ВВЕДЕНИЕ

Предлагаемое пособие «Английский для международно-правовой деятельности» адресовано студентам, обучающимся по направлению «Юриспруденция», и направлено на формирование следующих компетенций, предусмотренных ФГОС ВО: ПК-13 («способность правильно и полно отражать результаты профессиональной деятельности в юридической и иной документации»), ПК-15 («способность толковать нормативные правовые акты»), ПК-16 («способность давать квалифицированные юридические заключения и консультации в конкретных видах юридической деятельности»).

Цель пособия: обучение иноязычному устному и письменному профессиональному общению, а также формированию навыков межкультурной коммуникации, включая стереотипы мышления и поведения в культуре изучаемого языка.

Пособие направлено на решение следующих задач:

расширить профессиональный лексическийзапас обучающихся;

развить умения и навыки ознакомительного, просмотрового, поискового и аналитического чтения с учетом профессиональной направленности;

сформировать умения и навыки говорения и письма на иностранном языке в сфере международно-правовой деятельности.

Пособие включает два основных модуля:

международное право;

сферы применения международного права.

Каждый модуль состоит из четырех разделов, охватывающих такие ключевые темы, как: типы международного права, предметы международного права, международное договорное право, международные организации, права человека, дипломатические отношения, юридические системы разных стран.

Для каждого модуля разработана система заданий, которая предполагает ответы студентов на ключевые вопросы по теме модуля, извлечение информации из текста для обсуждения, сопоставление фактов и сведений, лексическую работу, дискуссию по предлагаемым ситуациям.

Задания разделены по уровням сложности, отмеченным звёздочками, что помогает применить дифференцированный подход к обучению.

Пособие рассчитано на 36 академических часа аудиторной работы.

International law, also called public international law or law of nations, the body of legal rules, norms, and standards that apply between sovereign states and other entities that are legally recognized as international actors. The term was coined by the English philosopher Jeremy Bentham (1748 – 1832)” (Malcolm Shaw).

According to Bentham’s definition, international law is a collection of rules governing relations between states. Nowadays it is a rapidly developing complex of rules and principles, practices and assertions together with increasingly sophisticated structures and processes. In general, international law provides normative guidelines as well as methods, mechanisms, and a common conceptual language to international actors – i.e., primarily sovereign states but also increasingly international

organizations and some individuals. The range of subjects and actors directly concerned with international law has widened considerably, moving beyond the classical questions of war, peace, and diplomacy to include human rights, economic and trade issues, space law, and international organizations.

International law is an independent system of law existing outside the legal orders of particular states. It differs from domestic legal systems in a number of respects. For example, although the United Nations (UN) General Assembly, which consists of representatives of some 190 countries, has the outward appearances of a legislature, it has no power to issue binding laws. Rather, its resolutions serve only as recommendations–except in specific cases and for certain purposes within the UN system. Also, there is no system of courts with comprehensive jurisdiction in international law.

International law is a distinctive part of the general structure of international relations. In response to a particular international situation, states usually consider relevant international laws. Although considerable attention is often focused on violations of international law, states generally are careful to ensure that their actions conform to the rules and principles of international law, because acting otherwise would be regarded negatively by the international community. States that breach international rules suffer a decline in credibility that may be bad for their future relations with other states. International law also provides a framework and a set of procedures for international interaction, as well as a common set of concepts for understanding it.

***A. Read the extract from Conan Doyle’s story “The sign of four”

Miss Morstan entered the room with a firm step and an outward composure of manner. She was a blonde young lady, small, dainty, well gloved, and dressed in the most perfect taste. There was, however,

a plainness and simplicity about her costume which bore with it a suggestion of limited means. The dress was a sombre grayish beige, untrimmed and unbraided, and she wore a small turban of the same dull hue, relieved only by a suspicion of white feather in the side. Her face had neither regularity of feature nor beauty of complexion, but her expression was sweet and amiable, and her large blue eyes were singularly spiritual and sympathetic. In an experience of women which extends over many nations and three separate continents, I have never looked upon a face which gave a clearer promise of a refined and sensitive nature. I could not but observe that as she took the seat which Sherlock Holmes placed for her, her lip trembled, her hand quivered, and she showed every sign of intense inward agitation.

“I have come to you, Mr. Holmes,” she said, “because you once enabled my employer, Mrs. Cecil Forrester, to unravel a little domestic complication. She was much impressed by your kindness and skill.”

“Mrs. Cecil Forrester,” he repeated thoughtfully. “I believe that I was of some slight service to her. The case, however, as I remember it, was a very simple one.”
