II. Правильны ли утверждения?

1.FCA Frankfurt Airport means that the German seller is responsible for packing, transportation costs until the goods are delivered to the carrier at Frankfurt Airport defined by the buyer.

2.EXW is the incoterm with the lowest commitment (обязательство) of the seller.

3. FAS is an incoterm used for air transportation.

4. The difference between CIF and CFR is that the former includes insurance.

5. With “CIF Hong Kong” the insurance for transportation up to Hong Kong is covered by the buyer.

6. CIP can be applied to all modes of transport.

7. FOB prices for one and the same shipment are cheaper than CIF prices.

«FOB с укладкой и штивкой», «FOB без укладки и штивки», «FOB линейные условия», Продавец передаёт товар на своём предприятии. В соответствии с условием EXW покупатель несёт все расходы и риски при транспортировке товара. Покупатель оплачивает все пошлины, налоги и сборы и несёт расходы, связанные с предотгрузочным осмотром. Укажите вид транспорта, дату или срок поставки товара и пункт в месте, куда следует поставить товар. Продавец поставляет товар, не прошедший таможенную очистку при импорте в названный покупателем порт назначения. Продавец предоставляет товар в соответствии с договором купли-продажи. Покупатель обязан получить за свой счёт и риск любую экспортную или импортную лицензию или другое официальное свидетельство. Выполните все таможенные формальности, я возмещу ваши расходы. Продавец обязан нести все риски утраты или повреждения товара до момента его поставки. Продавец обязан предоставить товар в распоряжение покупателя на терминале.

General Conditions of Delivery (fob)

1. The goods are considered as delivered by the Seller and accepted by the Buyer:

  • in respect of the quality – as per the quality stated in the Quality Certificate;

  • in respect of the quantity – as per the quantity of packages and weight stated in the Bill of Lading.

2. The date of the Bill of Lading is to be considered as the date of delivery.

3. The Seller is bound to secure readiness of the goods for loading on vessel within the dates of delivery mentioned in the present (настоящем) contract. The Seller must inform the Buyer of the readiness of the goods for loading not later than 15 days before the beginning of the delivery dates.

The Seller must advise the Buyer within 24 hours concerning (относительно) shipment of the goods as following:

  1. date of shipment;

  2. name of the vessel;

  3. number of the Bill of Lading;

  4. number of Trans (if any).

Loading of the goods on the vessel at the port of departure including (включающая) lighterage and stowage in the holds of the vessel is to be effected by the Seller and for his account.

The Seller should secure dispatch by master’s mail of one non-negotiable copy of Bill of Lading and one copy of Weight List (Specification) which are to be passed to the Customs office at the port of destination.

4. The goods should be carefully packed in such a way as to prevent the cargo from any damages, deterioration of quality and shortages during long transportation by sea and railway, including several possible transshipments as well as to prevent the cargo from any atmosphere affections.

5. Claims, both in respect of the quantity and quality of the goods may be presented (предъявляться) within six-month’s period from the date of arrival (прибытия) of the goods at the port of destination.

In case during the acceptance of the goods on the territory of the RF there has been discovered non-conformity of the goods delivered to the requirements of the present contract, the Buyer has the right either to demand from the Seller a discount from the price of the goods at the rate agreed upon by the parties or to return the defective goods to the Seller for their replacement by the goods of the proper (надлежащего) quality. All the transport and other expenses connected with the delivery and return of defective goods are to be borne by the Seller. For delay in delivery of the goods the Seller must pay a fine.

6. All amendments and supplements to the present contract are made only if made in written form and signed by both parties.

7. All the previous correspondence and negotiations connected with signing of the present contract are considered as null and void from the date of signing the present contract.

8. Obtaining of Export License, if such is required, is the Seller’s responsibility.
