In summary, it could be said that prostitution walked a long way from Hammurabi’s age to the present world. On this way it came across with social exclusion and legal banning because of its nuisance and affront to our sense of destiny; the public opinion about this issue constantly was negative. However, the reason why this issue is still being discussed is that people are still using the prostitutes’ service, thus it is important to find the best solution. All in all, legalized prostitution brings benefits to clients, who want to be sure with prostitute’s health, by obliging them undergo medical examinations; to the government, by taxes; finally, to prostitutes, who have to have the same rights as any other people and can become equal with other workers.

Der juristische prozess: die verbindung und die einheit mit dem materialrecht

In juristischer Literatur betrachtet man das Prozess als Ordnung der Verwirklichung der Tätigkeit der folgenden Gliedmaßen: untersuchungsrichte, administrative und gerichtliche. Das Fachwort „der Prozess“ bedeutet „die Bewegung vorwärts“. In der Literatur wird es auch bemerkt, dass es zum „Prozess“ nach der Bedeutung der Termin „die Prozedur“ genug nah ist. Dieser Termin bedeutet die Ordnung, die offiziell bei der Besprechung und der Leitung irgendwelcher Schaffen bestimmt sein soll.

Die Theorie des juristischen Prozesses wurde vom Professor W. M.Gorschenew aktiv ausgearbeitet. Es war die Bestimmung des juristischen Prozesses wie des komplexen Systems der Rechtsordnung (der Formen) der Tätigkeit der bevollmächtigten Organe des Staates, der Beamten, sowie der Subjekte des Rechtes, die für die Lösung verschiedener juristischer Schaffen interessiert sind, gegeben. Außerdem bemerkte das M.Gorschenew, dass der vorliegende Prozess von den rechtlichen Normen reguliert wird, und seine Ergebnisse werden in den entsprechenden Rechtsakten (die offiziellen Dokumente) gefestigt. Es ist entsprechend, dass der juristische Prozess auf die Realisation der Normen des Materialrechtes gerichtet ist. Um den Begriff des juristischen Prozesses, seine Stelle und die Festsetzung in der rechtlichen Praxis aufzuklären, muss man meinen, dass die Rollen der materiellen und prozessualen Normen in der rechtlichen Regulierung verschiede sind. „Die Normen des Materialrechtes bestimmen die subjektiven Rechte, die juristischen Pflichte, die juristische Verantwortung der Bürger und der Organisationen. Sie bilden den Hauptinhalt des Rechtes. Von den wesentlichen Merkmalen des Rechtes sind seine Sicherstellung eine Möglichkeit der staatlichen Nötigung, die Verbindung mit dem Staat. Es bedeutet, dass die Organe des Staates sich in die Tätigkeit, die auf die Realisation des Rechtes gerichtet ist, aktiv einreihen. Die ähnliche vielfältige Tätigkeit wird vom Termin «der juristische Prozess» bezeichnet.“

Nach Meinung der Reihe der Gelehrten soll die Theorie des juristischen Prozesses den selbständigen Teil der allgemeinen Theorie des Rechtes bilden. Andererseits, wenige Lehrbücher für die Theorie des Staates und dem Recht nehmen den Teil auf, der speziell der Theorie des Prozesses gewidmet ist. Oft beschränken auf diesem Niveau den juristischen Prozess von den Grenzen der Zweige, die als die Prozessualen gesetzgebend aufgemacht waren.

Viele Jahre in der wissenschaftlichen und Lehrliteratur verstand man den juristischen Prozess es ist eng: wie die juristische vom Recht erledigte Tätigkeit. Ende 20 Jahrhunderte war in den Arbeiten des Jh. M. Gorschenewas, das Jh. D. Sorokins, I. A. Galaganas, das Jh. A. Lorijas der breitere Blick auf dieses Phänomen gerechtfertigt. In den Monografien und den Artikeln dieser Gelehrten wurde der juristische Prozess wie die staatlich-herrische von den Rechtsnormen erledigte Tätigkeit nach der Lösung der konkreten juristischen Schaffen betrachtet. Leider ist solches Herangehen vor unserer Zeit von vielen Fachkräften für die allgemeine Theorie des Rechtes und die Staaten nicht wahrgenommen.

