The judicial branch interprets laws and makes sure that new laws are in
keeping with the Constitution. There are several levels of federal courts. The
Supreme Court is the most important. It has nine members who are appointed for
life.
The Constitution established the system of checks and balances. It must
prevent any branch from having too much power. Each branch has certain control
over the other branches. For example, the Congress makes the laws but the
President can veto or reject a law and the Supreme Court can decide that a law is
unconstitutional.

SEPARATION OF POWERS
The theory of the separation of powers is one of the main features of
government in Britain and in the USA. According to Montesquieu, a French
political scientist, one of the developers of the theory, there is no liberty if the
legislative and executive powers are united in the same person, or in the same
body, there is no liberty if the judiciary power is not separated from the legislative
and executive. The main idea of Montesquieu’s theory is that nobody should have
full control of all three functions of government.
Many British politicians criticize it as a theoretical and impractical model to
which the British system of government does not conform. Members of the
executive branch, for example, are also members of the legislative one – the head
of the judiciary, the Lord Chancellor, is a member of the Cabinet. On the other
hand, the courts perform many administrative functions.
The theory of the separation of powers is the basis of the US Constitution
(written in 1787) - the executive (President), the legislature (Senate / House of
Representatives) and the judiciary (Supreme Court) are discrete bodies. But even
the US government does not conform exactly to the theory. Each body exercises
control over the functions of the others through a complex system of checks and
balances. The President, for example, appoints the judges to the Supreme Court but
the Senate must approve his nominations. The judiciary has the constitutional right
to strike down legislation as unconstitutional.
By contrast, in France, the theory of the separation of powers is the reason
why the courts do not have the jurisdiction to question the legality of the acts of the
executive and the legislature.
Nowadays most political scientists agree that a precise separation of the
functions of government is impossible.
