Влияние экономических реформ и правового развития на гражданское общество в Китае
принимают меры для обеспечения функционирования «двойной» системы, которая характеризуется сочетанием работы в коллективном хозяйстве и частном, домашнем, хозяйстве в соответствии с договором. Во главе угла стоят право собственности и иные законные права и ин­тересы коллективных хозяйственных организаций, а также домашних хозяйств, действующих в рамках договора и партнерских отношений. Закон КНР об эксплуатации земли в сельских районах на договорной основе содержит положения о системе контрактов для обработки сель­скохозяйственных земель домашними хозяйствами.
5. Совершенствование правовой системы КНР в связи со вступлением
Китая в ВТО
До вступления Китая в ВТО в 2001 г. центральные и местные органы власти осуществляли правовое регулирование, обеспечивая свободу подведомственных предприятий и значительно снижая администра­тивные барьеры. В соответствии с обязательствами Китая, связанными с его вступлением в ВТО, был принят ряд законов, касающихся право­вого регулирования защитных мер, компенсационного и антидемпин­гового регулирования, а также некоторые другие законы, которые способствовали улучшению правового регулирования международной торговли.
Создание рыночной экономики сделало независимыми экономи­ческую деятельность и управление собственностью. Государство посте­пенно ушло из частного сектора, особенно из конкурентных секторов. Частные права и частная автономия стали заметными. Непрерывно расширяющаяся автономия гражданского общества по отношению к государству в сфере имущественных отношений становится все более важным элементом общественного развития.
III. Совершенствование социалистической рыночной экономи­ческой системы с 2004 г.
1. Всеобъемлющее строительство современной системы рынка
В настоящее время в стране сложился многоуровневый и разнооб­разный рынок товаров, сформировалась рыночная система, в которой действуют различные каналы товарооборота и модели управления. Постепенно создаются и укрепляются различные элементы рынка. Рынок определяет цены на большинство товаров и услуг. Ощущается

постоянный рост единой, открытой и конкурентной современной ры­ночной среды. Антимонопольный закон КНР (2007 г.) распространяет свое действие на монопольную деятельность за пределами Китая, если она влияет на субъекты, находящиеся на территории КНР. Закон также обеспечивает правовую основу для предотвращения и пресечения мо­нопольной деятельности, защищая честную рыночную конкуренцию и повышая тем самым экономическую эффективность.
2. Совершенствование защиты собственности
Согласно Конституции КНР установлен запрет на любые посяга­тельства на частную собственность граждан; государство защищает законом право граждан на частную собственность и право наследования частной собственности; государство может в общественных интересах экспроприировать или изъять частную собственность граждан для го­сударственных нужд, но оно обязано выплатить компенсацию в соот­ветствии с законом. В Законе КНР о вещных правах (2007 г.) имеются положения, касающиеся различных видов вещных прав, включая право собственности, узуфрукт и защиту вещных прав. Этот Закон эффективно регулирует право собственности и его применение и также способству­ет развитию рыночной экономики. Регистрация прав на недвижимое имущество становится более ясной в связи с четким делением вещных и обязательственных прав. В данном Законе указывается, что всем учас­тникам рынка гарантируются равные условия в реализации и защите их прав; вещные права государства, коллективов, отдельных лиц или любого иного обладателя права защищаются законом в равной мере.
3. Коренное изменение системы распределения доходов
Основным принципом распределения доходов является распре­деление по труду, существуют также другие способы распределения. В настоящее время в распределении доходов участвуют в зависимости от их вклада различные составляющие производства, включая труд, капитал, технологии, управление и др. Существует взаимосвязь между эффективностью и справедливостью в распределении и перераспре­делении.
4. Формирование системы социального обеспечения
Государство постепенно создает и развивает основные элементы системы страхования по старости, устанавливает основы городской

