Text 2. Revitalization of the work of the General Assembly: Making its work more focused, efficient and relevant1
Strengthening the work of the General Assembly can help ensure that this “chief deliberative, policymaking and representative organ of the United Nations” (para. 149 of the 2005 World Summit Outcome Document) becomes a true, universal “parliament of nations”. Identified as a priority from the very outset of the Organization in 1946 (the outcomes of which are reflected, inter alia, in the annexes to the General Assembly’s Rules of Procedure), the General Assembly, at its 60th session and continuously since its 62nd session, has annually established an Ad Hoc Working Group on the revitalization of the work of the General Assembly (AHWG), in the context of which Member States consider the following broad thematic issues:
Role and authority of the General Assembly;
Working methods;
Selection and appointment of the Secretary-General and other executive heads;
Strengthening the institutional memory of the Office of the President of the General Assembly.
Starting at its 62nd session, the AHWG elaborated an Inventory Chart reflecting the status of implementation of General Assembly revitalization resolutions (A/62/952/Add.1). This chart has subsequently been updated at the 63rd, 67th and 68th sessions (see documents A/63/959, A/67/936 and A/68/951 respectively) and continues to form a basis for the membership’s deliberations under this item.
Also based on the outcomes of the Assembly’s consideration of ways to revitalize its work, the Assembly encouraged the holding of informal interactive debates on current issues of critical importance to the international community and invited the President of the General Assembly to propose themes for these interactive debates.
During the 69th session, the President has announced a series of high-level events and thematic interactive debates on various aspects of the post-2015 development agenda in line with his theme “Delivering on and Implementing a Transformative Post-2015 Development Agenda”:
High-level thematic debate on the means of implementation for the post-2015 development agenda (February 2015);
High-level thematic debate on advancing gender equality and the empowerment of women in the post-2015 development agenda (March 2015);
High-Level thematic debate on the peaceful settlement of disputes and strengthening cooperation between the United Nations and regional organizations (April or May 2015);
High-level event on combatting climate change (June 2015).
It has also become an established practice for the Secretary-General to brief Member States pe-
riodically, in informal meetings of the General Assembly, on his recent activities and travels. These briefings have provided a well-received opportunity for exchange between the Secretary-General and Member States.
As a result of the ongoing revitalization of its work, and pursuant to rule 30 of its rules of procedure, the General Assembly now elects its President, Vice Presidents and Chairs of the Main Committees at least three months in advance of the start of the new session in order to further strengthen coordination and preparation of work among the Main Committees and between the Committees and the Plenary. It has also come to adopt the proposed programme of work and timetable of five of its six Main Committees for the forthcoming session at the end of the main part of the session, thereby facilitating the planning and preparation of work for delegations, incoming chairs as well as the Secretariat.
Text 3. UN expert urges General Assembly to refer DPR Korea rights report to International Criminal Court2
A United Nations human rights expert called on the General Assembly to refer a UN-mandated report documenting wide-ranging and ongoing crimes against humanity in the Democratic People’s Republic of Korea (DPRK) to the International Criminal Court (ICC).

