowledgement (of the 18th November) you said

you were confident you could meet this delivery date1, There is no possibility of

this now, unless your advice of despatch was lost in the post.

Our stocks are running out and the Christmas trade will soon be at its peak. It

will be most unfortunate if you cannot arrange delivery before Christmas.

Please inform us by cable whether the goods have been dispatched and when we

can expect delivery.