и сельской системы медицинского страхования; система страхования предусматривает, в частности, выплату рабочим компенсации при увольнении, материальную помощь по болезни, в связи с травмой, полученной на рабочем месте, а также при рождении ребенка. Госу­дарство создает общенациональную систему социальных пособий; постепенно повышает минимальную заработную плату и улучшает систему социальной помощи.
5. Диверсификация общественных организаций
В стране активно функционирует сегмент рынка посредников, которые предоставляют услуги в хозяйственной деятельности. В боль­шом количестве появляются посреднические организации, такие как биржи труда, юридические, бухгалтерские, брокерские фирмы, агентства оценки имущества, агентства по обеспечению качества и т.д. Независимые отраслевые ассоциации были созданы для оказания услуг, а также для координации и управления делами через государс­твенные ведомства. С развитием социальной автономии быстро растет число неправительственных организаций, они играют важную роль в некоммерческих областях, таких как социальная помощь, благотво­рительность, образование, окружающая среда и профессиональная подготовка.
В настоящее время у Китая еще много проблем, которые он должен стремиться решать путем углубления реформ. Государство проводит политику открытой информации, упразднения административной монополии, регулирования, создания и внедрения административных лицензий и сборов, все более широкой открытости на внутреннем рынке капитала, углубления судебной реформы и умеренной политической реформы. В настоящее время Китай делает акцент на благосостоянии людей, уделяя особое внимание социальной справедливости, реформи­рованию системы распределения доходов и социального обеспечения, на социальную ответственность предпринимателей. Самое серьезное внимание уделяется отношениям личности и общества, а также балан­су между частными и общественными интересами. При построении гражданского общества в стране правит закон, государство прилагает усилия к построению гармоничного общества.
Опыт трех десятилетий реформирования свидетельствует о том, что экономические реформы и формирование гражданского общества должны опираться на правовую систему. Конституционное, граждан-

ское, административное право и законодательство в иных общественных сферах играют в совокупности ключевую роль в формировании систе­мы гражданского общества, укреплении гражданского духа и сознания граждан. Это имеет особое значение для китайского общества, которое всегда находилось под сильным влиянием высоконравственных тра­диций и всегда руководствовалось в первую очередь законами бытия, законами человеческих отношений – во вторую и национальными – в последнюю очередь.

I. Incorporation of Market-Economy Elements into Planned Economy from 1978 to 1992
1. Plan and Market
The means of resource allocation basically transited from centrally planned economy to market-based economy. New market players emerged. According to the Constitution of the People’s Republic of China (1982), the individual and private sectors of economy are complements to the socialist public economy; the State protects the lawful rights and interests of the non-public sectors of the economy, including individual and private sectors of the economy; collective economic organizations have decision-making power in conducting independent economic activities; the State permits foreign enterprises, other foreign economic organizations and individual foreigners to invest in China. The General Principles of the Civil Law of the People’s Republic of China (1986) admits the legitimacy of different types of economic players. Individual citizens are approved to engage in industrial or commercial operation. Members of a rural collective economic organization who engage in commodity production under a contract are referred to as lease-holding farm households. Individual partnership and legal personality are clarified. A Chinese-foreign equity joint venture, Chinese­foreign contractual joint venture or foreign-capital enterprise established within the People’s Republic of China shall be qualified as a legal person in China, if it has the qualifications of a legal person.

