5.1 On-board complaint procedure
A complaint is defined as a breach of the requirements of the Maritime Labour Convention 2006
(including seafarers' rights). Complaints should be solved at the lowest possible level, whenever it is possible. Each seafarer shall address his complaint to his/her superior officer or head of department first, but however, in all cases, seafarers shall have a right to complain directly to the master and, where they consider it necessary, to appropriate MLC Owner, Crewing Manager, Flag State or appropriate external authorities. The seafarer has the right to be accompanied or represented during the complaint procedure and shall not be victimized.
In general the Safety Officer is appointed on board to deal with complaints, but in any case the seafarer is free to ask for assistance to any other crew member.
Complaints Procedure:
1.Should a seafarer want to raise a complaint; he should address it to the head of his/her department or the immediate Superior officer in order to resolve the complaint at the lowest level.
2.Whenever practical, complaints should be dealt with within a period of twenty-four (24) hours.
3.Whenever a resolution of the head of the department or immediate superior officer is not possible, the seafarer can take the matter to the master or the officer in charge / safety officer, who shall deal with it within a period of three (3) days.
4.If the complainant seafarer brings the complaint to the attention of the Master, the Master shall handle the complaint personally and if he considers necessary, may seek the assistance of the person designated by the ship-owner to handle complaints.
5.In case the Master is unable to resolve the complaint, the seafarer may refer to the MLC owner or his representative (Crewing Manager) who shall resolve the matter within one month.
6.If after one month , the complaint has not been resolved, the matter is to be brought to the Contact Point of the Vessel's Competent authority in the Flag State
7.Throughout the whole process, the seafarer shall have the right to seek confidential and impartial advice by the appointed seafarer on-board. The appointed seafarer has the responsibility to provide the seafarer with impartial advice, shall on request be able to advice the seafarer on the procedures available to him/ her and, if requested by the complainant seafarer, to attend any meetings or hearing taking place into the subject matter of the complaint.
