ПРЕДИСЛОВИЕ
Основной целью пособия является введение и закрепление лексики по специа-
лизированной тематике. В пособии содержатся тексты и упражнения, целью кото-
рых является облегчить учащимся усвоение и закрепление изучаемого ими учебного материала.
При выполнении упражнений и переводе текстов студентам следует использо-
вать терминологический словарь, помещѐнный в конце пособия и содержащий как пояснения терминов на английском языке, так и их русские соответствия.

CHARTER PARTY
(part 1)
Charter party is an official document. It is an agreement between Shipowners and Charterers on the carriage of the gods. Under this agreement the shipowners undertake to provide a vessel for the carriage of the goods. The charters, on the other hand, undertake to supply the cargo and to pay freight.
All the conditions of reception, carriage and the delivery of the goods are included in a Charter Party. It includes the following information:
the name of the two contracting parties and their legal addresses;
the name of the ship which is to arrive at an agreed port to take the cargo;
the date when the ship is to arrive at an agreed port to take the cargo;
the descriptions of the cargo and its quantity;
the port of destination;
the consignee‘s name;
the rate and amount of freight;
the conditions on which the cargo is to be carried and delivered to the consignee. These conditions usually also refer to the fact which of the parties is to carry out loading or discharging the cargo and who is to pay money for this operation;
the conditions defining the responsibility of all the parties, of the charters, carriers and consignees. The main principle of this responsibility is that the guilty party is to pay for damage or loss sustained by the ship or cargo. For example, the carrier is responsible for the damage caused during the voyage through his fault. But if the damage resulted from insufficient packing or negligent stowage the shipper is to pay for it;
When the vessel is delayed beyond the time stipulated in the Charter Party, the charterers must pay the owners demurrage. On the other hand, if loading or discharging operations are completed before the time, the Charter party provides for the payment of dispatch money. Dispatch money and demurrage are calculated in accordance with the terms agreed

upon in the Chapter party, and may differ according to the nature of the cargo shipped, the size of the vessel, and the form of the Charter party used.

CHARTER PARTY
(part 2)
A vessel may be chartered for carrying the goods at a single voyage, between two or more ports, or for several voyages between such ports. These forms of Charter Parties are called Voyage Charters to distinguish them from Time Charters.
(1)A charter-party for a voyage is a formal agreement made between the owner of the vessel and the charterers by which it is agreed that the vessel shall load at a certain named place a full cargo either of goods of a specified description or of general merchandise, and being so loaded shall proceed with all possible dispatch to a specified place, and there deliver the cargo to the charterers.
The Freight clause provides for the amount of freight to be paid and the manner and time of payment; for the time, usually described as lay days, to be allowed for loading and discharging, and for the demurrage to be paid if the vessel is detained beyond the lay days;

Demurrage is, properly speaking, a fixed sum per day or per hour agreed to be paid by the charterer for any time during which the vessel is detained in loading or discharging over the time allowed, which is, as we have said, usually described as the lay days. The contract usually provides that Sundays and holidays shall be excepted in counting the lay days.
In the Freight clause the method of payment is stated clearly. Freight is usually paid per ton delivered. It means that the freight is paid concurrently with the discharge of the cargo. A common stipulation is that the freight is to be paid on right and true delivery of the cargo, but the custom is to pay sums during the discharge.
Dead freight is the name given to the amount of freight lost, and therefore recoverable by the shipowner from the charterer as damages if a full and complete cargo is not loaded in accordance with the terms of the charter-party.
(2)A time charter-party is a contract between the shipowner and charterers, by which the shipowner agrees to let and the charterers to hire the vessel for a specified term for employment.
A place is usually named at which the vessel is to be re-delivered to the owners at the end of the term, and the freight is payable until such re-delivery; the owner almost always pays the wages of the master and crew, and the charterers provide coals and pay port charges;
The freight is usually fixed at a certain rate per gross register ton per month, and made payable monthly in advance.

Freight payable in time charter parties
(1)The shipper shall only be liable to pay the freight for the time that he can use the ship, but he shall continue to pay the freight when the use of the ship is suspended due to navigational incident.
(2)If the suspension of the use prescribed in the preceding paragraph is caused by an act of the carrier or his agents, or the condition of the ship, the shipper shall not be liable to pay the freight. If any damage resulted, he may claim for damages.
(3)Where the ship is missing the shipper shall be liable to pay the full freight up to the day when he had the last news. He shall be liable to pay half of the freight from the day of the last news up to the last day when the particular voyage is normally expected to have completed.
Freight payable when short of goods in charter parties
Where the whole or part of a ship is being used for carriage and the goods loaded are less than the agreed quantity, the shipper shall still be liable for the full freight, subject to the deduction of all the expenses thus saved and three-quarters of the freight earned from substituted goods.
Deduction of freight on rescission
Where the shipper is liable to pay the full freight on rescission of the contract he may deduct all the expenses thus saved by the carrier and three-quarters of the freight earned from substituted goods.
