4.The Parties agree that ships of all States not bordering the Bering Strait enjoy the right of innocent passage between the Islands of Big Diomede and little Diomede in accordance with international law.

5.The relevant rules of international law governing innocent passage of ships in the territorial sea are stated in the 1982 United Nations Convention on the Law of the Sea, particularly in Part II, Section 3.

6.The competent authorities of the Russian Federation and the United States of America will publish within a year from the date of signing of this Agreement in Russian and English languages special requirements to the exercise of the right of innocent passage in this part of the Bering Strait in order to prevent pollution of the marine environment taking into account ice conditions and the real intensity of ships passage.

7.The Parties agree that ships of all States use speeds of [__ knots] or less in the following areas of the Bering Strait:

8.Sea lanes, traffic separation schemes and the areas of the Bering Strait where ships of all States use speeds of [__knots] or less as defined in paragraphs 2, 3 and 7 of this Agreement are subject to mandatory publication by the competent public authorities of the Russian Federation and the United States of America within one month from the date of signing of this Agreement in English and Russian languages.

9.This Agreement shall enter into force on the date of its signature by both Parties. This Agreement may be amended by mutual written agreement between the Parties. This Agreement may be terminated within one year after notification by either Party of intention to terminate the Agreement.
