Проект статьи 4.1 «Сертификация многочисленной группы лиц»
для внесения дополнений в гл. 37 «Рассмотрение дел
о защите прав и законных интересов группы лиц» проекта Кодекса
гражданского судопроизводства Российской Федерации
Статья 4.1. Сертификация многочисленной группы лиц
1. Групповое производство возбуждается после проведения судеб­ного заседания по проверке соблюдения требований, предусмотренных пунктами 1 и 3 статьи 1 настоящего Кодекса.
2. Судебное заседание по проверке условий возбуждения группового производства проводится в срок не более чем через тридцать дней с даты вынесения определения о принятии искового заявления или заявления к производству арбитражного суда или суда общей юрисдикции.
3. Судебное заседание проводится с участием лица, обратившегося в суд в защиту прав и законных интересов группы лиц (истца-пред­ставителя), и ответчика. Информация о времени и месте судебного заседания указывается в определении о принятии искового заявления или заявления к производству. Неявка указанных лиц не препятству­ет рассмотрению вопроса о соблюдении требований к групповому производству.
4. Указанные в пункте 3 настоящей статьи лица вправе представлять доказательства, заявлять ходатайства, излагать свои доводы по воп­росам соблюдения условий возбуждения группового производства, предусмотренных пунктами 1 и 3 статьи 1 настоящего Кодекса.
5. По результатам судебного заседания суд выносит одно из следу­ющих определений:
о возбуждении группового производства; об отказе в возбуждении группового производства и оставлении
искового заявления или заявления без рассмотрения.
Определение о возбуждении группового производства выносится в случае, если суд установит, что одновременно соблюдены все усло­вия, предусмотренные пунктами 1 и 3 статьи 1 настоящего Кодекса.
Определение об отказе в возбуждении группового производства выносится в случае, если не соблюдено хотя бы одно из требований, предусмотренных пунктами 1 и 3 статьи 1 настоящего Кодекса.
Указанные определения могут быть обжалованы.
