Case study -12. ColreGs Violation (Rule 10)

Own vessel had entered the southbound lane of a traffic separation scheme (TSS) in the approaches to a major Asian port. All pre-arrival notifications had been sent previously and the vessel traffic management system (VTS) was contacted on VHF at the designated reporting point. In compliance with the passage plan, speed had been reduced to manoeuvring full ahead, making about 14 knots, and the vessel was on manual steering. Suddenly, we observed a rogue northbound cargo ship, coming against the general direction of traffic flow, narrowly avoid another south-bound ship 2.5 miles ahead of us. We identified the rogue vessel on our AIS display, but received no answer to our calls on VHF and AIS. As a precaution, we reduced speed rapidly and altered our course to port. The rogue vessel passed on our starboard side, clearing us by about a cable, completely indifferent to the serious violation of Rule 10 and near misses with 2 vessels. As she passed by, 2 persons were seen looking at us through binoculars.

We notified the VTS of the situation and demanded that, in the interests of safety, they make it a practice to monitor vessels more effectively and issue timely warnings to contravening vessels and also alert general traffic in the vicinity.
