THE BRITISH CONSTITUTION
There is still no written constitution in Great Britain. The cornerstone of
British liberties is the Magna Carta, or Great Charter, which King John signed in
1215 under the threat of civil war.
Stephen Langton, archbishop of Canterbury, directed baronial unrest into a
demand for grant of liberties by the king. The purpose of the Magna Carta was to
protect aristocracy and not the ordinary citizens. However, it limited the power of
the monarch and protected citizens against unjust punishment, the loss of life,
liberty and property except according to law. It stipulated that nobody could punish

a citizen or keep him in prison without a fair trial. Under the Magna Carta the king
could not levy certain taxes without popular consent.
In Britain they often say that the modern UK constitutional principles date
from the “Glorious Revolution” of 1688. The Bill of Rights (1689) was the result
of the long struggle between the Stuart kings, the Parliament and the English
people. This paper of great importance prohibited the monarch from exercising key
powers without the consent of the Parliament, such as the power to levy taxes, to
provide maintenance of a standing army in peacetime without specific
parliamentary authorization, and the power to override legislation. The Bill of
Rights also eliminated royal interference in parliamentary matters and stipulated
that elections should be free and that members of the Parliament should have
freedom of speech.
The Magna Carta and the Bill of Rights guaranteed the two basic principles
of the English system of government: limited monarchy and representative
government.
