Due process and individual rights
The due process clause is found in the 5th amendment, which states that no person shall be deprived of life, liberty, or property, without due process of law.
In essence, due process requires that agencies recognize individual rights while enforcing the law. Any violation of due process may result in dismissal of the case.
Crime Control Through Due Process
There are several goals of the Criminal Justice process, two of which are to maintain social order and, secondly, to protect individuals from injustices. Maintenance of social order can be linked to what has been termed the crime control model of justice. Basically, this model values efficiency at all stages, such as arrest, trial, and conviction. The second goal is linked to the due process model of criminal justice, which emphasizes effectiveness, understanding the facts of each case and strong adherence to due process.
There is a tendency to abide by one model or the other, usually due to our political ideology. However, we tend to think of the system as crime control through due process, thus balancing the rights of the collective with the rights of the individual.

Употребление
1. Инфинитив в форме Indefinite выражает действие, одновременное с действием глагола в личной форме.
I want to tell you the truth. Я хочу сказать вам правду.
I want to be told the truth. Я хочу, чтобы мне сказали правду.
2. Инфинитив в форме Continuous выражает действие в процессе его развертывания, происходящего одновременно с действием глагола в личной форме.
It is extremely important to be working on the problem of crime prevention on a permanent basis.
Чрезвычайно важно работать над проблемой предупреждения преступности на постоянной основе.
3. Инфинитив в форме Perfect выражает:
(a) действие, предшествовавшее действию глагола в личной форме.
They seem to have lost all hope to find the escaped prisoner.

(б) возможное или вероятное действие в прошлом (с глаголами must, may /might).
He must have been attacked by someone.

1. Инфинитив в функции определения после слов the first, the second, the last, etc., переводится глаголом в личной форме в том времени, в котором стоит глагол-сказуемое английского предложения.
He was the first to leave the scene of the crime.
Он первым ушел с места преступления.
2. При определении существительного инфинитив часто приобретает модальное значение и переводится определительным придаточным предложением с модальным глаголом-сказуемым.
It depends on the topic to be discussed.
Это зависит от темы, которую предстоит обсудить.
3. При переводе инфинитива в функции обстоятельства цели или следствия перед инфинитивом употребляется союз чтобы; для того, чтобы.
He came here to ask you some questions.
Он пришел сюда, чтобы задать тебе несколько вопросов.
The witness was too far away from the criminal to see him well.
Свидетель был слишком далеко от преступника, чтобы хорошо его рассмотреть.
ИНФИНИТИВНЫЙ ОБОРОТ С ПРЕДЛОГОМ FOR |
Инфинитивный оборот с предлогом FOR состоит из сочетания предлога FOR и существительного в общем падеже или местоимения в объектном падеже с инфинитивом. При переводе данного оборота используется придаточное предложение с союзом чтобы; для того чтобы; когда.
The police officer waited for her to calm down, but she kept on crying.
Полицейский ждал, чтобы она успокоилась, но она продолжала плакать.
