CONDITIONS REGARDING CRIMINAL LIABILITY
Acts committed in self-defence are not punishable if they were necessary to resist or avert an unlawful attack that has begun or is im­minent, provided that such acts do not manifestly exceed what is rea­sonable with regard to the danger inherent in the attack, the aggressor and the importance of the interests endangered by the attack.
Any person who exceeds the limits of lawful self-defence shall not be liable to punishment if his act could reasonably be attributed to the fear or excitement produced by the attack.
Similar rules shall apply to acts necessary to enforce lawful orders in a lawful manner, to carry out a lawful arrest or to prevent the escape of a prisoner or a person committed to an institution.
An act which is normally punishable shall not be punished if it was necessary in order to avert threat of damage to a person or to property, and if the offence may be regarded as only of relatively minor importance.
Acts committed by children under the age of 15 are not punishable.
Persons who, at the time of the act, were irresponsible on account of mental illness or a state of affairs comparable to mental illness are

not punishable. The same shall apply to persons, who are severely mentally defective. Provided that the accused was temporarily in a condition of mental illness or a state of affairs comparable to mental illness on account of the consumption of alcohol or other intoxicants, he may in special circumstances be punished.
Persons who, at the time of the act, were slightly mentally defec­tive, are not punishable, except in special circumstances. The same shall apply to persons in a state of affairs comparable to mental defi­ciency.
With regard to the offences dealt with in this Act, acts committed negligently shall not be punished, except where expressly provided. With regard to other offences, the appropriate penal provision shall apply even where the offence was committed negligently, unless the opposite is especially provided.
Where a punishment or aggravated punishment is conditional upon the fact that an intentional offence has resulted in an unintentional consequence, then that punishment shall only take effect where such a consequence may be attributed to the negligence of the accused or where he has failed to avert it to the best of his ability, after becoming aware of the danger.

Text 1. CODE OF CROWN PROSECUTION
The Crown Prosecution Service (CPS) is a public service for Eng­land and Wales headed by the Director of Public Prosecutions. It is answerable to Parliament through the Attorney General.
The Crown Prosecution Service is a national organisation consist­ing of 42 Areas. Each Area is headed by a Chief Crown Prosecutor, and corresponds to a single police force area, with one for London. It was set up in 1986 to prosecute cases instituted by the police. The police are responsible for the investigation of crime. Although the Crown Prosecution Service works closely with the police, it is inde­pendent of them.
The Director of Public Prosecutions is responsible for issuing a Code for Crown Prosecutors under section 10 of the Prosecution of Offences Act 1985, giving guidance on the general principles to be applied when making decisions about prosecutions. This is the fourth edition of the Code and replaces all earlier versions. For the purposes
of this Code, ‘Crown Prosecutor’ includes members of staff in the
Crown Prosecution Service who are designated by the Director of Public Prosecutions under section 7A of the Act and are exercising powers under that section.
1. Introduction.
1.1 The decision to prosecute an individual is a serious step. Fair and effective prosecution is essential to the maintenance of law and order. Even in a small case a prosecution has serious implications for all involved – victims, witnesses and defendants. The Crown Prosecu­tion Service applies the Code for Crown Prosecutors so that it can make fair and consistent decisions about prosecutions.
1.2 The Code helps the Crown Prosecution Service to play its part in making sure that justice is done. It contains information that is im­portant to police officers and others who work in the criminal justice system and to the general public. Police officers should take account of the Code when they are deciding whether to charge a person with an offence.
1.3 The Code is also designed to make sure that everyone knows the principles that the Crown Prosecution Service applies when carry­ing out its work. By applying the same principles, everyone involved in the system is helping to treat victims fairly and to prosecute fairly but effectively.

1. Each case is unique and must be considered on its own facts and merits. However, there are general principles that apply to the way in which Crown Prosecutors must approach every case.
2. Crown Prosecutors must be fair, independent and objective. They must not let any personal views about ethnic or national origin, sex, religious beliefs, political views or the sexual orientation of the suspect, victim or witness influence their decisions. They must not be affected by improper or undue pressure from any source.
3. It is the duty of Crown Prosecutors to make sure that the right person is prosecuted for the right offence. In doing so, Crown Prose­cutors must always act in the interests of justice and not solely for the purpose of obtaining a conviction.

Text 1. DEFENSES
If actus and mens have been proved, a defendant may still avoid
guilt if he can show he has a defense — a reason the court should ex-

cuse his act. Different systems of law recognize different and usually limited sets of defenses. For example, English law sometimes allow the defense of duress — being forced to commit a crime because of threats that you or someone else will be harmed if you don't. Duress may be used as a defense against the charge of murder as a secondary party (helping the murderer), but is not available if the defendant is charged as the principal murderer.
Another defense is that of insanity. In most countries a person cannot be found guilty of a crime if in a doctor's opinion he cannot have been responsible for his actions because of mental illness. But this defense requires careful proof. If it is proven the defendant will not be sent to a prison, but instead to a mental hospital.
It might be argued that a person is not responsible for his actions if he is intoxicated — drunk or under the influence of drugs. In fact, an intoxicated person may not even know what he is doing and thus lacks mens rea. However, in Britain and many other countries, there is a general principle that people who knowingly get themselves intoxicat­ed must be held responsible for their acts. Consequently, intoxication is not a defense.
Nearly every system of law recognizes the defense of self-defense. In English law, a defendant can avoid guilt for injuring someone if he can convince the court that the force he used was reasonable to protect himself in the circumstances. In some countries, shooting an unarmed burglar would be recognized as self-defense, but in other it might be considered unreasonable force.
The concept of defense should not be confused with that of mitiga- tion — reasons your punishment should not be harsh. If a person has a defense, the court finds him not guilty. It is only after being found guilty that a defendant may try to mitigate his crimes by explaining the specific circumstances at the time of the crime. In France, the de­fense of crime of passion is sometimes used to lessen the sentence: that your act was directly caused by the unreasonable behavior of your lover.
Although most criminal laws in the world refer to acts of violence or theft, there are laws regulating almost every kind of human behav­ior: for example, what we do with our land; what we say and write; how we run our businesses; even what we wear. Sometimes govern­ments "create new crimes" by identifying a form of behavior and pass­ing a new law to deal with it. In most industrialized countries existing theft laws were not adequate to deal with computer crimes where

Technical change is one reason criminal law is one of the fastest growing areas of the law. Another reason is that the number of crimes committed in some countries seem to be increasing rapidly—although sometimes it is not clear whether people are breaking the law more, be­ing caught more, or reporting other people's crimes more. One more reason is that different societies—or perhaps it is different govern­ments—continually review their ideas of what should and shouldn't be a considered crime. Homosexual acts, suicide and blasphemy (attacking religion, see Chapter 16) were once crimes in all European countries, but have now mostly been decriminalized. On the other hand, discrimi­nation against someone on the grounds of race or sex was not acknowl­edged as a crime until relatively recently, and is still not recognized in some countries. Recent cases of euthanasia (shortening the life of a sick person) are causing re-evaluations of the concept of murder.
