Law and Family
The law sees the family a special institution. The process of divorce; custody and responsibility for children; and protection from violence in the home are matters Family Law deals with.
Beyond the function of providing a new generation of children, the family is often promoted for its moral contribution to society. In accordance with the Constitution of the Republic of Belarus, men and women enjoy equal rights.
Weddings are performed in the Civil Status Records Bureau. Legislation is based on the principle of monogamy. Generally, romantic love is the bases of marriage. To be legally valid, a marriage must be:
Voluntary
Between two single people
Who are over eighteen
Both man and woman must be acting voluntarily. Neither party can be already married. So they must both be single, widowed or divorced. In the most European countries the minimum age for marriage is 18. A person under the age of eighteen needs to obtain parental, or other consent to the marriage. The marriage will be invalid if the child is under sixteen. Getting married leads to the creation of new rights and new obligations between the couple.
Marriage is a contract. What can marriage contracts cover?
Ownership of income or assets acquired before the marriage.
Treatments of gifted items or inheritances.
Ownership of items of personal use.
So, if the couple decided to separate and drew up a separation agreement, the courts would enforce it if one of the parties did not carry out his or her part of the bargain.
