Agreement solely because contesting the findings would cause him undue
financial hardship and stress, lead to lengthy and costly appellate
proceedings, and he wished to seek finality. Respondent agreed not to appeal
the ORI findings of research misconduct set forth above. He has agreed,
beginning on March 12, 2013:
(1) if within two (2) years from the effective date of the Agreement,
Respondent receives or applies for U.S. Public Health Service (PHS) support,
Respondent agreed to have his research supervised for a period of two (2)
years; Respondent agreed that prior to the submission of an application for
PHS support for a research project on which his participation is proposed and
prior to his participation in any capacity on PHS-supported research,
Respondent shall ensure that a plan for supervision of his duties is submitted
to ORI for approval; the supervision plan must be designed to ensure the
scientific integrity of his researchcontribution; Respondent agreed that he
shall not participate in any PHS-supported research until such a supervision
plan is submitted to and approved by ORI; Respondent agreed to maintain
responsibility for compliance with the agreed upon supervision plan;
(2) if within two (2) years from the effective date of the Agreement,
Respondent receives PHS support, Respondent agreed that for two (2) years,
any institution employing him shall submit, in conjunction with each
application for PHS funds, or report, manuscript, or abstract involving PHSsupported research in which Respondent is involved, a certification to ORI
that the data provided by Respondent are based on actual experiments or are
otherwise legitimately derived and that the data, procedures, and
methodology are accurately reported in the application, report, manuscript, or
abstract; and
(3) Respondent agreed not to serve in any advisory capacity to PHS
including, but not limited to, service on any PHS advisory committee, board,
and/or peer review committee, or as a consultant for a period of two (2) years
beginning with the effective date of the Agreement.

CASES READY FOR FURTHER PATENTING
CASE 1
Institution: University of Maryland, Baltimore

Docket: JW-2012-106
Title: 1-THP/LDN (low dose Naltrexone) combination as
medication for substance dependence disorder
Summary: Addiction is a complex and costly disorder that is difficult to
treat due to the effects on multiple brain circuits involved in
reward and motivation, learning and memory, and inhibitory
control over behavior(s). Treatment options remain limited
and addiction to alcohol and illicit drugs cause significant
problems and economic burden on society. UMB inventors
address this issue through the combination therapy of 1-THP
(dopamine antagonist) and low dose Naltrexone (opioid
antagonist) to treat addiction-related diseases and disorders,
with particular focus on substance-dependent diseases or
disorders. l-THP, an active compound isolated from the
Chinese herbal medicine Yanhusuo, has been used in clinical
practice as an analgesic (commercial name: Rotundine) in
China for more than 40 years. Naltrexone is a known
treatment for addiction in the United States but is limited to
the treatment of alcohol dependence. Preliminary studies
indicate low-dose Naltrexone in combination with l-THP
show significant improvement in biological activity over
Naltrexone or l-THP alone, as measured with conditioned
placement preference, locomotion, and relapse behavior.
More specifically, the combinatory effect comes from the
inhibition of dopamine (DA) receptors by 1-THP in
conjunction with the opioid inhibition of LDN. Additional
benefits with the 1-THP/LDN combination was seen with the
reduction in the sedation side effect of 1-THP as
demonstrated in rodent models.
Applications: A five year national study by The National Center on
Addiction and Substance Abuse at Columbia University
(CASA Columbia) revealed that 16% of the U.S. population
suffers from an addiction illness, yet only an estimated 10%
received any form of treatment. However, those that do
receive treatment often are treated by under-qualified, underequipped individuals that cannot provide adequate care. It is
estimated 40 million people in the US qualify as addicts with
another 80 million that use substances that threaten their
health and safety (e.g. tobacco, alcohol, etc). Available
medical treatment options are typically geared to address
82

acute conditions and do not address the necessary long term
f
disease management of addiction. Treatment options on the
market include Chantix (Pfizer) for the treatment of nicotine
addiction, Vivitrol (Alkermes) and Campral (Forest
Laboratories) for the treatment of alcohol dependence, and
Subutex/Suboxone (Reckitt Benckiser) for the treatment o
opiate dependence. The demand for safe, effective treatments
will drive the world market for addiction pharmacotherapies
and is forecasted to increase by 19% to $3.8 billion in 2016
with the biggest demands in the areas of alcohol, narcotic,
and nicotine dependencies.
Advantages: Naltrexone is a non-selective opioid antagonist that was
approved by the FDA for the treatment of alcohol and opioid
addiction in 1984.
Minimal safety concerns
1-THP safety trials currently ongoing by the inventor
1-THP has a long track record of use in China (Rotundine)

CASE 2
f
f
f
Institution: University of Maryland, Baltimore
Docket: IG-2009-039
Title: A device for measuring geometries in either real or synthetic
anatomic/clinical specimen(s) using instrument tracking and
computer aided analysis
Summary: Currently no means exist to (laparoscopically) accurately
measure the size and geometry of a hernia defect. Standard
methods such as flexible rulers are imprecise, laser scanning is
expensive and prone to problems, and videometric or use o
computer aided vision is limited in a surgical ward. UMB
inventors however, have developed a device with the ability to
accurately measure distances between two or more points o
interest to visualize two or three-dimensional geometries and
volumes of interest. The device is composed of a probe whose
tip (target side) contacts the points of measurement, a motion
tracking system which tracks the probe?s movements, and a
data analysis system which calculates the locations of the
contact points to perform post data processing. Primary use o
this system would allow a surgeon to accurately measure the
size of a hernia defect to render appropriate treatment including
the sizing and cutting of an appropriate mesh.
Applications: More globally, there have been needs to determine sizes,
geometries, and distances in a simple yet indirect fashion.
Direct applications of this system include but are not limited to
hernia defects, arthoscopic prosthetic fixation, forensic
measurements, bariatric, and foregut surgery.
Advantages: No system/instrument/probe currently in production can
provide the specific capabilities of providing location by the
use of direct touch and indirect measurement with the
combination of motion tracking systems and computational
analysis systems. Specifically, its use in herniorraphy is novel
and unique.
Stage of
Development:
Two types of probe system have been developed.
Unitized Probe System: This probe consists of a tracking sensor
and/or control unit permanently attached onto the probe and is
designed and manufactured specifically for the purpose of the
84

magic wand system.
Clip-On Probe System: The tracking sensor and/or control unit
is clipped onto a probe and functions altogether as a unitized
probe system. The clip-on is affixed via a clamp or clip which
is designed to connect the system and instrument as a single
unit and if needed in a specific orientation.
