4. MUTUAL LEGAL ASSISTANCE
1. States Parties shall afford one another the widest measure of mu­tual legal assistance in investigations, prosecutions and judicial pro­ceedings in relation to the offences covered by this Convention as provided for in article 2 bis and shall reciprocally extend to one anoth­er similar assistance where the requesting State Party has reasonable grounds to suspect that the offence referred to in article 2 bis, para­graph 1 (a) or (b), is transnational in nature, including that victims, witnesses, proceeds, instrumentalities or evidence of such offences are located in the requested State Party and that the offence involves an organized criminal group.
2. Mutual legal assistance shall be afforded to the fullest extent possible under relevant laws, treaties, agreements and arrangements of the requested State Party with respect to investigations, prosecutions and judicial proceedings in relation to the offences for which a legal person may be held liable in accordance with article 5 of this Conven­tion in the requesting State Party.
3. Mutual legal assistance to be afforded in accordance with this ar­ticle may be requested for any of the following purposes:
a) taking evidence or statements from persons; b) effecting service of judicial documents; c) executing searches and seizures, and freezing; d) examining objects and sites; e) providing information, evidentiary items and expert evaluations;
f) providing originals or certified copies of relevant documents and records, including government, bank, financial, corporate or business records;
g) identifying or tracing proceeds of crime, property, instrumentali­ties or other things for evidentiary purposes;

h) facilitating the voluntary appearance of persons in the requesting State Party;
i) any other type of assistance that is not contrary to the domestic law of the requested State Party.
4. Without prejudice to domestic law, the competent authorities of a State Party may, without prior request, transmit information relating to criminal matters to a competent authority in another State Party where they believe that such information could assist the authority in undertaking or successfully concluding inquiries and criminal pro­ceedings or could result in a request formulated by the latter State Par­ty pursuant to this Convention.

THE JUDICIAL BRANCH IN THE USA
The federal judiciary is a totally separate, self-governing branch of the government. The federal courts often are called the guardians of the Constitution because their rulings protect the rights and liberties guaranteed by the Constitution. Through fair and impartial judgments, they determine facts and interpret the law to resolve legal disputes.
The courts do not make the laws. That is the responsibility of the Congress. Nor do the courts have the power to enforce the laws. That is the role of the President and the many executive branch departments and agencies. But the judicial branch has the authority to interpret and decide the constitutionality of federal laws and to resolve other dis­putes over federal laws.

The framers of the Constitution considered an independent federal judiciary essential to ensure fairness and equal justice to all citizens of the United States. The Constitution they drafted promotes judicial in­dependence in two principal ways. First, federal judges appointed tin­der Article III of the Constitution can serve for life, and they can be removed from office only through impeachment and conviction by Congress of «Treason, Bribery, or other high Crimes and Misdemean­ors». «Second, the Constitution provides that the compensation of Ar­ticle III federal judges “shall not be diminished during their Continu­ance in Office”», which means that neither the President nor Congress can reduce the salaries of most federal judges. These two protections help an independent judiciary to decide cases free from popular pas­sion and political influence.

fect Participle Active) употребляется только в функции обстоятельства, но не
определения и соответствует русскому деепричастию совершенного вида. Та­ким образом, having worked означает не проработавший, а проработав. Гла­гольной формы, соответствующей русскому причастию совершенного вида прошедшего времени в английском языке не существует. Поэтому при переводе приходится строить придаточное предложение (которые проработали — who

THE APPOINTMENT PROCESS
Once a judge has been appointed to the full-time bench he is in practice virtually irremovable. Certainly, neither incompetence nor a basic lack of judicial qualities would justify his dismissal. It is there­fore important that mistakes not be made. There have been notorious examples of outstanding advocates who made poor judges. So, how does the system of appointment work? Technically, almost all the judges are appointed by the Sovereign acting normally on the advice of the Lord Chancellor or, in the case of the most senior judges, of the Prime Minister. But it is the Lord Chancellor and his senior officials who actually decide. Obviously the Lord Chancellor is too busy to do all the leg-work himself. The task of identifying the right people falls principally on the Permanent Secretary and the Deputy Secretary also known as the Deputy Clerk to the Crown. The main task of producing names actually falls on the Deputy Secretary who goes about the country talking with judges, senior circuit administrators and leaders of the practising Bar trying to identify that elusive quality which makes someone a potentially good or at least adequate judge.
Until recently little was known about the process which led to the appointment of judges. In May 1986, however, a pamphlet issued by the Lord Chancellor's Office set out some basic information about the system of judicial appointment and the policies pursued. According to this, the basic principle is that no single person's view about the suita­bility of a particular candidate should be decisive. Every name is ex­haustively considered through an elaborate process of consultation with senior judges, Leaders of the Circuit Bars and other senior mem­bers of the profession. Candidates who are now known to the senior officials in the Department are interviewed. The final decision is for­mally taken by the Lord Chancellor (who will himself see those to be appointed as High Court judges to offer them the job), but when he considers names they have already gone through a very careful sifting process. Moreover, if they are being considered for full-time appoint­ment, they will nowadays already have a track record over several years in a part-time judicial post. The pamphlet said that 'as far as pos­sible, candidates should be appointed to permanent judicial posts only when they have successfully prepared and proved themselves by expe­rience in a part-time capacity'.