Viele Gelehrte kommen zur Bestimmung des Begriffes und der Merkmale des juristischen Prozesses auf eigene Art heran. Zum Beispiel, W.I.Leuschin behauptet, dass der juristische Prozess «die von den prozessualen Normen erledigte Ordnung der Tätigkeit der kompetenten staatlichen Organe, in der Vorbereitung bestehend ist, die Annahme, die dokumentarische Befestigung der juristischen Lösungen, des allgemeinen oder individuellen Charakters» ist. D.N.Bachrach stellt unter der Zweifel die gegebene Bestimmung. Er sagt, dass der juristische Prozess, erstens die Tätigkeit, die sich in der bestimmten Ordnung verwirklicht ist. Er meint, dass die Annahme der Lösungen der rechtliche Brennpunkt der prozessualen Tätigkeit ist. In trennscharf, rechtsetzunge und andere Prozesse von der Annahme der Akte endet der vorliegende Prozess.Es dient als Grunde für Anfang der Andere. Aber in anderen Prozessen die große Aufmerksamkeit teilen der Erfüllung der übernommenen Akte zu. So ist die Notwendigkeit der Entwicklung der prozessualien Theorien wie des Bestandteils der allgemeinen Theorie des Rechtes eine eingerichtete Tatsache seit langem. Das Wissen der Theorie des juristischen Prozesses hilft die Hauptprobleme, die auf der gegebenen Etappe ihrer Entwicklung existieren, zu begreifen und abzufassen. Das hilft die möglichen Wege des Studiums und der Lösung der Probleme in den Zweigen des juristischen Prozesses zu durchdenken und zu analysieren.

Probleme der Bildung des Rechtsstaats in Russland

Im Teil 1 Artikel 1 Verfassung der RF ist verkündet “ Russische Föderation - Russland ist der demokratische föderative Rechtsstaat mit der republikanischen Regierungsform “. Ungeachtet des in diesem Artikel angegebenen Status Russlands als Rechtstaat ist es derzeit in höherem Maß die Äußerung von Verfassungidealen.

Der Staat wird dann ein Rechtsstaat sein, wenn sich die Zivilgesellschaft bildet. Das fordert die Anstrengungen. Der Rechtsakt wandelt den Staat nicht in einen Rechtsstaat um. Nur die Gesetze sind nicht fähig den Staat in den Rechtsstaat umzuwandeln. Der Werdegang des Staates ist folglich ein Prozess, der von der Gesellschaft natürlich erlebt ist, die Gesellschaft soll dazu bereit sein.

Hier gibt es nicht nur ein juristisches Problem, dabei ist das Vorhandensein des was Gesetzgebungsystems , das fähig ist, denn Staat zu vereinigen - der bedeutende Schritt für den Werdegang des Rechtsstaates. Man muss politisches und sozialwirtschaftliches Systeme vervollkommnen, es ist auch die Umwandlung des Eigentums erforderlich, weil unter Bedingungen der Oberherrschaft des monopolistischen bürokratischen staatlichen

Eigentums , das harte administrative Befehlsgewalt braucht, der Staat ein Rechtsstaat nicht sein kann.

Unter den modernen Bedingungen ist eine der wichtigsten und kompliziertesten Aufgaben für Russland die Bildung des Rechtsstaats mit der starken demokratischen Gewalt, die das Recht befolgt. Einige Handlungen in dieser Richtung sind schon vorgenommen. Zum Beispiel wurde die Hauptperson im Staat ein Objekt der öffentlichen Kritik. Für den Rechtsstaat ist es wichtig, weil die Gesellschaft berechtigt ist, objektive Bewertung ihrer Tätigkeit zu bilden.

Derzeit befindet sich Russland im Stand der Krisenbewältigung, das erschwert die Aufgaben, deren Lösung für den Werdegang des Rechtsstaates erforderlich ist. Die Gesellschaft ist besonders besorgt über den Stand im Bereich der Menschenrechte, anschwellende Kriminalität, Korruption und Bürokratismus.

