В свете сказанного выше базовые требования к существующим режимам иностранных санкций должны включать в себя гарантии на доступ к правосудию. Играя в этом случае ключевую роль, государства обязаны принимать меры для обеспечения надлежащей правовой процедуры, судебного контроля и возмещения ущерба отдельным субъектам, пострадавшим от санкций. Российский законодатель, реализуя принятые на себя обязательства, обоснованно принял антисанкционные правила ведения судопроизводства в арбитражных судах Российской Федерации, которые в целом призваны обеспечить интересы российских участников международного коммерческого оборота.

INTRODUCTION
Restrictive measures, also often referred to in the legal literature as sanctions, have recently become one of the leading instruments of foreign policy in the modern world1. The imposition of restrictive measures (bans and personal sanctions) by foreign states against Russian citizens and organizations limits their rights, causing at least damage to their reputation, and therefore deliberately puts them in an unequal position with other persons. The regime of unilateral foreign sanctions (restrictive measures) puts on the agenda the important issue of access to justice, its fair implementation. Legal representation has always been central to the quest for access to justice. In a number of cases, this issue is raised in connection with the provision of legal counselling to the sub-sanction person, representation of his/her interests in court. Such persons can only be given a truly fair court hearing if they have access to a lawyer, qualified legal assistance. The duties of lawyers as servants of the law outweigh other considerations such as payment of fees in accordance with the standard terms of the client agreement and reputational damage.

when it comes to litigation. The regime of licensing the payment of representation fees by the sanctioned person in the English courts, amid sanctions, indirectly restricts the free access to legal help, and the path to justice becomes excessively long and very thorny. The right of the sub-sanctioned person to a fair trial is de facto restricted. Denial of justice is not limited to cases where the doors of the court have been literally closed. The justice system may fall short of international standards in many other respects. But the obligation to provide decent justice to foreigners follows from the same customary international law.
The monograph analyses the jurisprudence of the courts of the UK and its overseas territories (British Virgin Islands) involving Russian parties under the sanctions regime. This research finds out what restrictions our compatriots face in defending their rights as a result of the sanctions and how these restrictions can be overcome. These proceedings involving sanctioned persons highlight the often overlooked tension between political objectives and access to justice.
The English sanctions regime overlooks certain values that underpin the democracies of the same Western Europe and, despite the current world situation, are of paramount importance. Among those values — and perhaps at the top of many lawyers’ list of fundamentally important values — are those that we group together under the name «rule of law». The odious nature of the actions of some States, from the point of view of other sovereigns, cannot serve as a ground or excuse for the mentioned sovereigns to disregard their international obligations, in particular in the field of the protection of fundamental human rights. Legislative restrictions on sub-sanctioned persons imposed by the UK government are, according to the authors, incompatible with fundamental human rights. These rights define the boundaries

of permissible and legitimate actions of the State, in particular the imposition of unilateral sanctions.
To be effective, the right to a legal counsel in sanctions disputes must be secure in the sense of being adequately paid for, sustainable in terms of protection from political interference, and unencumbered in the sense of being free from restrictions and prohibitions. An effective right to legal counsel services must be realised in such a way that sub-sanctioned individuals are able to access this right at key turning points. In the absence of an effective right to legal assistance, to the free and non-discriminatory choice of counsel, their right to a fair trial cannot be considered guaranteed. In turn, this situation may indicate a denial of access to justice in a single State and a breach of its international obligations.
Access to justice is crucial to the rule of law. Without access to a court, sub-sanctioned individuals cannot express their views, realize their rights, challenge discrimination or hold decision-makers accountable. Denial of justice is not limited to cases where the doors of the court have been literally closed. The justice system may fail to meet international standards in many other ways. States have an obligation to take all necessary measures to provide fair, transparent, efficient, non-discriminatory services that promote access to justice for all, including the excluded.
It is natural and legitimate for litigants to expect that their case will be heard in an atmosphere of impartial calm. In such circumstances, the problem lies not so much in a specific defect in the judicial process, but in the failure to provide conditions in which justice can be achieved on the principles of neutrality, impartiality and fairness. The provisions of the Code of Arbitration Procedure of the Russian Federation on disputes involving sub-sanctioned persons are

very important, since denial of justice in this case is used as a jurisdictional ground. In this regard, it is important to observe the necessary balance of procedural rights of the parties in judicial evidence to ensure adversarial, proportionality and legality. It is unlikely that the existence of a risk of denial of justice abroad should be assessed on the basis of mere speculation or suspicion in the absence of evidence of a high degree of probability of such a refusal.
In light of the above, basic requirements for existing foreign sanctions regimes should include guarantees of access to justice. Playing a key role in this case, states are obliged to take measures to ensure due process, judicial review and compensation for damage to individual entities affected by sanctions. The Russian legislator, realizing the obligations assumed, has justifiably adopted anti-sanctions rules for proceedings in arbitration courts of the Russian Federation, which are generally designed to safeguard the interests of Russian participants in international commercial turnover.

Право на доступ к суду по гражданским делам рассматривается как часть максимы справедливого судебного разбирательства во многих странах мира. Есть некие общечеловеческие ценности, которые, по утверждению уче- ного-юриста Т. Е. Абовой, не могут не учитываться в обществе, относящем себя к демократическому. Среди них она справедливо выделяла право на судебную защиту1.
Доступ к суду можно считать фундаментальным принципом в глобальном мире, он является выражением теории общественного договора, которая служит философской основой многих современных конституций государств. Теория общественного договора основана на принципиальной монополии государства на применение физической силы. Исходя из данной теории, разумные личности соглашаются на основе договора отказаться от нерегулируемой свободы в обмен на безопасность гражданского общества, управляемого справедливым, обязательным для исполнения законом. Основная идея теории заключается в том, что граждане не откажутся от своего естественного права решать споры с помощью силы, если суверен не предложит мирную альтернативу, в рамках которой у граждан есть справедливый шанс одержать верх, победу, если они правы, независимо от того, богаты они, бедны или что-то среднее2.
Право предъявлять иски и защищаться в судах — это альтернатива силе. В организованном обществе это право

является самым важным из всех других прав и лежит в основе упорядоченного управления1.
Как писал Т. Гоббс в «Левиафане», которому «мы обязаны миром и безопасностью», при заключении взаимного договора каждого с каждым все множество людей обращается в одно лицо и называется государством или республикой. Оно приобретает такое могущество и такие силы, что посредством внушаемого им страха может соглашать всех к миру и к союзу против врагов2. Отсюда, согласно политико-правовому учению Т. Гоббса, верховная власть имеет право судить, то есть разбирать и решать все споры как о правах гражданских и естественных, так и о фактах. Иначе правительство, по мнению данного юри- ста-философа, не могло бы оказывать защиту против взаимных правонарушений; законы собственности не имели бы никакого значения; каждый по естественному чувству самосохранения был бы принужден и имел бы право отстаивать свое собственными силами, и таким образом не достигалась бы цель государства, потому что продолжалась бы война всех против всех3.
В деле Marbury v. Madison председатель Верховного суда США Дж. Маршалл писал: «Суть гражданской свободы, несомненно, состоит в праве каждого человека требовать защиты закона всякий раз, когда ему нанесен вред. Одна из первых обязанностей правительства — предоставить такую защиту». Это следует рассматривать вместе со знаменитым принципом «Нет права без средства правовой защиты», который был растолкован в том же решении: «Где есть законное право, там существует и законное
