Conclusion. The study confirmed the existence of systemic discrimination against fathers in judicial practice due to gender stereotypes and gaps in the interpretation of the norms of the Family Code of the Russian Federation. As a legal solution, a model of harmonization of legislation through the presumption of joint custody, standardization of parental competence assessment and amendments to Article 66 of the Family Code of the Russian Federation is proposed.

TheAbstract 8 of environmental rule of law is genetically placed in the context of broader rule-of-law principles. Similarly to the general concept of the rule of law, the environmental rule of law focuses on fair, clear and implementable environmental laws; public participation in decision-making; access to justice; access to information; accountability and integrity of institutions and decision-makers; clear and coordinated mandates and roles across and within institutions; accessible, fair and timely dispute resolution mechanisms; recognition of the mutually reinforcing relationship between human rights and environment.Alloftheseelementsoftheenvironmentalruleoflawwere in some way assessed in the First Global Report on Environmental Rule of Law (2019), (hereafter as the First Report) and in the second report
– Environmental Rule of Law: Tracking Progress and Charting Future Directions(2023),(hereafterastheSecondReport),whichundoubtedly has contributed to the systemic approach to the environmental rule of law. This paper discusses some systemic issues of the environmental ruleoflawinthelightofthesereportsfindingsthatgiveaglobalprospect

on the implementation of the environmental rule of law. It follows from themthatthe environmentalruleof lawshouldbeconsideredas abasis before adopting any document and acting on environmental policy and law provides framework standards for addressing the gap between theory and practice of environmental law. As has been pointed out intheSecondReport,theenvironmentalruleoflawislatelytransforming due to such factors like technical innovation, the COVID-19 pandemic, and the rise of social justice movement inter alia, challenging standards of the environmentalruleof law.The articlecomprises4parts.The first concerns the concept and context, the second one presents specific features and core elements of the environmental rule of law, the third – points to the benefits of compliance with the environmental rule of law. Some summarizing conclusions have been included in the fourth part.

S. This has prompted a reassessment of sustainability strategies and raised concerns about potential conflicts with the fiduciary duties of directors and portfolio managers. This paper exploresthetensionbetweenESGandshareholderprimacyunderDelaware law,whichishometo66%ofFortune500companies.Itisacontribution to the theories of shareholder primacy and corporate governance with the most up-to-date evidence, at the intersection of law, economics and finance. Although Delaware courts have not specifically approached the liability extent of directors and asset managers in ESG related decisions, they have established the elements of the fiduciary duties

of care and loyalty, which can be applied to ESG-aligned decisions. This paper highlights guidelines for directors, portfolio managers and fiduciaries when making ESG-aligned decisions, in particular the careful documentation of the process followed in reaching a decision. The paper also calls for more rigour in the field of sustainability.