Dabei fördert mechanisches Kopieren von Ideen der westlichen Staaten den Werdegang des Rechtsstaates in Russland nicht. Diese Ideen sind für russische Realen nicht geeignet.- Spätentwicklung der politischen und parlamentarischen Kultur, tiefes Niveau der rechtlichen Aktivität der Bevölkerung und immer noch entwickelnde demokratische Traditionen.

Mit Rücksicht darauf darf man bei der Betrachtung der modernen Entwicklung der Idee des Rechtsstaats ihre Rolle und Grad der Verbreitung nicht überbetonen . Der Rechtsstaat ist zurzeit eher das Ideal, das Bestreben nach diesem Ideal in den Verfassunggrundsätzen und Schlagworten ausgedrückt und dieses Ideal ist noch in keinem Staat verwirklicht.

Die Entwicklung der Konzeption des Rechtsstaats vermutet die Benutzung der algemeinmenschlichen Werte und die Bildung der beständigen Rechtsordnung, Einhaltung der Gesetzlichkeit und der Verfassungmäßigkeit ,der besonderen Stelle und Rolle der Strafverfolgungsbehörden im System der verbreiteden Volksselbstverwaltung, der Vielfältigkeit der Meinungen und Beurteilungen in allen Bereichen des Lebens, d.h.für allseitige Persönlichkeitsentwicklung bei der Sozialen Gerechtigkeit.

Im Ergebnis ist am wichtigsten der Platz, den der Mensch Wertesystem der gesellschaftlichen staatlichen Ordnung einnimmt, die dem Menschen vor der Gesellschaft vorgestellten Möglichkeiten und die ihn gewährte Lebensqualität. Diese Kriterien bestimmen die Perspektiven und die Vorteile der beliebigen sozial-politischen Systeme. Insbesondere ist es aktuell unter den modernen ständig ändernden Bedingungen der Welt ,wenn das Problem der Humanisierung der gesellschaftspolitischen Verhältnisse immer schärfer erscheint.

Zum jetzigen Zeitpunkt befindet sich Russland schon auf dem komplizierten Weg der Bildung der Zivilgesellschaft und der neuen Grundsätze in den Verhältnissen der Bürger und der Macht.

Der Rechtsstaat kann und soll sich auf Grund der Realen und der Traditionen der Heimat entwickeln, mit Rücksicht auf der allgemein -menschlichen Werte . Die historisch überdacht sind und mit der internationalen Gemeinschaft in den Menschenrecht ausgedrückt sind, die von der Russischen Föderation im vollen Umfang anerkannt sind und organisch mit den Rechten ihrer Bürger ergänzt sind.

Erforderliche Bedingungen zur Realisation des Verfassungsmodells des Rechtsstaats in Russland sind seine Stabilität und Langfristigkeit.

Zur Realisation der Idee des Rechtsstaats ist auch die Umwandlung des Systems der sozialwirtschaftlichen Verhältnisse erforderlich, die ermöglicht, Ideen, Konzeptionen des Rechtsstaates tatsächlich zu verwirklichen.

Nach der Überwindung der Schwierigkeiten und der Hindernisse realisiert Russland sein Bild des Rechtsstaates, das seiner Geschichte, Traditionen und Kultur entspricht, und wird in die wirklich freie demokratische Gesellschaft umgewandelt.

The Constitution of the Russian Federation of 1993

The Constitution of the Russian Federation of 1993, adopted in a national referendum, is the starting point of a new stage of the political development of Russia. Undoubtedly, it influences the development of the entire legal system, of all the Russian legislation.

The basic law of each country always arouses interest of its citizens, politicians, representatives of the international community. This also applies to the Constitution of the Russian Federation. It started under special conditions which emerged in the autumn of 1993 after the armed confrontation of the President and the Parliament.

The Russian Constitution does not provide rules on the role of the political opposition. In a democracy, opposition is necessary. The opposition shows weak points, deficiencies of public administration and thus contributes to the solution of social problems.

The Constitution is the fundamental law of the Russian Federation and is valid throughout the territory, but there are bad traits. Citizens and non-citizens do not always follow the law, and today it is an urgent problem.

