  3. supervision of the observance of laws by bodies that conduct detective and search activity, inquiry and pre-trial investigation;

  4. supervision of the observance of laws in the execution of judicial decisions in criminal cases

The procurator has the right, and it is his duty, to appeal against all decisions and actions of state bodies and officials which he considers to be unlawful. Every citizen has the right to complain to the procurator concerning any violation of the law.

When a breach of law contains the elements of a crime it is the duty of the procurator to bring the guilty person to trial.

  1. Who supervises the investigation of cases conducted by the Militia?

The procurator supervises the investigation of cases conducted by the Militia, and other state security bodies. The Procurator’s Office institutes criminal cases and investigates criminal cases, ascertains the circumstances under which crimes were committed, collects evidence against the criminals and their accomplices and sees to it that other investigating bodies act within the law.

After the investigation of a criminal case the procurator approves the indictment and transfers it to the court.

10) What are the functions of the procurator in the trial?

The procurator discharges important functions in the trial. In criminal cases he acts as the state prosecutor. Like other participants in the trial (the defence counsel, the injured party) he may question witnesses, take part in the investigation of evidence and submit fresh evidence in the court, challenge the members of the court. When the court investigation is over, he pronounces his final speech for the prosecution.

11) Does the procurator have the right to lodge protests with higher judicial bodies against the sentences and decisions of the courts which he finds illegal?

The procurator may lodge his protest against the court’s judgement, decision or rider in a higher court, which passes a final decision on his protest.

12) Does the procurator have the right to withdraw the charge?

If the procurator is of the opinion that the accused is not guilty, it is his duty to withdraw the charge.

13) In what way does the procurator supervise the execution of judicial decisions?

The procurator has broad powers of supervision over the observance of legality in places of confinement. He verifies the legality of keeping persons in places of confinement. He ensures that the statutory regime rules and the rules of labour for convicted persons are observed. He supervises the state of educational work.

14) What rights does the procurator have to discharge these functions?

To discharge these functions, the procurator has the right to inspect places of confinement at any time, to study documents, to question prisoners in person and to demand personal explanations from the administration.
