Republican state enterprise “Republican veterinary laboratory” by the Ministry of agriculture of the Republic of Kazakhstan (hereinafter - the Company) was founded in accordance with decree of the Government of the Republic of
Kazakhstan from December 29, 2002 № 1431 “Issues of individual organizations under the Ministry of agriculture of the Republic of Kazakhstan”.
The function of the subject of law of the Republican state property to the Company has a Committee of state property and privatization of Ministry of Finance of the Republic of Kazakhstan (further - authorized body).
Body of state Enterprise management is the Ministry of agriculture of the Republic of Kazakhstan (further - body of state administration).
In its activity the Company is guided by the Constitution

of the Republic of Kazakhstan, Civil code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan from July 10, 2002 “About veterinary science”, the decree of the President of the Republic of Kazakhstan having the force of law, dated June 19, 1995 No. 2335 “On public companies”, other normative legal acts, as well as the Charter.
The company is a legal entity in the legal form of the Republican state enterprise, has the independent balance, accounts in banks, seal with the State emblem, letterheads with its name, seals, stamps and other formal attributes.
The company is established and acquires legal personality from the moment of its state registration.
The location of the Company is the Republic of Kazakhstan, 473000, Astana, district Saryarka, Potanin str. 37.
The purpose and object of the Company to determine the detection of highly dangerous animal diseases included in the list approved by the Government of the Republic of Kazakhstan; registration trials, testing of veterinary drugs, feed and feed additives and the control series (batch) of veterinary drugs in their complaint.
For the implementation of the tasks the Company performs the following functions: conducting laboratory and diagnostic studies: serology (RA, RBP, RBP, RDSC), bacteriological (palmariales), virology and parasitology; research animal feed, forage at suitability for feeding to animals; veterinary and sanitary expertise of meat and meat products and other products of slaughter animals, milk and dairy products, fish and fish products, bee products and honey, poultry products and other foods of animal and vegetable origin in the markets and other places, and conducting clinical inspection and examination of animals; conducting of certification tests of food, agricultural products and veterinary drugs are subject to all forms of accreditation; determination of compliance series (parties) veterinary drugs veterinary requirements of the standards; the provision of services to individuals and legal

entities for the diagnosis of animal diseases not included in the List of communicable diseases, prevention and control measures against them by public service at the expense of the state budget, approved by the decree of the Government of the Republic of Kazakhstan dated October 2, 1996 No. 1205 “On approval of normative legal and other acts on veterinary medicine”; organization of a network of veterinary pharmacies; purchase, storage and transportation of medicines for veterinary purposes, biological preparations, zoo-hygienic means and attributes veterinary purposes; acquisition, storage, distribution, use and disposal of precursors and poisons; the veterinary medical and anti-epizootic measures.
Activity subject to state licensing, implementing Entity under an appropriate license. The company is not entitled to work and to make transactions that do not meet the purpose and objectives enshrined in the Charter.
The body of the state management Company has the following powers: defines the priority activities of the Company; reviews and approves the ongoing and planned economic activity, including planned financial performance, determines the frequency and order of their submission; responsible for the monitoring and analysis of performance targets finan- cial-economic activity of the Enterprise with the submission of the report to the authorized body at a set time; appoints and dismisses the General Director of the Company and holds his certification in the manner determined byThe government of the Republic of Kazakhstan; appoints and dismisses the Deputy General Director of the Company for submission to the General Director of the Company; supervises the use and safety of property of the Company; approves the estimates of the Enterprise with the release of the state order; sets the wage Fund of the Company; resolve other issues ascribed to its competence by the legislation of the Republic of Kazakhstan.
Body of the Enterprise as a legal person is its the General Director, is accountable to the government authority.
The body of the state administration formalizes the rela-

tionship with the CEO through the conclusion of the individual labour contract in accordance with the legislation of the Republic of Kazakhstan on labor.
The General Director shall be personally liable to the owner and the body of state administration for the state of Affairs at the Enterprise. The General Director acts on the principles of undivided authority and to decide all questions of activity of the Enterprise. General Director of the Enterprise within its competence: without power of attorney acts on behalf of the Company; represents the interests of Enterprises in all organizations; manages the assets of the Company; enter into contracts and performs other transactions; issues powers of attorney, opens a Bank account; in accordance with the labour legislation shall recruit and dismiss employees of the Company, apply incentives and impose penalties on them; issue orders and give instructions obligatory for all employees of the Company; submit to the authority of public administration the candidates for appointment and dismissal of his deputies; specifies duties and powers of Deputy Directors and other executives of the Company; appoints and dismisses Directors of branches and representative offices with the approval of the government authority; approves regulations on branches and representative offices of the Company.
The General Director has four deputies, including one first

erty transferred to him in the operational management of the owner; the property (including cash proceeds) received by the Company as a result of their own activities; other sources not prohibited by legislation of the Republic of Kazakhstan.
The company is not entitled to sell and make deals of gift in respect of the property, assigned to the operational management relating to fixed assets and own shares.
The owner of the property assigned to the Company, may withdraw it or reallocate it between other established legal entities in its sole discretion, unless otherwise established by legislative acts.
In the decision on seizure of property located on the right of operative management, the authority is entitled to set the terms of Enterprise content and security of seized property pending its transfer to another person with the subsequent writing off the balance.
The company has the right to alienate or otherwise to dispose of the secured property and property acquired with funds received as a result of economic activity, except with the written consent of the authorized body.
The company may not be purchased on the basis of contracts of purchase and sale, exchange, gift or other transaction, the assets in the fixed assets without the written consent of the authority.
The Enterprise is financed by own revenue estimates with the allocation of the state order, approved by the government authority.