Presenting his latest report to the General Assembly committee dealing with human rights issues (Third Committee), Marzuki Darusman, Special Rapporteur on the situation of human rights in the DPRK, further urged the General Assembly to submit a separate report from the Commission of Inquiry set up to probe the human rights situation in the country, to the Security Council.
Further, he said that the UN system as a whole should follow up the Commission of Inquiry’s report in a “coordinated and unified way,” as envisaged in the Human Rights up Front initiative, which seeks to prevent genocide and human rights violations.
“This would send an unequivocal signal that the international community is determined to take the follow up to the work of the Commission of Inquiry on the DPRK to a new level,” Mr. Darusman said, who also serves as a member of that panel.
The 400-page report was released in February by the UN Commission of Inquiry on human rights in the DPRK, which was established by the Human Rights Council in March 2013. Documenting in great detail the rights violations committed in the country, the report called for urgent action to address the human rights situation, including referral to the ICC.
Noting that he held his first-ever meeting with DPRK officials on the margins of the General Assembly today, Mr. Darusman said that all relevant parts of the UN system “should work to alleviate specific areas of sufferings, as relevant to their mandates, in relation to the aforementioned violations documented by the commission of inquiry and the recommendations accepted during the universal periodic review.”
Welcoming what he called the “active engagement” of DPRK authorities in the second review of the human rights situation in the country carried out by other States — known as the “universal periodic review,” he acknowledged that the Government had accepted 113 recommendations out of the 268 made.
The accepted recommendations mainly relate to the fulfilment of economic, social and cultural rights, as well as the protection of women’s and children’s rights.
“I welcome these signs of increased engagement by the DPRK with the Human Rights Council and international community, and I hope they will bear fruit,” Mr. Darusman said.
He stressed, however, that he was deeply concerned that the DPRK has failed to accept any recommendations relating to the findings of the Commission of Inquiry.
Any efforts by the DPRK to engage with the international community should be premised on a more fundamental acknowledgement of the problems, and must not “divert from efforts to ensure the accountability of those responsible,” he added.
During his presentation, Mr. Darusman also asked the General Assembly to request that the DPRK grant access to the UN human rights mechanisms to assist, assess and verify the implementation of the recommendations.
Additionally, he said he was encouraged by recent moves to reopen the investigation of international abductions and enforced disappearances committed by the DPRK.
“The… authorities should allow all persons who have been abducted or otherwise forcibly disappeared, as well as their descendants, to return immediately to their countries of origin, and speed up the investigation into the fate of those missing in a transparent and verifiable manner,” Mr. Darusman stressed.
Text 4. The European Union to Cut 40% of its Greenhouse Gas by 20301
On 24 October the European Council endorsed a binding target for the European Union (EU) of at least a 40% domestic reduction in greenhouse gases by 2030 compared to 1990.
In addition, it set a binding target of at least 27% for the share of renewable energy consumed in the EU in 2030.
An indicative target of at least 27% was set for improving energy efficiency in 2030, compared to projections of future energy consumption based on current criteria. This will be reviewed by 2020, having in mind an EU level of 30%, the Council said.
The Secretary-General commended the European Union’s new ambitious target to reduce greenhouse emissions, indicating that “the European Union leaders have once again placed Europe in a

leading position with an ambitious emissions reduction target”, decision which “will also set a new standard for climate ambition for all countries in support of the upcoming global negotiations”.
Christiana Figueres, Executive Secretary of the UN Framework Convention on Climate Change (UNFCCC), also welcomed the announcement: “I applaud this move, which provides valuable momentum towards the Paris 2015 global climate agreement. The decision means that the EU will be able to submit its contribution to the Paris agreement by March next year. And it opens the door to greater ambition by all countries. The fact that the 28 countries of the EU, in different stages of economic development, can reach a good compromise bodes well for the ability of all nations to come to an effective agreement next year.”
The final round of formal negotiations before this year’s UN climate convention conference in Lima, Peru has begun in the German city of Bonn. The session, running from 20 to 25 October, gives governments the important opportunity to further develop a cohesive text of a new draft climate agreement.
Text 5. How EU decisions are made1
The EU’s standard decision-making procedure is known as “Ordinary Legislative Procedure” (ex “codecision”). This means that the directly elected European Parliament has to approve EU legislation together with the Council (the governments of the 28 EU countries).
Drafting EU law
Before the Commission proposes new initiatives it assesses the potential economic, social and environmental consequences that they may have. It does this by preparing “Impact assessments” which set out the advantages and disadvantages of possible policy options.
The Commission also consults interested parties such as non-governmental organisations, local authorities and representatives of industry and civil society. Groups of experts give advice on technical issues. In this way, the Commission ensures that legislative proposals correspond to the needs of those most concerned and avoids unnecessary red tape.
Citizens, businesses and organisations can participate in the consultation procedure via the website Public consultations.
National parliaments can formally express their reservations if they feel that it would be better to deal with an issue at national rather than EU level.
Review and adoption
The European Parliament and the Council review proposals by the Commission and propose amendments. If the Council and the Parliament cannot agree upon amendments, a second reading takes place.
In the second reading, the Parliament and Council can again propose amendments. Parliament has the power to block the proposed legislation if it cannot agree with the Council.
If the two institutions agree on amendments, the proposed legislation can be adopted. If they cannot agree, a conciliation committee tries to find a solution. Both the Council and the Parliament can block the legislative proposal at this final reading.

