2.1 A complaint of damage

Dear Sirs,

We are writing to you to complain about the damage to Control Fuel Unit we received yesterday against contract No. 26/15-098.

The boxes in which the Units were packed were damaged and looked as if they had been broken open in transit. From your invoice No. 76-098 we estimate that 5 (five) Units to the value of $156,098.90 have been stolen. And because of the rummaging in the boxes, quite a few other units were crushed or stained and cannot be used for the purposes intended. We are holding them at your disposal pending your instructions as to how they should be returned.

With the sale on c.i.f. basis and the forwarding company being your agents, we suggest you contact them with regard to compensation.

You will find a list of damaged and missing articles attached hereto, and the consignment will be put to one side until we receive your instructions.

Dear Mr Bhatta,

Thank you for your informing us of the damage to our consignment (Inv. 76-098).

From your previous transactions you will realize that this sort of problem is quite unusual. Nevertheless, we are sorry about the inconvenience it has caused you.

Please would you return the whole consignment to us, postage and packing forward, and we will ask the Shipping company to come and inspect the damage so that they can arrange for a fair compensation. We reckon this matter should not be taken up with the insurance company.

If you want us to send you another shipment as per your Contract 76-189/356-01 please let us know. We have the Units in stock and there would be no trouble to send them within the next fortnight.

Dear Sirs,

We are sorry to hear that you have trouble with our Switchers delivered under Contract 76-189/356-12. However, we consider that you refuse to accept the goods due to a misunderstanding.

We cannot accept your claim for the following reason. As the contract was concluded on ex-works terms we cannot be held responsible for the alleged damage incurred during transportation.

We hope that you will be satisfied with this explanation and withdraw this claim.

We maintain that we are not liable for the damage to the goods, but considering our long-standing business relations and the loss you may have suffered we suggest as a token of goodwill that the consignment should be examined by our experts, as before the shipment the goods were carefully tested and found in excellent condition and conforming to technical conditions and specification in every respect.