Russia is a federal state consisting of more than eighty subjects. Three types of entities are formed on a territorial basis and three (republic, autonomous prefectures and autonomous regions) on the national one. Art. 5 of the Constitution of Russia determines the equality of all the constituent components of the Russian Federation which gives ground to consider Russia a theoretically symmetric federation. But in practice, our Federation is complex and asymmetric, and its constituent components are diverse and based on different principles. This is indirectly confirmed in the Constitution itself. Proclaiming in Part 4 of Article 5 the equality of the constituent components both towards each other and in their relations with the federal authorities, the Constitution nevertheless decides on the status of the constituent components of the Russian Federation contradictorily.

Another question is the number of constituent components in the Federation. It is now clear that, first of all, there are a lot of them. Secondly, the fact is that the constituent components were formally established on the basis of administrative units. Now there is a tendency to reduce the number of constituent components. However, even if there are fewer constituent components, according to Article 5, Part 1 of the Constitution, there should be republics, territories, regions, federal cities, autonomous regions and autonomous areas. This is due to the fact that Article 5 refers to Chapter 1 ”The Constitutional Order”, the provisions of which cannot be reviewed by the Federal Assembly. To make such changes it is necessary to adopt a new Constitution.

Toward a Remedy for Extremism

After throwing light on the so-called ”religious extremism”, pointing out aspects of its true nature and characteristics and revealing its most important causes, motives, and stimulants, we now need to outline a remedy for it, its means, and methods. It should

be emphasized at the outset that the remedy is inseparable from the causes and must, therefore, be as varied and complex as the causes themselves are. Needless to say, no magical touch can put an end to extremism or bring back the extremists to the line of moderation. The malaise afflicting the soul and mind of mankind is far more deeply rooted than we think, and consequently more difficult to treat. Extremism is essentially a religious phenomenon with a variety of psychological, social, and political dimensions. As such, all of these aspects must be tackled from an Islamic point of view.

Yet it is unjust to hold the young alone responsible and to exonerate the society, the regime, and its governmental departments especially those in charge of education, guidance, and the media. The responsibility is in fact mutual, and each of these elements partly played an important part.

It has already been pointed out that the inner contradictions and the chaos which characterize present-day Muslim societies, as well as the estrangement of these societies from Islam, have significantly contributed to the birth and spread of extremism. Therefore, these societies must play a positive role in the remedy. The initial step for a Muslim society is to acknowledge and confirm its genuine commitment to Islam.

Islam is a comprehensive system of life. To be really Islamic society must commit itself to Islam in its totality, unlike the Israelites who adopted only parts of the Torah but ignored the rest. Furthermore, for a society to be Islamic it must be willing to apply Allah’s injunctions on all the affairs and aspects of life: social, economic, political, or intellectual.

Our societies must endeavor to eliminate this obvious contradiction we believe in Islam both as a divine creed and a Shariah, but we have abandoned its Shariah and disregarded its guidance and moral teachings. These we have replaced with imported systems and alien ideologies from both the East and the West yet we still claim to be Muslims. Our rulers must understand and realize that they are in a Muslim land and are ruling Muslim peoples who are entitled to be governed in accordance with the teachings of their religion. Constitutions, laws, educational systems, etc., must all reflect and express the people’s beliefs, values, and traditions, which must also be guided, consolidated, and disseminated via the media. The economic and social policies-at local and international levels must be formulated within the framework of these beliefs and must serve their goals. The failure of the rulers in Muslim countries to live up to these legitimate expectations is utterly unacceptable and is in stark contradiction to Islam. Indeed, these rulers’ defiance of the conscience of Muslims in most Muslim countries has become intolerable. Some of them openly reject Islam and express their commitment to an Eastern or a Western ideology.

Human organ trafficking

Trafficking in organs is an organized crime, involving a host of offenders. As of 2011, about 90,000 people were reported to have been waiting for a new organ. There is a worldwide shortage of organs available for transplantation, yet commercial trade in human organs at one point was illegal in all countries except Iran. Illegal organ trafficking is widespread, but data

on the extent of the black market is difficult to obtain. Whether or not to legalize the organ trade to combat illegal trafficking and organ shortage is a subject of much debate. On average, an individual will wait three and a half years for an organ to become available for transplant. Financial compensation for organ donors is being legalized in Australia and Singapore.

