Prescription

“Theory of the State and Law” is an educational plan for studying and passing exams by student’s 1^st of non-juridical specialties of KIU.

Offered methodical materials are completely document that reflects the main directions and volumes of educational work of student’s.

Such completely provision of educational course by methodical documentation and timely using by it will help student’s 1^st course to orient in completely commitments and to plan an economy use for work.

Methodical recommendations are prepared according to program on normative course “Theory of the state and Law” and according to changes that were in social practice, particularly in real sovereignty of Ukraine.

Having prepared of studying this discipline student must discount conditions of building the state in Ukraine, main bases and conclusions that are in Declaration on State Sovereignty of Ukraine, Act on Independent of Ukraine and also problems of person right’s for general law understanding.

Having learned course “Theory of the state and Law” assists to completely understanding by students the essence, social meaning and indissoluble connect such phenomenons as state and law, their interaction in the system of concrete historical public relations. Learning theoretical provisions, it is necessary to connect it with the facts of reality, practice of building Ukraine and it’s legislation, reform of political and law system. It is necessary to work out literature critically.

Requirements for knowledge and skills

Students must know:

— reason and condition of arising the state and law;

— essence, meaning, forms, characteristics and functions of the state;

— concept and system of law, characteristics of offence and bases foe application the judicial responsibility;

— bases of branch legislation.

Students must know how to:

— differ the branches of national law;

— differ lawful behavior from illegal and crime from misdemeanors;

— define the form of government, administrative-territorial apparatus from political regime of definite state;

— conclude the employment agreement;

— define the form of property of subject of law relations.
