1.Предмет контракта

2.1. Работодатель принимает Работника на основную работу на должность _________ и дополнительную работу для исполнения обязанностей______________________________________________

2.2. Прием на работу в соответствии с настоящим контрактом оформляется приказом руководителя, наделенного правом найма персонала предприятия.

3. Общие условия контракта

3.1. В соответствии с занимаемой должностью на Работника возлагаются обязанности, перечень которых оговаривается в Приложении к настоящему Контракту, являющемся его неотъемлемой частью.

3.2. Условия труда Работника, обязанности сторон по настоящему контракту, размеры и формы оплаты труда Работника, а также все прочие трудовые отношения между Работодателем и Работником регулируются нормами действующего трудового законодательства, Правилами внутреннего трудового распорядка, утвержденного Работодателем, настоящим Контрактом.

3.3. Подчиненность и подотчетность Работника определяется Работодателем в соответствии со штатным расписанием.

3.4.Работнику устанавливается пяти-ли шестидневная (41 часовая) рабочая неделя.

3.5. Работодатель оставляет за собой право привлекать Работника к исполнению его обязанностей в праздничные и выходные дни с предоставлением компенсации или внеочередного отдыха (отгула).

3.6. Праздничные дни определяются в соответствии с действующим законодательством. Выходными днями являются суббота и воскресенье, за исключением случаев, предусмотренных в п.2.5.

3.7. В рабочее время не исключается время обеденного перерыва и другие возможные перерывы, предусмотренные действующим законодательством.

3.8. При необходимости Работодатель вправе установить для Работника рабочее время по графику сменности. В этом случае выходные дни предоставляются в соответствии с этим графиком.

In 1997 Kazakhstan’s two pipeline associations, Yuzhnefteprovod, based in Caspian port in Aktau, and the Kazakh & Central Asian Trunk Pipeline Association (MN KISA), based in Pavlodar, were brought together under a new state-owned, closed joint stock company, Kaztransoil. The Central Dispatch function of the former Munaigas was turned into a separate state-owned entity called the Main Oil and Gas Department.

Many Kazakh productions areas are not connected to refining and consumption centers within the country, but to those in neighboring countries, and vice versa. Much of Kazakhstan’s oil is exported to Russia refineries in Samara and Ufa, in government-to-government swaps for Siberian crude that is refined in Kazakhstan’s Pavlodar refinery.

Kaztransoil controls around 6300 km of pipeline for crude oil and 1.100 km for oil products. It has over 3 million cubic meters of oil storage capacity, 32 pumping stations, 18 collection points, four railroad loading stations and two oil loading piers for Caspian vessels.

A number of factors have contributed to reduced use of oil pipeline capacity in recent years, including:

• Failing output at fields in western Kazakhstan as reserves decrease;

• Quotas imposed by the Russian pipeline company Transneft on oil exported via Russia;

• Falling supplies from Russia to Kazakhstan’s Pavlodar refinery;

• Falling imports by other Central Asian countries of Russia crude via the Omsk-Pavlodar-Shimkent line to Chardzhou, leaving this line almost completely idle.

All over the world tariff systems can be classified into four main types. The first type is represented by a single column tariff which consist one list of duties with a single duty rate for each article, applicable equally to imports from all countries. Duty reductions arranged by countries exercising such a system are usually universal for all the other countries. Germany, Japan, the Scandinavian countries are amidst those practising the single column tariff.

The second type used in customs practice is a maximum- minimum tariff. This involves the setting up of two columns of duties in the tariff. The lower rate is applicable to countries enjoying most-favoured-nation treatment whereas the higher to other countries. Sometimes maximum-minimum tariff include only one column (usually called the minimum tariff) and the rates of the maximum tariff are calculated by applying a percentage increase or multiplier to the minimum rates. France and Spain are among the countries using such a system.

The countries where are general-conventional tariff is used start with a single column of duties and proceed to establish a second column of conventional duties in negotiations with other countries. This second column contains only the items on which conventional rates have been settled and does not, therefore, coverall, tariff items, to which the general tariff is applied. The conventional rates are correspondingly common mostly with the countries of the most-favoured-nation treatment.