The worldwide demand for donated organs and tissues has grown exponentially since the first successful corneal transplantation over a century ago in 1906. Over time, surgeons developed the ability to perform new transplant procedures, beginning with the first successful kidney operation in 1954, and quickly followed by liver, heart, pancreas, lung, intestines, hand, and in 2010, even face transplants. As difficult as these surgeries may be, acquiring organs for transplantation is the greater challenge. Nevertheless, in the United States an average of 79 people receive an organ transplant each day.

There are two main forms of the illegal organ trade. Those from impoverished economic conditions selling their own body organs for profit, and body parts taken from executed prisoners. The black market trade of human organs is sustained by wealthy individuals, sometimes on long waiting lists for transplants, traveling to foreign countries for the procedure.

Once organs are trafficked, mainstream health care services help to ”launder” these transactions, giving them the appearance of legitimacy while hindering estimates as to how often these crimes happen — in fact, nobody knows how many organs are being traded across the world. ”If countries do nothing about this problem, the consequences for both donors and recipients can be terrible, as they may have to deal with dreadful health outcomes”, said Dr. Ana Manzano.

”In effect, illicitly purchased organs are transformed into legitimate organs by the process of integration into mainstream financial institutions”, wrote Manzano.

More than 114,000 organ transplants are done annually in over 100 countries. World Health Organization (WHO)

The Guiding Principles on Human Organ Transplantation (1991) of WHO state that the commercialization of human organs is ”a violation of human rights and human dignity”.

Some facts:

1)China is the world’s second largest performer of organ transplants.

2)The Chinese government has been unable to account for the source of 41,500 transplanted organs for the years 2000 to 2005.

3)Offers to sell organs have been found on the Internet.

4)In Bangladesh, the trade is propelled by poverty, where 78 per cent of residents live on less than $2 a day. They give their organs to pay off loans and take care of their families. If they received the money at all, it disappears quickly and they are often left sick and unable to work after the operations.

5)The legislation passed in the United States on human trafficking is not only for prosecution of these perpetrators, but to help the victims.

Organ trafficking undoubtedly ranks among the most gruesome and morally reprehensible of crimes. Now, a new study suggests this murky business is enabled and facilitated by legitimate institutions.

BRICS — a new generation

of international cooperation. The prospect of the future or false hope?

The world has entered a new stage of economic, political and financial cooperation. Today we are witnessing the general desire of countries to integrate. Integration is a way of mutually beneficial cooperation, which involves the realization of interests of participants. In 2006 an international Association of developing countries, BRICS, which includes Brazil, Russia, India, China and South Africa was created.

The work of the new bank was launched by the first meeting of the Board of governors of the development Bank in Moscow. Max Planck’s capital was set at $ 100 billion. Paid-in capital amounted to $ 10 billion.1 The successful operation of the bank will strengthen the voting power of developing countries in the IMF, will increase their importance in the international arena. Developing countries will be able to get support from the BRICS to implement infrastructure projects.

Another achievement is the creation of the pool of currency reserves, which is designed to smooth out the surges in demand for foreign currency. Pool is a safety tool, which amounts to $ 100 billion.

The new development Bank aims to become the main rival to the IMF. However, now the Bank is the only model of this Institute because the number of IMF’s depositors is 188 but BRIC’s depositors is only 5.

Today, countries are concerned by the sharp decline in its economic growth. The total outflow of capital in the last 14 months amounted to about $ 1 trillion.2 By the end of 2015 the Russian economy will be the laggard among the BRICS members, due to the introduction of tough sanctions and falling oil prices. In addition, we can see the fragmentation in the actions of the BRICs.

However, BRICS is in the top 4 economies of the world belonging to the ”Big ten”, as well as Africa’s largest economy. Each of the member countries has huge economic potential. BRICS countries should introduce multi-currency system to counter the hegemony of the dollar. Unfortunately, trading currencies are carried out only at the rate of CNY / RUB in Russia and China. In addition, dollar system was adopted as a basis for the establishment and operation of new financial institutions BRICS.3 This demonstrates the binding of this structure and its institutions to the dollar.

