1. The Council of Industrialists and Entrepreneurs Under the President of Ukraine (hereinafter referred to as the Council) shall be a permanently acting consultative organ. The Council shall be formed by the president of Ukraine in accordance with suggestions made by public associations of industrialists and entrepreneurs.
2. The principal tasks and functions of the Council shall be as follows:
1) analyzing the status and condition of entrepreneur-ship in Ukraine and preparing appropriate suggestions and proposals based upon the results of such analyses;
2) working out—at the behest of the president of Ukraine or on its own initiative—draft laws, draft ukases, and other normative acts, recommendations, and methods directed at implementing economic reforms and developing Ukraine's market structure;
3) preparing conclusions concerning draft laws and other normative acts connected with the introduction of market-relations;
4) facilitating the development of entrepreneurship, establishing and supporting relations with state organs;
submitting to the president of Ukraine necessary information on matters of developing industry and entrepreneurship;
5) introducing for examination and consideration by the president of Ukraine suggestions and proposals regarding the improvement of the structure, forms, and methods of administering production, entrepreneurship, banking, etc.
3. In its own activity the Council shall be guided by the Constitution, the legislative acts of Ukraine, the ukases and regulations of the president of Ukraine, as well as by the present Statute.
4. The Council shall be headed up by a chairman to be appointed by the president of Ukraine.
The personnel composition of the Council shall be approved by the president of Ukraine. The Council's personnel may include as many as 29 persons.
The apportionment or distribution of duties among the Council members shall be determined and specified by the Council.
5. The chairman of the Council shall have the following duties and functions:
1) guide the Council and organize its work;
2) take part in sittings of the Ukrainian Cabinet of Ministers, stale Duma, and other organs of the state executive branch, introduce suggestions, proposals, and recommendations prepared by the Council in order to solve problems with regard to developing the economy;
3) organize the rendering of expert and consultative assistance to the president of Ukraine and the Ukrainian Cabinet of Ministers in solving problems of the economic reform and stimulating the development of market relations in Ukraine;
4) ensure the Council's interaction and cooperation with the Ukrainian Union of Industrialists and Entrepreneurs, unions of associations of enterprises, leaseholders, and cooperative members, and—in case of necessity— work out with their participation suggestions and proposals regarding matters of developing entrepreneurship and protecting the rights of entrepreneurs.
6. The principal forms of the Council's activity shall be its sittings, which shall take place at least once every three months.
The Council's sittings shall be competent and official if they are participated in by at least two-thirds of its members.
Decisions shall be adopted by a majority vote of the Council members.
7. Council decisions shall be formalized as recommendations, conclusions, suggestions, or proposals.
8. Operation of the Council shall be maintained by the Council's senior secretary.
Material and technical support of the Council's activity shall be carried out by the Administrative Office under the president of Ukraine.