2. Adjustment of Ownership Structure
According to the Constitution of the People’s Republic of China (1982), in the primary stage of socialism, the State upholds the basic economic system in which the public ownership is dominant and diverse forms of ownership develop side by side and keeps to the distribution system in which distribution according to work is dominant and diverse modes of distribution coexist. According to the General Principles of the Civil Law of the People’s Republic of China, state ownership, collective ownership and private ownership are types of ownership; a citizen’s lawful property shall be protected by law, and no organization or individual may appropriate, encroach upon, destroy or illegally seal up, detain, freeze or confiscate it; the State shall protect intellectual property rights, including the rights of authorship (copyrights), the patent rights, the rights to exclusive use of trademarks and the rights obtained by making inventions or other achievements in scientific and technological researches. Citizens who make inventions or other achievements in scientific and technological researches shall have the right to apply for and receive certificates of honors, bonuses or other awards.
3. Establishment of Rural Economic System
The rural reform, with the comprehensive development of market economy, was a breakthrough in China’s economic system reform. The system of People’s Commune was abolished. According to the Constitution of the People’s Republic of China, rural collective economic organizations implement a two-level management system characterized by the combination of centralized operation with decentralized operation on the basis of household contracted management; working people who are members of rural collective economic organizations have the right to farm plots of cropland and hilly land allotted for their private use, engage in household sideline production and raise privately-owned livestock. According to the Land Administration Law of the People’s Republic of China (2004 Revision), in lands collectively owned by peasants those have been allocated to villagers for collective ownership shall be operated and managed by village collective economic organizations or villagers’ committee; and those have allocated to township (town) peasant collectives shall be operated and managed by the rural collective economic organizations of the township (town); land collectively owned by peasant shall be contracted out to members of the collective economic organizations for use in crop farming, forestry, animal husbandry and fisheries production under a term of 30 years; the contractees shall sign a contract with the correspondents

contractor to define each other’s rights and obligations; the right of operation of land contracted by peasants shall be protected by law.
4. Development of Urban Residents Committee
An urban residents committee is a mass organization for self-government at the grassroots level, in which the residents manage their own affairs, educate themselves, and serve their own needs. According to the Organic Law of the Urban Residents Committee of the People’s Republic of China, a residents committee shall safeguard the lawful rights and interests of the residents, handle the public affairs and public welfare services of the residents in the local residential area, mediate disputes among the residents, assist in the maintenance of public security and develop community service activities. A residents committee shall manage its own property; and no department or unit may infringe upon its right of ownership of property.
5. Protection of Personal and Property Rights
The State respects and protects personal and property rights and set up a tort liability system. According to the Constitution of the People’s Republic of China, freedom of the person, the personal dignity and the residences of citizens of the People’s Republic of China are inviolable; freedom and privacy of correspondence of citizens are protected by law; citizens of the People’s Republic of China have the right to work, the right to material assistance from the state and society, the right to receive education and the right to comprehensive development. According to the General Principles of the Civil Law of the People’s Republic of China, citizens have the rights of life and health, the right of name, the right of portrait, the right of reputation, the right of honor, the right of marriage by choice as well as the right of equality. There are also provisions on the civil liabilities for infringement of the personality rights, the rights of life and health, the intellectual property rights and the property rights.
6. Reform, Opening-up and Worldwide Communication
There are specific provisions on the application of law in civil relations with foreigners in the General Principles of the Civil Law of the People’s Republic of China. China promotes international trade by participating in and implementing the United Nations Convention on Contracts for the International Sale of Goods (CISG), which was effective on China as of January 1, 1988. The Law of the PRC on Chinese-Foreign Equity Joint

Ventures, the Law of the PRC on Chinese-Foreign Contractual Joint Ventures and the Law of the PRC on Foreign-funded Enterprises provide legal support for expanding international economic co-operation and technical exchange, creating a stable environment for foreign investors and promoting the development of China’s national economy.
The first phase of reform fundamentally influenced the growth of civil society. Reform legitimized commodity economy, made market players and economic interests diverse and promoted equal rights and responsibilities of individuals based on free will. Independent personality was respected; and private property was acknowledged and protected by law. Legislative activities of the State met the demand of civil society; and the latter also promoted the construction of civil and commercial legal system.
II. Establishment of Market Economy from 1993 to 2003
1. Establishment of Market Economy by Formulating and Improving Civil
and Commercial Laws
A series of laws, such as the Contract Law, the Guarantee Law, the Negotiable Instruments Law, the Insurance Law and the Maritime Code of the People’s Republic of China, were enacted, which improved a sound civil and commercial legal system. Market economy was regulated by laws.
2. Significant Development of State-Owned Enterprises Reform and
Comprehensive Development of Other Market Players
Most state-owned enterprises became corporate enterprises owned by diverse shareholders in the reform of management system and operation mechanism. In the Company Law of the People’s Republic of China (1993), there are provisions on the types of corporation, its establishment as well as the basic systems of corporate management. In the Partnership business law of the People’s Republic of China (1997), there are provisions on the basic rules for the establishment of partner business.
3. Establishment of Macro-Control System in Line with Market Economy
The State made effort to achieve administrative simplification and decentralization by breaking with the traditional management mechanisms and taking the advantages of competitive market mechanisms. The State also strived to explore and establish a macro-control system in line with the market economy requirements by changing governmental function

