Problem: The purpose of writing this article is to analyze the objective evidence of illicit trafficking of potent and toxic substances in order to market. Distinguishes these objects with medications, as well as biologically active additives and doping agents. acquisition, storage, recording, release, transport or delivery of potent and toxic substances.

Model: In preparing the articles analyzed item 234 of the Criminal Code (trafficking in strong or poisonous substances for marketing purposes).

Conclusions: Analyzed objective evidence of illicit trafficking of potent and toxic substances in order to market will distinguish potent and poisonous substances with drugs, drug products and biologically active additives. The problem of the subject of this crime is that the criminal responsibility of item 234 of the Criminal Code can occur only after the matter will be included in the prescribed manner to the corresponding list of strong or poisonous substances. Without this it is impossible to talk about the presence of signs of the crime in question.

Originality / value of the article: Work is intended for faculty members of law schools, post-graduate students, job seekers and students interested in the problem of the subject crime under item 234 of the Criminal Code of the Russian Federation.
