8. What are the Customs regulations in respect of objects of art?

Under Russian law items older than 50 years are considered part pf Russia’s national and cultural heritage, and need Cultural Ministry approval for export. The standard procedure is to the ministry for permission. They usually ask for prove of ownership. It can be anything from a sales receipt or even a childhood picture with the instrument. When the Culture Ministry receives the documents confirming the right of ownership they issue the permission. But it says on the Customs Declaration form that items of historical or cultural value should be declared. Otherwise they may be seized on suspicious of contraband. And the person will be taken to court.

9. What actions are considered smuggling? In what way are people punished for smuggling? (13)

Smuggling is to take something or someone illegally from one country to another «to smuggle something into or out of the country» means to take something pass the officials who check what is being brought.

Smuggle has some synonyms: for example contraband.

In accordance with the Customs Code of the Russian Federation one of the main duties of the Customs Business is to prevent traffic of smuggling.

The unlawful bringing in or taking out of the country of such articles as currency, jewelleries, antiques, explosives, drugs, etc., is considered smuggling or contraband.

The articles which are consiled are usually detained and the passenger may take them on the back way.

The consiled articles from Customs control are considered smuggling and may be confiscated.

A person who is found guilty of smuggling may be punished in accordance of the Customs Regulation.

Sometimes the Customs officer is entitled to personal search if he has a reason to believe that the person is carrying about himself objects liable to confiscation.

Usually the search can be made only with the permit of the Customs Office Chief and in the presence of two witnesses.

The protocol of the search is to be signed by the officer-in-charge, two witnesses and the person accused.

In case of confiscation of articles or valuables the protocol of the confiscation is made and is written by the guilty person.

The decision of the Court is final and binding.

The valuables the articles of art and antiques can be taken out of the country only with the special permit of the department of culture.

10.Speak about personal search.

A person who is found guilly of smuggling may bе punished bу a fine or taken to Court. Smuggled articles are detained.

The methods of smuggling are becoming more and more so­phisticated, so the Customs Service has to develop more effective ways of detecting; cases of contraband, but there is no sub­stitute for a well-trained and experienced Customs Officer.

The Customs Officer is entitled to rummage every piece of baggage and if he has a reason to believe that the person is carrying about himself objects liable to confiscation he may even search the person. The search can bе made only with the permit of the Customs Office Chief. The search is carried out in the presence of two witnesses and a list of all things seized is to be made. The protocol of the search is to bе signed bу the officer-in-charge, two witnesses and the person accused.

The person accused has the right to appeal within ten days.

The decision of the Court is final and binding.
