1. Introduction
Every federal system reflects the particular political, historical and cultural background which gave rise to it. In the case of Canada, the federal system reflects a background rooted in British colonialism and parliamentary democracy, but also the experience of longstanding ties to the United States and familiarity with its federal ex-

perience. Canadian federalism began in 1867 with the adoption by the British Parliament of the British 9orth America Act, a British statute which essentially created a federal union of four British colonies in North America. (In later years this number rose so that there are now ten provinces and three federal territories.) The Canadian constitution did not become fully «Canadian» until 1982, when the British North America Act was «patriated» from Britain to Canada as the Constitution Act; prior to that point, amendments to the constitution were required to be passed by the British Parliament.

2. Division of Powers in the Canadian Constitution
The general approach of the Canadian Constitution is to divide power between the federal and provincial levels of government on the

basis of specified areas of jurisdiction, with each level acting as a sovereign government in its own sphere (although there are some anomalies, such as agriculture, where there is shared jurisdiction). In general, then, the Canadian Constitution does not envisage a hierarchical situation that is more pronounced in other federal constitutions, with one level of government being dominant and the other subordinate. Nor does there exist in the Constitution the broader array of governmental entities which would be referred to in Russia as «subjects of the Federation». While other levels of government do exist in Canada, these would be created by either the federal or provincial governments as a matter of statute and would not enjoy constitutional status. (I leave here to one side the special and difficult case of aboriginal organizations, which may enjoy certain constitutional protection, especially as the result of constitutional amendments in recent years; this is a situation that is still evolving in Canada.)

The most important powers touching on natural resources management are set out in this volume which deals with the division of powers regarding oil and gas management. Secondly, the role of government in some other fields, such as the protection of the environment, has expanded so significantly at both the federal and provincial level that the old categories of power are simply inadequate in answering the question as to which level of government should exercise responsibility. Typically both the federal and provincial governments could point to powers in the Constitution that would allow them to act; clearly though this leaves open the possibility of duplication of effort and consequent conflicts and inefficiencies.
Apart from the question of how one should interpret the roles of federal and provincial governments in new or expanded areas of jurisdiction, there is a third, and very practical, problem that arises

from the changing nature of government over the past century; this relates to the fiscal burden that accompanies increased government responsibilities. More specifically, some of the areas of governmental activity that have expanded most dramatically in Canada have been in areas within provincial jurisdiction ─ most notably, health and education. The problem here is not that there is ambiguity as to where these responsibilities fall, but rather that, in shaping the Constitution, it was not anticipated that there would be such a significant demand on provincial revenues. As a result, in both of these areas, there has been significant federal involvement in providing funds to support programmes, typically with some conditions for the maintenance of national standards. It is only recently, with increasing strains on the federal budget, that the federal government has begun to withdraw from these areas (with consequent strains being imposed on provincial budgets). The issue of interjurisdictional cooperation in this respect is discussed further on in this paper.

3. Peculiarities of Canadian Federalism
Because Canada, when it was formed, had a status somewhere between that of a colony and an independent state, its constitution has certain peculiarities, some of which survive to this day. This is the case, for example, with respect to the relative silence of the Constitution on foreign affairs, an area that remained under the control of Great Britain until the first quarter of this century. While Canada subsequently gained full power in this area from Britain, the historical development of the Constitution has left us with some oddities as a result. This is most true with respect to the powers of the federal government to conclude and implement treaty obliga-

tions. In most federations the primary powers in this area rest with the federal level, even where the implementation of the treaty would result in interference with the «normal» powers given to the regions. In Canada, however, the silence of the Constitution on foreign affairs has been interpreted to mean that while the federal government has the ability to enter into any treaties it wishes with other countries, it may be prevented from implementing these treaties in domestic law where this would interfere with the powers given to the provinces under the Constitution. This means that, in practice, provinces must be heavily involved in any treaty negotiations that affect their powers ─ for example with respect to treaties that touch on the environment or natural resources management.
Another peculiarity exists with respect to judicial appeals. The Canadian Supreme Court was created by statute (rather than being created by the Constitution) and became the final judicial appellate body in all matters only in 1948. (Before that time, Supreme Court decisions could still be appealed to Great Britain.) This has left Canada in the somewhat unusual position for a federal state of not having a constitutionally-entrenched supreme court. In practice, however, the Canadian Supreme Court does serve a role similar to that of constitutionally entrenched courts elsewhere, insofar as it now has the final authority to authoritatively interpret the Canadian Constitution.
One important area, however, where the Canadian Supreme Court does not have inherent powers typical of such courts in other federations ─ for example the United States Supreme Court ─ is with respect to interjurisdictional disputes, whether between the provinces or between a province and the federal government. To some extent this defect has been remedied by provincial and federal statutes which confer on the Federal Court of Canada (whose decisions may be appealed to the Supreme Court) the power to hear such disputes. However, at least one province has repealed its legislation in this regard, a course that is also open to any other province, with the result that there is no assured way of settling intergovernmental disputes through the court system.
