2. Packing and Marking
2.1. The equipment is to be shipped in export seaworthy packing corresponding to the nature of each particular type of the equipment.
2.2. The packing is to provide the full preservation of the good from any damage and corrosion during its transportation by sea, railway and combined transport, taking into account several transshipments in transit as well as long storage. The goods are to de packed as not to allow to change their position inside the package.
All contracts consist of clauses, which are numbered, and some times of sub-clauses, and even of sub-sub-clauses as well. In the negotiations or correspondence one can refer to the specific clause and sub-clause, e.g. "according to the clause 7.5. of the contract number ...", or "as specified by clause 5.4.3. of the present contract ...
Общие условия поставки
1. Содержание и объём поставки
1.1. При морских перевозках поставки осуществляются на условиях ФОБ ПОРТ страны Продавца, при этом:
а) продавец несет все расходы по поставке товара на условия ФОБ с установкой, включая стоимость:
- морской упаковки, маркировки, сепарационных и крепёжных материалов, крановые и доковые, портовые и таможенные сборы, стоимость перемещения груза на причале, погрузки на борт и в трюм судна, укладки в трюме, а также дополнительные расходы по погрузке, если они будут иметь место;
б) право собственности на товар, а также риск .случайной его утраты или повреждения переходит с Продавца на Покупателя после погрузки товара на борт судна и укладки его в трюмах;
в) датой поставки считается дата "чистого" бортового коносамента.
1.2. При железнодорожных перевозках поставки осуществляются на условиях Франко-вагон граница страны Продавца, при этом:
а) Продавец несет все расходы по транспортировке товара до государствен ной границы своей страны, расходы по дальнейшей транспортировке, по погрузке и/или перестановке колесных пар несёт Покупатель;
б) право собственности на товар, а также риск его случайной утраты или повреждения переходят с Продавца на Покупателя с момента передачи товара железной дороге страны Продавца железной дороге страны Покупателя или страны транзита;
в) датой поставки считается дата штемпеля на железнодорожной накладной пограничной станции. принявшей товар от железных м страны Продавца, подтверждает; переход границы.
1.3.При автомобильных перевозках поставки осуществляются на условиях франко-место погрузки товара на транспортные средства Покупателя, при этом:
а)Продавец несет расходы по транспортировке товара до места, в котором производится погрузка товара на транспортные средства Покупателя;
б) право собственности на товар, а также риск его случайной утраты или повреждения переходят с Продавца на Покупателя с момента принятия товара на .транспортные средства Покупателя;
в) датой поставки считается дата документа, подтверждающего принятие товара транспортными средствами Покупателя.
1.4. При воздушных перевозках поставки осуществляются на условиях франко-борт самолета Аэрофлота в аэропорту отправителя при этом:
а) Продавец несет все расходы до момента погрузки товара на борт самолета в своей стране;
б) право собственности на товар, а также риск его случайной утраты или повреждения переходят с Продавца на Покупателя с момента его погрузки на борт самолета в стране Продавца;
в) датой поставки считается дата грузовой накладной воздушного сообщения.
1.5. При почтовых отправлениях поставки осуществляются на условиях Франко-получатель страны Покупателя, при этом;
а) Продавец несет все расходы до пункта назначения;
б) право собственности на товар, а также риск его случайной утраты или повреждения переходят с Продавца на Покупателя с момента сдачи посылки почтовому ведомству страны Продавца; при этом с момента сдачи посылки почтовому ведомству страны Продавца право требования по договору перевозки, заключенному с почтовым ведомством, переходит с Продавца на Покупателя;
в) датой поставки считается дата штемпеля на почтовой квитанции.
1.6. Для обеспечения норм нормальной работы поставляемого оборудования с производительностью и другими показателями, предусмотренными в настоящем контракте, Продавец обязуется:
а) передать Покупателю имеющийся у него опыт и знания эксплуатации и ремонту поставляемого оборудования;
б) по просьбе Покупателя обеспечить на аналогичном действующем оборудовании персонала Покупателя по согласованной, сторонами программе;
в) по просьбе Покупателя поставить запасные части, позволяющие нормально работать на оборудовании после истечения гарантийного периода, по спецификациям и ценам, которые будут согласованы с Покупателем, при этом цены не должны быть выше действующих прейскурантных цен фирм.