Всоответствии с правилом 59 временных правил процедуры и ввиду отсутствия иного предложения Председатель Совета (Ливан) направил заявление в Комитет по приему новых членов для рассмотрения и представления по нему доклада.
2.Комитет рассмотрел это заявление на своих 109-м и 110-м заседаниях, состоявшихся 30 сентября и 3 ноября 2011 года соответственно.
3.После проведения 109-го заседания Комитета Председатель Совета Безопасности в октябре месяце (Нигерия) созвал пять неофициальных заседаний Комитета, четыре из которых проводились на уровне экспертов, для внимательного рассмотрения вопроса о том, удовлетворяет ли Палестина конкретным критериям приема в члены, изложенным в статье 4 Устава Организации Объединенных Наций. Эксперты решали, удовлетворяет ли Палестина критериям государственности, является ли она миролюбивым государством и может ли она выполнять обязательства, предусмотренные в Уставе.
4.В ходе заседаний Комитета выражались различные мнения. Было выражено мнение, что заявитель удовлетворяет всем критериям, изложенным в Уставе. Поднимались вопросы относительно того, отвечает ли заявитель всем необходимым для членства требованиям Устава. Было выражено также мнение, что при обсуждении этого вопроса следует принимать во внимание более широкий политический контекст.

В связи с этим отмечалось также, что перспектива проведения переговоров не должна служить поводом для затягивания Советом Безопасности рассмотрения заявления Палестины. Отмечалось, что заявление Палестины не наносит ущерб политическому процессу и не является альтернативой переговорам. Отмечалось также, что палестинское заявление не приблизит стороны к миру. Кроме того, отмечалось, что вопрос о признании палестинской государственности не может и не должен обусловливаться исходом переговоров между палестинцами и израильтянами и что в противном случае палестинская государственность станет зависеть от одобрения Израиля — а это будет означать наделение оккупирующей державы правом вето в отношении права палестинского народа на самоопределение, которое с 1974 года признается Генеральной Ассамблеей в качестве неотъемлемого права. Text 8. Международный Суд ООН. Основные сведения1
Международный Суд (МС) является главным судебным органом Организации Объединенных Наций (ООН). Он был учрежден Уставом Организации Объединенных Наций, подписанным 26 июня 1945 года в Сан-Франциско, для достижения одной из главных целей ООН: «проводить мирными средствами, в согласии с принципами справедливости и международного права, улаживание или разрешение международных споров или ситуаций, которые могут привести к нарушению мира».
Суд функционирует в соответствии со Статутом, который является частью Устава, и своим Регламентом. Он начал работать в 1946 году, заменив собой Постоянную палату международного правосудия (ППМП), которая была учреждена в 1920 году под эгидой Лиги Наций.

По общему признанию, современная история арбитража ведет свое начало от Договора Джея, заключенного Соединенными Штатами Америки и Великобританией в 1794 году. В этом Договоре о дружбе, торговле и судоходстве предусматривалось создание смешанных комиссий, состоящих из равного числа американских граждан и британских подданных, для урегулирования нескольких нерешенных вопросов. Арбитражное разбирательство по делу о судне «Алабама» в 1872 году знаменует собой другой решающий этап. Text 10. Предупреждение геноцида1
В2004 году — в связи с разгулом насилия, приобретшего характер геноцида, в Руанде и на Балканах — Генеральный секретарь Организации Объединенных Наций Кофи Аннан назначил Хуана Мендеса Специальным советником в целях устранения наиболее серьезных упущений в международной системе, наличие которых способствовало беспрепятственному развитию этих трагических событий. Вписьме на имя Председателя Совета Безопасности от 2004 года (S/2004/567) Генеральный секретарь перечислил следующие функции Специального советника по предупреждению геноцида:
•собирать поступающую, в частности в рамках системы Организации Объединенных Наций, информацию о массовых и серьезных нарушениях прав человека и международного гуманитарного права, имеющих этническую и расовую природу, которые, если они не будут предотвращены или пресечены, могут привести к геноциду;

•поддерживать связи с системой Организации Объединенных Наций в отношении мер по предупреждению геноцида и работать над укреплением потенциала Организации Объединенных Наций в области анализа и управления информацией, касающейся геноцида или связанных с ним преступлений.
Text 11. UNCITRAL: origin and mandate2
In an increasingly economically interdependent world, the importance of an improved legal framework for the facilitation of international trade and investment is widely acknowledged. The United Nations Commission on International Trade Law (UNCITRAL), established by the United Nations General Assembly by resolution 2205 (XXI) of 17 December 1966 (see annex I), plays an important role in developing that framework in pursuance of its mandate to further the progressive harmonization and modernization of the law of international trade by preparing and promoting the use and adoption of legislative and non-legislative instruments in a number of key areas of commercial law. Those areas include dispute resolution, international contract practices, transport, insolvency, electronic commerce, international payments, secured transactions, procurement and sale of goods. These instruments are negotiated through an international process involving a variety of participants, including member States of UNCITRAL, non-member States, and invited intergovernmental and nongovernmental organizations. As a result of this inclusive process, these texts are widely accepted as offering solutions appropriate to different legal traditions and to countries at different stages of economic development. In the years since its establishment, UNCITRAL has been recognized as the core legal body of the United Nations system in the field of international trade law.
UNCITRAL gives effect to its mandate by:
“(a) Coordinating the work of organizations active in this field and encouraging cooperation among them;

