Значна кількість основних розділів права штату Огайо керуються майже повністю або у найбільш важливих відношеннях, загальним правом. Однією з важливих галузей, яка майже повністю керується загальним правом, є делікти. Делікти - це розділ права, який стосується відшкодувань за пошкодження або збитки, заподіяні внаслідок необачності або інших правопорушень. Наприклад, більшість законів щодо відповідальності за травми, одержані у автомобільних аваріях, відносяться до загального деліктного права. Ще однією галуззю, у якій широко застосовуються принципи загального права, є майнове право. Договірне право право частково регулюється загальним правом, а частково – статутами. Деякі частини права повністю регулюються статутами, наприклад, визначення поняття “злочинна поведінка”, або розміру відшкодування, які передбачаються компенсацією робітника.
Принципи та поняття загального права використовуються для вирішення питань, чи має відношення той чи інший статут, постанова або положення до конкретної ситуації, і якщо має, то як вони повинні застосовуватись.Далі, якщо статут, постанова або положення тлумачаться певним шляхом, таке тлумачення стає частиною загального права, і тим самим переплітається з писаним правом.
Важливість загального права
Загальне право є важливим не лише тому, що воно є істотною частиною права взагалі, але й тому, що воно забезпечує постійний процес, що об'єднує та стабілізує право, надаючи йому гнучкість, яка дозволяє розв’язувати принципово нові проблеми.

The main principles of the relations between the state and a person are stated in Articles 3 and 4 of the new Constitution. The individual, his/her life and health, honor and dignity, inviolability and security are recognized in Ukraine as the highest social value. It is the rights and obligations of the individual and their implementation that are the basis of our state and and its policy.
Article 6 of the Constitution states: "The state power in Ukraine is exercised on the principle of its division into legislative, executive and judicial power". In practice this principle is aimed to prevent the concentration of power in the hands of one person or body to avoid the totalitarian governing of the state. An efficient system of checks and balances between different branches of power is an important condition for the implementation of this principle. To avoid the disbalance among the branches, their powers should be strictly defined, and efficient provisions to prevent any branch of power from overbalancing the others should be created.
The theory of the division of power was first suggested by the representatives of the Enlightenment back in the XVII-XVIII century. The bolsheviks, who came to power in 1917, neglected it providing their Boards both with legislative and executive powers. During the period of Perestroyka, initiated by M.S.Gorbachev, the Soviet society turned back to the principle of the division of power. According to this principle, the representatives of executive power, including the ministers, cannot be elected to the Parliament. Judges cannot become MPs either. The executive body must be subordinate to the legislative body, and the court and public prosecutors must be independent of both. This is the basic scheme of the law-governed state organization.
