Таможенно-тарифное регулирование
Таможенно-тарифное регулирование внешнеторговой деятельности - совокупность методов государственного регулирования внешнеторговой деятельности, основанных на применении таможенных пошлин, таможенных процедур, правил. Таможенно-тарифное регулирование является основным методом регулирования государством сферы внешней торговли, применяемым с давних пор. Целями применения мер таможенно-тарифного регулирования могут быть:
Протекционистская функция - защита национальных товаропроизводителей от иностранной конкуренции.
Фискальная функция - обеспечение поступления средств в бюджет
С точки зрения государственного регулирования внешнеэкономической деятельности таможенно-тарифное регулирование является одной из двух групп методов регулирования государством этой сферы деятельности наряду с нетарифными методами.

В современных условиях глобализации мировой экономики построение всех элементов таможенно-тарифных методов унифицируется на основе международных договоров. Важнейшими из них являются:
Соглашения, действующие между членами Всемирной торговой организации в соответствии с её Уставом и пакетом соглашений, прежде всего Генеральным соглашением о тарифах и торговле (ГАТТ)
Конвенция о Гармонизированной системе описания и кодирования товаров
Таможенная конвенция о международной перевозке грузов с применением книжки МДП.
Другие многосторонние и двухсторонние международные договоры (например, соглашения о предоставлении принципа наибольшего благоприятствования в торговле).
Таможенное декларирование
Таможенная декларация — оформленный в соответствии с требованиями национального законодательства документ, содержащий необходимую информацию о перемещении через границу груза, включая экспортные и импортные товары, пассажирский багаж, ручную кладь, ценности, валюту.
Таможенному декларированию подлежат товары: - перемещаемые через таможенную границу; - при изменении таможенного режима (например, таможенного режима временного ввоза на режим таможенного склада); - являющиеся отходами, образовавшимися в результате применения таможенных режимов переработки на таможенной территории и переработки для внутреннего потребления; - являющиеся остатками ввезенных товаров для переработки и не использованных в производственном процессе при применении таможенных режимов переработки на таможенной территории и переработки для внутреннего потребления; - являющиеся отходами, образовавшимися в результате уничтожения иностранных товаров, при применении таможенного режима уничтожения; - незаконно ввезенные на таможенную территорию РФ и приобретенные лицом, осуществляющим предпринимательскую деятельность и не имеющим отношения к незаконному перемещению.
Декларирование производится путём заявления в установленной форме, где сообщается точные сведения о товаре и транспортных средствах, об их таможенном режиме. Транспортные средства декларируются одновременно с товарами. При перемещении товаров физическими лицами для личных, семейных, домашних и иных не связанных с осуществлением предпринимательской деятельности нужд письменная форма декларирования производится на бланке таможенной декларации ТД-6 и заполняется при перемещении товаров через таможенную границу физическим лицом, достигшим шестнадцатилетнего возраста. Кроме письменной формы декларирования может использоваться устная форма декларирования, которая применяется в ряде случаев при декларировании товаров, перемещаемых через таможенную границу физическими лицами. Помимо устной формы декларирования физическими лицами также используется конклюдентная форма (от лат. con cludere- заключать, т.е. действие, свидетельствующее о намерениях лица). Она применяется при использовании «зеленого» коридора, выбор которого предполагает, что физическое лицо заявило об отсутствии у него товаров, подлежащих письменному декларированию.
При декларировании товаров декларант обязан:
произвести декларирование товаров в соответствии с порядком, предусмотренным таможенным кодексом;
по требованию таможенного органа предъявить декларированные товары и транспортные средства;
уплатить таможенные платежи;
оказать таможенным органам содействие в производстве таможенного оформления.