“(b) Promoting wider participation in existing international conventions and wider acceptance of existing model and uniform laws;
“(c) Preparing or promoting the adoption of new international conventions, model laws and uniform laws and promoting the codification and wider acceptance of international trade terms, provisions, customs and practices, in collaboration, where appropriate, with the organizations operating in this field;
“(d) Promoting ways and means of ensuring a uniform interpretation and application of international conventions and uniform laws in the field of the law of international trade;
“(e) Collecting and disseminating information on national legislation and modern legal developments, including case law, in the field of the law of international trade;
“(f) Establishing and maintaining a close collaboration with the United Nations Conference on Trade and Development;
“(g) Maintaining liaison with other United Nations organs and specialized agencies concerned with international trade; and

Text 12. Convention on the Limitation Period in the International Sale of Goods (New York, 1974)1. Excerpt
Purpose
The Limitation Convention establishes uniform rules governing the period of time within which a party under a contract for the international sale of goods must commence legal proceedings against another party to assert a claim arising from the contract or relating to its breach, termination or validity. By doing so, it brings clarity and predictability on an aspect of great importance for the adjudication of the claim.
Why is it relevant?
Most legal systems limit or prescribe a claim from being asserted after the lapse of a specified period of time to prevent the institution of legal proceedings at such a late date that the evidence relating to the claim is likely to be unreliable or lost and to protect against the uncertainty that would result if a party were to remain exposed to unasserted claims for an extensive period of time. However, numerous disparities exist among legal systems with respect to the conceptual basis for doing so, resulting in significant variations in the length of the limitation period and in the rules governing the claims after that period. Those differences may create difficulties in the enforcement of claims arising from international sales transactions. In response to those difficulties, the Limitation Convention was prepared and adopted in 1974. The Limitation Convention was further amended by a Protocol adopted in 1980 in order to harmonize its text with that of the United Convention on Contracts for the International Sale of Goods (CISG), in particular, with regard to scope of application and admissible declarations. Indeed, the Limitation Convention may be functionally seen as a part of the CISG and, as such, considered as an important step towards a comprehensive standardization of international sales law.
Key provisions
The Limitation Convention applies to contracts for the sale of goods between parties whose places of business are in different States if both of those States are Contracting States or when the rules of private international law lead to the application to the contract of sale of goods of the law of a Contracting State. It may also apply by virtue of the parties’ choice.
The limitation period is set at four years (art. 8). Subject to certain conditions, that period may be extended to a maximum of ten years (art. 23). Furthermore, the Limitation Convention also regulates certain questions pertaining to the effect of commencing proceedings in a Contracting State.

