With reference to your letter No.... dated ... we wish to give some clari­fications about the delay in discharge of the m/v ... .

We appreciate your concern but the delay was entirely due to reasons beyond our control and we cannot be held responsible for it.

The delay was caused by the defective shipboard handling gear both in No. 1 and No. 2 hatches.

Furthermore the situation was aggravated by the concentration of heavy lifts in these two hatches. Due to the nature of some packages and the low draught of the vessel we had to rent a floating crane to speed up the dis­charge from these hatches.

Besides in spite of our repeated requests the shipping documents for the cargo came late and we could not start the discharge immediately upon the vessel's berthing.

We assure you that we have done all we could to discharge the vessel in time and hope that you will find our explanation satisfactory.

We are informed by our Agents that the m/v ... arrived at Novorossisk on January 31 at your request but did not berth up till February 5. The port authorities did not give any explanation about the delay. Moreover we have not yet received any advice from our agents when we can expect the begin­ning of loading. Needless to say it puts us in a very difficult position as we shall have to pay demurrage, although we are not responsible for the delay.

In these circumstances we regret to inform you that we have to claim

compensation from you.

Carrier: Oh, yes, we have and we are glad that we've got the kind of vessels to handle your order but there's some business we'd like to discuss how­ever.

S. What's that?

C. As far as we know the port of destination is always congested, we think it reasonable to increase lay time and disbursement expenses respec­tively.

S. The problem is under discussion with our customer. We'd like him to guarantee berthing for our vessels within 48 hours from the moment of the vessel's arrival at the port.