State institution “National center of monitoring, reference, laboratory diagnostics and methodology in veterinary medicine” of the Ministry of agriculture (here in after - the state
Agency) is a nonprofit organization with the status of a legal entity, created for the implementation of the reference and the methodological options for the diagnosis of animal diseases with the conduct of a National collection of the deposited strains of microorganisms used in veterinary medicine, epizootic monitoring of wild animal diseases in the Republic of Kazakhstan, in the legal form of a public institution.
State institution “Republican veterinary laboratory” of the Ministry of agriculture in accordance with the decree of the government of the Republic of Kazakhstan dated 29 December 2002 No. 1431 renamed the State institution “national center of monitoring, reference, laboratory diagnostics and methodology in veterinary medicine” of the Ministry of agriculture.
State institution is the successor of the state institution “Republican veterinary laboratory” of the Ministry of agriculture.
The founder of the establishment is the state represented by the Government of the Republic of Kazakhstan. The Gov-

ernment authority of a state institution, and by the authority exercising in relation to him the functions of an entity state property (hereinafter - the authorized body), is of the Ministry of agriculture.

Public institution (here in after – PI) acquires legal personality from the moment of its state registration. PI has an independent balance, accounts in banks according to the legislation, forms, stamp and stamps the as its name in the state and Russian languages. PI cannot create, but also to act as a founder (participant) of other legal persons, except those institutions that are delegated the right of possession, use, and disposition of state property. PI is responsible for its obligations in cash at its disposal. In case of insufficiency of money the institution responsible for its obligations borne by the Government of the Republic of Kazakhstan. Civil - legal transactions concluded PI, subject to registration in the manner determined by the Government of the Republic of Kazakhstan. On contractual obligations, the liability of PI occurs within the approved financing plan for the maintenance of the institution in accordance with the law.
The aim of the PI is the reference implementation and methodological features for the diagnosis of animal diseases with the conduct of a National collection of the deposited strains of microorganisms used in veterinary and epizootic monitoring of wild animal diseases in the Republic of Kazakhstan.
To achieve this goal PI performs the following activities: improving the means and methods of diagnostics of especially dangerous, slow and exotic animal diseases; the Improvement of means and methods of determining highly toxic and radioactive substances in the organism of animals, products and raw materials of animal origin; Development of projects of normative legal acts on organization and methodology of

veterinary laboratory business, including prevention, diagnosis and elimination of hazardous, slow and exotic animal diseases and animal diseases, poisoning caused by toxic or radioactive substances; Providing advice to legal entities and individuals operating in the field of veterinary medicine, in addressing issues related to the diagnosis of diseases, organization and implementation of interventions for the prevention and eradication of diseases of animals, birds, fish and bees; Conduct reference and arbitration of laboratory studies in doubtful or controversial cases in the implementation of veterinary - sanitary examination of products and raw materials of animal origin, animal disease diagnostic; Conducting applied research in veterinary laboratory diagnostics and veterinary - sanitary expetise; Improvement of existing methods of laboratory research particularly dangerous, slow and exotic animal diseases, and also diseases of animals caused by toxins and radioactive substances; The ongoing epidemic monitoring and laboratory monitoring for the welfare of the external environment and various objects of veterinary surveillance for exotic, slow and especially dangerous diseases of animals, birds, bees, and fish and wild fauna; Study of the epizootic and veterinary - sanitary conditions in the border area of the Republic of Kazakhstan on especially dangerous diseases of animals and birds, drafting epizootic cards; Conduct in accordance with approved by the authorized body of work plans, PI, seminars, trainings, meetings veterinary experts on matters within the competence of the PI; The area of the epizootic and immunological monitoring is the territory of the Republic of Kazakhstan.
PI may not engage in activity that is inconsistent with the goal of creating a public institution.
Overall management of the PI performed by the authorized body as defined in accordance with the law. The authorized body in accordance with legislation performs the following functions: Assigns to state property; Approves plans funding

for maintenance PI; monitors the efficiency and safety of the property transferred to the PI; Approves the Statute of the PI, makeschangesandadditionstotheCharter;Definesthestructure, the order of formation and term of office of the management bodies of the PI, the procedure for the adoption of the
PI solutions; Defines the rights and duties of the Director PI; Approves the structure, staffing level and the wage Fund of the PI; On the proposal of the head of PI shall appoint and dismiss his Deputy (deputies);Adopt the financial statements.
Performs other functions established by law.
The head of PI shall be appointed and dismissed by the authorized body by the Chief state veterinary inspector of the Republic of Kazakhstan.
The employment relationship of the authorized body and the head of PI shall be documented in the contract.
Director and PI organizes and directs the work of PI, directly reports to the authorized body (except for the cases established by law) and shall be personally responsible for fulfilling PI and the exercise of its functions.
Director PI operates on the principles of undivided authority and independently decides on the activities of the PI in accordance with its competence. Property of PI is formed at the expense of the property transferred to it by the state, and consists of fixed and current assets and other property, the cost is recognised in the balance sheet of the PI. Estate PI belongs to him by right of operative management and refers to the Republican property. If PI is granted the right to carry out income-generating activities, the income derived from such activities shall be transferred to the state budget.

PI is carried out by the authorized body in accordance with legislation.
The labor collective of the PI are citizens of the Republic of Kazakhstan, involved with their work in its activities on the basis of prisoners with the Director of individual or collective employment contracts. For the workers of state shall be subject to all rights and obligations under labor law. The mode of operation of the PI is established in accordance with legislation of RK.