The Limitation Convention further provides rules on the cessation and extension of the limitation period. The period ceases when the claimant commences judicial or arbitral proceedings or when it asserts claims in an existing process. If the proceedings end without a binding decision on the merits, it is deemed that the limitation period continued to run during the proceedings. However, if the period has expired during the proceedings or has less than one year to run, the claimant is granted an additional year to commence new proceedings (art. 17).
No claim shall be recognized or enforced in legal proceedings commenced after the expiration of the limitation period (art. 25(1)). Such expiration is not to be taken into consideration unless invoked by parties to the proceedings (art. 24); however, States may lodge a declaration allowing for courts to take into account the expiration of the limitation period on their own initiative (art. 36). Otherwise, the only exception to the rule barring recognition and enforcement occurs when the party raises its claim as a defense to or set-off against a claim asserted by the other party (art. 25(2)).
Relation to private international law and existing domestic law
The Limitation Convention applies only to international transactions and avoids the recourse to rules of private international law for those contracts falling under its scope of application. International contracts falling outside the scope of application of the Limitation Convention, as well as contracts subject to a valid choice of other law, would not be affected by the Limitation Convention. Purely domestic sales contracts are not affected by the Limitation Convention and are regulated by domestic law.
Text 13. United Nations Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea1. Excerpt
Article 1
Definitions
For the purposes of this Convention:
1.“Contract of carriage” means a contract in which a carrier, against the payment of freight, undertakes to carry goods from one place to another. The contract shall provide for carriage by sea and may provide for carriage by other modes of transport in addition to the sea carriage.
2.“Volume contract” means a contract of carriage that provides for the carriage of a specified quantity of goods in a series of shipments during an agreed period of time. The specification of the quantity may include a minimum, a maximum or a certain range.
3.“Liner transportation” means a transportation service that is offered to the public through publication or similar means and includes transportation by ships operating on a regular schedule between specified ports in accordance with publicly available timetables of sailing dates.
4.“Non-liner transportation” means any transportation that is not liner transportation.
5.“Carrier” means a person that enters into a contract of carriage with a shipper.
6.(a) “Performing party” means a person other than the carrier that performs or undertakes to perform any of the carrier’s obligations under a contract of carriage with respect to the receipt, loading, handling, stowage, carriage, keeping, care, unloading or delivery of the goods, to the extent that such person acts, either directly or indirectly, at the carrier’s request or under the carrier’s supervision or control.
(b) “Performing party” does not include any person that is retained, directly or indirectly, by a shipper, by a documentary shipper, by the controlling party or by the consignee instead of by the carrier.
7.“Maritime performing party” means a performing party to the extent that it performs or undertakes to perform any of the carrier’s obligations during the period between the arrival of the goods at the port of loading of a ship and their departure from the port of discharge of a ship. An inland carrier is a maritime performing party only if it performs or undertakes to perform its services exclusively within a port area.

8.“Shipper” means a person that enters into a contract of carriage with a carrier.
9.“Documentary shipper” means a person, other than the shipper, that accepts to be named as “shipper” in the transport document or electronic transport record.
10.“Holder” means:
(a) A person that is in possession of a negotiable transport document; and (i) if the document is an order document, is identified in it as the shipper or the consignee, or is the person to which the document is duly endorsed; or (ii) if the document is a blank endorsed order document or bearer document, is the bearer thereof; or
(b) The person to which a negotiable electronic transport record has been issued or transferred in accordance with the procedures referred to in article 9, paragraph 1.
11.“Consignee” means a person entitled to delivery of the goods under a contract of carriage or a transport document or electronic transport record.
12.“Right of control” of the goods means the right under the contract of carriage to give the carrier instructions in respect of the goods in accordance with chapter 10.
13.“Controlling party” means the person that pursuant to article 51 is entitled to exercise the right of control.

The parties to a contract on the international sale of a crane were in dispute over the conclusion of the contract. The Court of First Instance deemed the contract to have been concluded, on the grounds that the Spanish seller had offered a deal on the goods and a price that had been accepted by the German buyer. The appellant (the seller) considered that the contract had been subject to the condition that payment for the goods would take place before any other buyer was accepted and that, if that condition had not been fulfilled, there was no contract. However, the Provincial High Court upheld the judgement of the Court of First Instance, in view of the provisions of articles 14 to 16 of CISG, since it was clear from the electronic mails exchanged by the parties that the seller had given the buyer first refusal to carry out the transaction, so long as it was carried out before a specified date. This the buyer had done, when it paid the agreed amount by bank transfer. That transaction had, however, been refused by the seller’s bank. The seller had thus made a firm and binding offer that it had failed to honour for unjustified reasons, since it had not sought to extend the deadline granted for paying the cost of the transaction but had gone on to sell the goods to a third party. There had thus been an offer and an acceptance, which meant that the sale contract had been concluded and its failure was due to the seller.
The Court considered whether article 74 of CISG applied, since the breach of contract by the seller had caused damage to the buyer in the form of loss of profit. In endorsement of the lower court’s judgement, damages were set at the difference between the amount of the resale and the price of the crane acquired by the buyer, in addition to the buyer’s costs. Lastly, the Court considered that there had been no breach of the provisions of articles 74, 75 and 77 of CISG, since the seller had not established that the damages claimed exceeded the loss that the party in breach had foreseen or ought to have foreseen, it had not established that the possibility of a replacement purchase was possible and it had not established that the buyer had not taken reasonable measures, given the circumstances, to reduce the damage. The exercise of discretion provided for in article 1.103 of the Civil Code was not appropriate in the present case.