and carrying out systematic reforms in Planning, investment, taxation, finance, foreign exchange, price and other sectors. In the Anti-Unfair Competition Law of the People’s Republic of China, there are provisions on activities of unfair competition and the incurred legal responsibilities, which create a good environment for fair market competition. In the Law of the People’s Republic of China on Protection of Consumer Rights and Interests, there are provisions on the rights of consumers, the obligations of business operators, the consumer organizations and the settlement of disputes between consumers and operators. In the Product Quality Law of the People’s Republic of China, there are basic rules on the supervision and regulation of product quality and provisions on the responsibilities and obligations of producers and sellers as well as the compensation for damages. In the Securities Law of the People’s Republic of China, there are basic rules on the issuance, trading and listing of Securities and provisions on the stock exchanges, the securities companies, the securities registration and clearing institutions and other securities institutions. In the Law of the People’s Republic of China on Urban Real Estate Administration, there are basic rules on the land for real estate development, the transfer and mortgage of real estate, etc. All these legal measures established a macro­control system, in which the State planning, financial policy and monetary policy coordinated with each other.
4. Development of Villagers’ Committees and Safeguard of Right to Operate
Contracted Landing
The Villagers’ Committees developed and conducted election, adopted decision, maintained administration and exercised supervision by democratic means. The villagers committee took measures to safeguard the dual operation system characterized by the combination of centralized operation with decentralized operation on the basis of operation by households under a contract and ensure the lawful property right and other lawful rights and interests of the collective economic organizations, villagers, households operating under a contract and partnerships. In the Law of the People’s Republic of China on the Contracting of Rural Land, there are provisions on the system of contracting for operation of rural land contracted by households, including the rights and obligations of the contract-letting party and the contract-undertaking party, the means of concluding contracting as well as the protection and circulation of the right to operate contracted landing.

5. Improvement of Legal System and World Trade after Accession to WTO
Before China’s accession to WTO in 2001, central and local governments empowered enterprises with business freedom by clearing up laws and regulations and greatly reducing administrative licenses. In accordance with China’s promise upon entering the WTO, a series of laws, including the Regulation of the People’s Republic of China on Safeguard Measures, the Countervailing Regulation of the People’s Republic of China, the Anti­Dumping Regulation of the People’s Republic of China, and some other legal measures were enacted, which improved the legal system of international trade.
The establishment of market economy made economic activities and property management independent. The State gradually withdrew from private sectors, especially competitive sectors. Private rights and autonomy became prominent. With the property relationships increasingly becoming an important element of social development, the separation of civil society and political state continuously accelerated.
III. Improvement of Socialist Market Economic Systems since 2004
1. Comprehensive Construction of Modern Market System
The multilevel and diverse commodity market and the market pattern, in which various circulation channels and management patterns co-exist, have basically come into being. Different market elements are gradually cultivated and constructed. The Prices of most commodities and services are decided by the market. A unified, open and competitive modern market system is continuously growing. In the Anti-monopoly Law of the People’s Republic of China (2007), there are provisions on the monopolistic conducts. The Anti­monopoly Law expands its application to the monopolistic conducts outside China, which influence those within the territory of the People’s Republic of China; and it also provides legal basis for preventing and curbing monopolistic conducts, protecting fair market competition and enhancing economic efficiency.
2. Improvement of Property Protection
According to the Constitution of the People’s Republic of China, the lawful private property of citizens may not be encroached upon; the state protects by law the right of citizens to own private property and the right to inherit private property; the state may, for the public interest, expropriate or