BRICS is a new phase of international economic cooperation. Member countries are able to become the main competitor of the Western countries and the US in the future. But now it is only a distant prospect, the implementation of which will meet in a modern setting many obstacles.

The European Convention on Human Rights

The European Convention on Human Rights (ECHR) (formally the Convention for the Protection of Human Rights and Fundamental Freedoms) is an international treaty to protect human rights and fundamental freedoms in Europe. Drafted in 1950 by the then newly formed Council of Europe, the convention entered into force on 3 September, 1953. All the Council of Europe member states are parties to the Convention and new members are expected to ratify the convention at the earliest opportunity.

The Convention was designed to incorporate a traditional civil liberties approach to securing ”effective political democracy”, from the strongest traditions in the United Kingdom, France and other member states of the fledgling Council of Europe. The Convention was opened for signature on November 4, 1950, in Rome. It was ratified and entered into force on September 3, 1953. It has been overseen and enforced by the European Court of Human Rights in Strasbourg, and the Council of Europe. Until procedural reforms in the late 1990s the Convention was also overseen by a European Commission on Human Rights.

The nature of the Convention is that it is drafted in broad terms, in a similar method (albeit more modern) to the English Bill of Rights, the American Bill of Rights, the French Declaration of the Rights of Man or the first part of the German Grundgesetz. Statements of principle are, from a legal point of view, not determinative and require extensive ”interpretation” by courts to bring out the meaning in particular factual situations. However, decisions are ”legally binding upon the state parties”.

The European Convention is still the only international human rights agreement providing such a high degree of individual protection. State parties can also take cases against other state parties to the Court, although this power is rarely used. The Convention has several protocols.

Allgemeine Regeln des Staatsangehörigkeitserwerbs für Ausländer

Sofort ist es nötig zu sagen, dass im deutschen Recht für die Personen mit verschiedenem Status verschiedene Regeln des Erhaltens der Staatsangehörigkeit existieren. Es ist nötig nicht auch zu vergessen, dass die Rede ausschließlich über die Ausländer, das heißt die Personen niedriger gehen wird, die nicht die Deutschen laut dem Artikel 116 des Absatzes 1 des Hauptgesetzes sind. Im Übrigen ist es gleichgültig, ob sich der Mensch zur deutschen Nationalität oder nicht beordert, da die und der Status nach dem 116. Artikel durchaus nicht immer und nicht in allem übereinstimmen. Also, allgemein sind die folgenden Prinzipien.

Den neuen Bürger übernehmend, wünscht der deutsche Staat, dass er ein würdiger Bürger dieses Landes nicht nur wird genoss die Rechte, sondern auch brachte den Nutzen oder selbst wenn den Wirtschaftsinteressen der BRD nicht schadete. Überflüssig zu sagen, dass das Vorhandensein der kriminellen Strafen nach dem Urteil der deutschen Gerichte der Chancen des Kandidaten auf die positive Lösung der Frage nicht vergrössert. Für viele Fälle die Befriedigung des Antrags von der Überlassung der deutschen Staatsangehörigkeit behindert die Tatsache des Erhaltens der sozialen Hilfe.

Im Ideal soll der Bewerber um die Staatsangehörigkeit die Wohnfläche, die Arbeit haben (es ist genug, wenn ein Familienangehörige arbeitet, wenn sein Einkommen auf ihren Inhalt ohne staatliche Hilfe), die Rentenversicherung packt und das Deutsche im Maß, das für die erfolgreiche Integration in die neue Gesellschaft notwendig ist zu besitzen.

Im Unterschied zu den Auswanderern verfügen die Ausländer über den Rechtsanspruch auf die Überlassung der Staatsangehörigkeit in der Regel nicht. Die Endlösung wird in Ermessensentscheidung zurückgegeben. Dessenungeachtet, die Letzten, natürlich, können so, wie sie wollen nicht handeln, und sind verpflichtet, aus den obengenannten Kriterien “der Zuverlässigkeit” des Kandidaten zu stammen. Ein Ergebnis der Abwesenheit des unmittelbaren Rechtes auf die Staatsangehörigkeit ist, dass die Absage in der Überlassung nur der begrenzten Kontrolle seitens der gerichtlichen Organe unterliegt.

