Law of Divorce. Protection of Children
In divorce, issues of property division, child support, child custody, and alimony are decided by the judge in a trial. When marriage is broken child custody is of great concern
Child custody must be based on the best interests of the child. The real sub-criteria of this decision are:
Where the children are now.
Who has had the child for the longest recent period.
Stability.
New romantic relationships
Employment
Consistent plan for the child.
Assuring the child’s safety.
The child’s preference, depending on the age.
In general, the welfare of children is the biggest concern of the family law. In economically developed countries, there are limits on the type and amount of work a child is allowed to do. There are age limits on the rights and duties of citizens. Parents have a duty to make decisions, for example those concerning education, on behalf of their children. When parents are dead or absent, a legal guardian is appointed to make these decisions. Sometimes this is an adoptive parent – a person who legally adopts the child as his or her own and has all the rights and duties of a natural parents.
Task 1. Answer the questions:
What are the matters of Family Law?
Give the grounds for divorce.
Name the criteria for deciding a custody case. Which of them do you consider the most important?
