3 LAW-ENFORCEMENT AUTHORITIES AND THE JUDICIAL SYSTEM OF THE REPUBLIC OF KAZAKHSTAN

Court is the judicial power organ that is included to the judicial system of the Republic of Kazakhstan and it implements the justice by civil, administrative and criminal issues in procedural order.

Justice is implemented by court human rights activity on the consideration of civil, criminal and other issues at the continued compliance of law requirements and established by them order providing legality, reasonableness, fairness and universal validity of judgments.

Judicial power is imperious powers of the court applied in the sphere of criminal, civil and other established by law form of proceedings; directed to the consideration and resolution of all issues and disputes about the violated law. Judicial power in the Republic of Kazakhstan belongs only to the courts in the face of permanent judges and juries involved to the criminal proceedings in case and order not provided by law.

Juridical responsibility is the application of measures of state coercion towards an offender for committed by him/her offence associated with the suffering of a guilty from depriving of private or non-property character. Criminal legal, administrative legal, disciplinary, material, civil legal and etc. responsibilities refer to the juridical responsibility.

Judicial system is the system of courts that interprets and applies the law in the name of the state. Under the doctrine of the separation of powers, the judiciary generally does not make law or enforce law, but rather interprets law and applies it to the facts of each case. This branch of the state is often tasked with ensuring equal justice under law. It usually consists of a court of final appeal, together with lower courts.

OBLIGATIONS OF JUDGES

Strictly observe the Constitution and laws to protect the rights, freedoms and legitimate interests of citizens and organizations

In the performance of their duties, as well as during off-duty relationship to avoid anything that might discredit the authority of justice, the dignity of a judge or call into question his objectivity and impartiality

Oppose any attempts of illegal interference in its activities

Protect the confidentiality of deliberations and information obtained during closed court hearings.

Supreme Court of Republic of Kazakhstan is the highest judicial body for civil, criminal situations. The jurisdiction of local and other vessels engaged in procedural forms provided supervision of their activities and provide explanations on issues of judicial practice.