Diese Organe nur für die Ausnahmefälle können das Amt zur Überlassung der Staatsangehörigkeit “verurteilen”. In der Regel, im Falle der Unrechtmäßigkeit der Absage verpflichten sie die Beamten von neuem nur, die Erklärung des Bewerbers zu revidieren, dass, zum Ausgangsergebnis nämlich mit anderer Begründung der Lösung wieder bringen kann.

Viele unseren Landsleuten befinden sich im Irrtum, sie meinen, dass das Kind, das auf den deutschen Territorien geboren wurde, ein deutscher Bürger (das sogenannte territoriale Prinzip) automatisch wird. Es ist nicht so. Die Bedeutung hat nicht den Geburtsort, und die Staatsangehörigkeit der Eltern (das Prinzip der Herkunft). Es ist genug, damit zum Zeitpunkt der Geburt einer von ihnen ein Bürger Deutschlands war, dann wird von dieser auch das Kind, selbst wenn er in Australien das Licht der Welt erblicken wird.

Das territoriale Prinzip ist für die klassischen Immigrationsstaaten typisch, solche wie die USA, die ehemaligen spanischen Kolonien in Zentral und Südamerika usw. Deutschland wünscht aber nicht, ein Immigrationsland zu sein. Deutschland strebt nach der Vergrößerung der Zahl der Bürger nicht. Die Regierung meint, dass die Erwerbung der deutschen Staatsangehörigkeit von den Ausländer eine logische Vollendung eines langwierigen Integrationsprozesses sein soll, und vom konkreten Geburtsort nicht abzuhängen.

Foreign experience of independent study on improving student’s professional interpretation competence

The interpretation process is very complex and is closely related to thought process, thus, there are different approaches to what forms the interpreting competence. According to the modern approach, which is supported by many interpreters, the competence can be divided into 6 equivalently important fields:

1.General knowledge;

2.Delivery;

3.Split attention;

4.Décalage;

5.Stress management;

6.Reformulation.

It is evident that it is not possible to interpret without certain level of general language knowledge, thus general knowledge should be included into the professional interpretation competence [2, pp. 76–78]. But the exercises and trainings aimed at mastering language knowledge do not vary in different countries. That is why we will focus on items 2–6.

The delivery skills are required in interpreting, while expressing someone’s thoughts. The interpreter should impact ideas adequately and have oratory skills and the ability to draw the audience. These are the exercises that might usefully be done to improve delivery skills:

• ”Cheating” means to repeatedly interpret the same speech until you arrive at a satisfactory version. The artificial nature of the task is outweighed by the value of the exercise. The student reduces the intellectual burden by hearing the speech a second or third time, thus allowing them to concentrate on production.

Shadowing someone’s speech which has a large number of delivery problems (i.e. frequent restarts, umming and erring, self-correction etc.). The students should eliminate the same flaws in the target text.

Speaking and listening at the same time is not natural and can detract from other cognitive activities, therefore it is worth of practicing. During interpretation attentionsharing reduces the capacity available for speech comprehension, and interference between source language and target language also makes comprehension more difficult [1, p. 213]. There are exercises that one can usefully engage in to improve the split attention:

Listen to a sentence, stop the tape, think about how to interpret it, speak the interpretation while listening to the next sentence, stop the tape, think about how to interpret it etc.

Shadow a speech while at the same time writing something completely unrelated on a piece of paper. I.e. numbers from 1–100 in reverse order.

Improvisation exercise. Improvise a speech of 2 minutes on a subject volunteered by a colleague. Other students listen and comment on the coherence of speech, delivery etc. This exercise trains the split attention of the interpreter since as you improvise you should be thinking ahead to your next sentence/paragraph. It also trains delivery technique.

The same as the previous one except students outside the booth show cards with keywords on them at short intervals. The person speaking must incorporate the word/idea coherently into the improvised speech.

Décalage is a French word for the time difference between what the speaker says and its reproduction by the interpreter in the target language. These are the exercises that might usefully be undertaken to improve the décalage skills:
