ON THE ÒRULE OF LAWÓ JUDICIAL DOCTRINE

The author brießy reviews the history of the concept of Òrule of lawÓ in its legal and philosophical senses. Then he characterizes the concept in todayÕs Russia by sketching its history in modern Russian constitutionalism, describing its essence as judicial doctrine, and identifying problems for its development. In the end of the article the author characterizes the concept from constitutional economicsÕ point of view.

CONSTITUTIONAL STATUS OF THE BRITISH HOUSE OF LORDS

In the article the author distinguishes four stages in the history of reforms of the British House of Lords. Particular attention is paid to the government bill envisaging the introduction of the principle of election of members of the upper house. The author explores the consequences of passing this bill for the political system of the United Kingdom.

THE CONSTITUTIONAL PRINCIPLE OF SEPARATION OF POWERS: THE EXPERIENCE OF PARLIAMENTARY INVESTIGATION

The article reviews the constitutional principle of separation of powers in the Republic of Poland in light of a decision of the Constitutional Tribunal. The Constitutional Tribunal resolved the issue of the parliamentary right to investigate the activities of the President and the National Bank of the Republic of Poland. By reference to provisions of current legislation, the decision of the Constitutional Tribunal and the views of modern legal doctrine, the author concludes that the Constitutional Tribunal acted as ÇHŸnter der VerfassungÈ and its decision Þlled signiÞcant gaps of positive law in matters of parliamentary control.

The article is about two di erent models of judicial review: the American one and the European one. The author gives a brief review of how the American model a ected the European one during its history; identiÞes the main di erences between the two models and gives reasons for those differences; describes paradoxes revealed by these di erences; and characterizes some forms of convergence between those models.

ARGUMENTATION OF THE RUSSIAN CONSTITUTIONAL COURTÕS JUDGEMENTS: FROM ITS MOVE TO ST. PETERSBURG

TO THE KONSTANTIN MARKIN CASE

This paper examines the case law of the Russian Constitutional Court containing references to the European Convention on Human Rights from the moment of the Constitutional CourtÕs move to St. Petersburg until the judgment of the European Court of Human Rights in the case of Konstantin Markin. It is submitted that most of the references are limited to a brief mention of the more or less relevant provisions of the Convention. More detailed references to the Convention are also assessed. The Constitutional Court provides detailed reasoning under the Convention in order to interpret the Russian Constitution and to deÞne the criteria of applicability of its provisions. Judgments of the Constitutional Court contribute to the execution of judgments of the European Court, on the one hand, but limit larger constitutional rights to narrower Convention rights, on the other. It is argued that the case law by which the Constitutional Court tries to justify, by reference to the Convention and the European CourtÕs case law, what is unjustiÞable thereby raises most serious concerns.

THE EXPERIENCE OF THE APPLICATION OF THE EUROPEAN CONVENTION IN THE JUDICIAL PRACTICE OF THE CONSTITUTIONAL TRIBUNAL OF THE REPUBLIC OF POLAND

This article is about the application of the European Convention for the Protection of Human Rights and Fundamental Freedoms in the judicial practice of the Constitutional Tribunal of the Republic of Poland. The Þrst chapter presents the scope of substantive jurisdiction of the Tribunal. The second chapter deals with the interactions between the Polish Constitution and the Convention. The third chapter focuses on the practice of referring to the Convention in the rulings of the Polish constitutional court. Finally, the fourth chapter is devoted to drawing conclusions. This article is based on the assumption that the practice of the Constitutional CourtÕs application of the Convention is incoherent and should be structured and systemised.

COMMUNISM AS SOCIAL UTOPIA AND LEGAL FICTION: THE CONSTITUTIONAL PROJECT

OF THE THAW PERIOD Z1961=1964[

The quite reasonable rejection of nominal Soviet constitutionalism in contemporary political debates does not mean the inappropriateness of substantive studies of its illusions, methods and mistakes. The object of this article is the Soviet Constitution of 1964, which was intended to implement Communism as a legal Þction and to serve as the basis for the juridical construction of the whole social, legal and political system. From this cognitive and anthropological perspective the author reconstructs not only the historical context of this experiment but also explores the origins of political ideas of the Perestroika era and the di culties of forming contemporary Russian constitutionalism. Showing the general failure of Communism as a legal ideology, the author follows SpinozaÕs admonition Ònot to laugh, not to despair but to understandÓ as a guiding principle.
