During the voyage the vessel met with stormy weather and heavy seas, the ship suffered rolling and pitching heavily shipping water fore and aft and spraying overall.

All precautions were taken to save the cargo and the ship but, nevertheless, fearing damage to the cargo during the bad weather, I state the present sea protest.

BE IT KNOWN AND MADE MANIFEST TO ALL WHOM IT DOES OR SHALL OR MAY CONCERN THAT on the 20th day of March in the year of one thousand nine hundred and ninety nine BEFORE ME ... PERSONALLY APPEARED:

Master of the m/v ..., of a burthen of 3,726 gross tons and 1,819 net tons, registered in the port of ..., Official No. 764, International Call Letters USLE, who did duly and solemnly declare and state as follows, that is to say:

THAT this Appearer and the rest of the crew of the said vessel set sail in her from ... on the 9th day of March 1999 bound for ... with 1165 metric tons of general cargo, the vessel being then tight, staunch and strong, well manned, victualled and sound, and in every respect fit to perform the said intended voyage.

THAT at 20.00 hours on March 9, 1999 the vessel sailed from ... An air temperature of +10°C was recorded during that day.

THAT on March 13, 1999, at noon the vessel was at 45°00'N and 34°00'W. During the day, she encountered port winds of force 7 which caused her to pitch and roll heavily up to 30° on either side in a rough sea of force 6 and a heavy 18 foot swell and to take water over her deck and hatches.

THAT on March 14, 1999, at noon the vessel was at 46°00'N and 40°00'W. During the day, she encountered port winds of force 8 which caused her to pitch and roll heavily up to 30° on either side in a rough sea of force 6 and a heavy 10 foot swell and to take water over her deck and hatches.

THAT on March 15, 1999, at noon the vessel was at 46°00'N and 43°00'W. During the day, she encountered port winds of force 10 which caused her to pitch and roll heavily up to 35° on either side in a rough sea of

force 8 and a heavy 20 foot swell and to take water over her deck and hatches.

THAT the vessel arrived at Section 19 in the Harbour of ... at 21.00 hours on March 19, 1999.

AND NOW fearing damage to the hull and machinery of the vessel and to her cargo from any or all of the above incidents, this Appearer does protest and I, the said ... do also protest against the aforesaid bad weather, gales, storms, accidents, incidents and occurences, and against all and every matter and thing had and met with as aforesaid, and all loss or damage occasioned thereby reserving the right to extend this protest at a time and place convenient.

I, ..., Master, do solemnly and sincerely declare that the foregoing statement is correct and contains a true account of the facts and circumstances. AND I make this solemn declaration conscientiously believing it to be true and knowing that it is of the same force and effect as if made under oath and by virtue of "The Canada Evidence Act".

EXTRACT FROM A SEA PROTEST

On November 26, 1999, at noon the vessel was at 49°39.5' and 00°40.5'. During the day the vessel encountered starboard bow winds of forces 9/10 that caused her to pitch and roll heavily up to 20° on either side in rough seas of force 7 and heavy 20 foot swells and to take water overall. During the aforementioned heavy weather the vessel was obliged to reduce the engine speed.

On November 30, 1999, at noon the vessel was at 43°43.6'N and 05°01.2'W. During the day the vessel encountered starboard quarter winds of forces 7/8 that caused her to pitch and roll heavily up to 22° on either side in rough seas of force 6 and heavy 20 foot swells and to take water overall. During the aforementioned heavy weather the vessel was obliged to reduce the engine speed. An air temperature of +08°C was recorded during the day.

On December 6, 1999, at noon the vessel was at 39°04.8'N and 47°36.5'W. During the day the vessel encountered SE'ly fob lowing winds of forces 8/9 that caused her to pitch and roll very heavily up to 35° on either side in rough seas of force 7 and heavy 20 foot port swells and to take water
