Focus 7. Letters to make up.
Write a letter to a would-be foreign supplier. Follow the plan:
inform that you have received and considered the General Conditions of Delivery (see Focus 1);
advise of you decision to buy the equipment subject to alteration of some clauses of the General Conditions;
inform that the delivery dates should be specified as estimates rather than approximate dates (in the form of delivery schedule or shipping programme) and penalties should be fixed for delay in delivery;
the way of packing should be stated in detail, because the Sellers bear responsibility for damage to the goods caused by improper packing;
state that your usual business practice is payment by LC only;
enclose your variant of the General Conditions and inform that your representative is arriving in New York on 25 September and is ready to meet the Sellers’ representatives to negotiate the contract clauses;
don’t forget about a complimentary close.
FOCUS 8. Role play.
Hold negotiations with the Seller’s company on the General Conditions. The Sellers position is stated in the General Conditions of Focus 1. The position of the Russian company is stated in Focus 7. Try to find a variant suitable for both parties to the contract.
FOCUS 9. Act as an interpreter.
DIALOGUE 1
DIALOGUE 2
– Well, Mr Loginov, have you come to the final wording of Shipment and Packing clause? |
– It’s not a problem, as we will insure the goods against all possible risks. All the packing will be seaworthy and crushproof. |
– It implies that, firstly, partial deliveries are allowed, and, secondly, you are to effect partial payments for partial deliveries. |
– Exactly so. |
Dialogue 3
– Mr Zhdanov, I would like to remind you that clause 7 Installation and Site Preparation is a very important one. Unfortunately, we often face irresponsible attitude of the Customers to the environmental preparation of the site. |
– Do not forget about safe conditions of the premises. They should comply with workplace health and safety regulations. Otherwise, our personnel will not even enter the shops. |
– I’ll send the documentation to you as soon as possible. Proper installation without delays results in proper maintenance without claims. |
